July 2009, NAC submitted to AIRC that: Aquaculture production be Award-free because: Historically award free Variable working arrangements due to weather and sensitivity of aquatic animals to environment – need flexible workforce There is a transitional period for those currently under Award (e.g. Tas) The safety net for workers is the National Employment Standards (NES) and annual minimum wage decision. The NES provides protection on hours, leave, etc. AIRC hearing is 12 Aug 2009. NAC asking AIRC to give early decision to leave time for NAC submit its Draft Award

AWU Submission Applies to all aquaculture and fishing Ordinary time is 38 hrs/week, but can be spread over 152 hrs (4x38) or any other cycle agreed by employer/employee Ordinary time at base rate (or base plus 25% loading for casual) is 10 hrs max/day over 5.00am-8.00pm Overtime (outside above hrs. Mon/Fri) is Sat. 150% first 3 hours, and 200% after that. Sunday is minimum 4 hours, and 200% all hours.
