Motorcycle riders are more vulnerable because of the nature of the vehicle they are riding compared to other motorists. This gives motorcyclists a greater risk of injury during an accident. According to the National Highway Traffic Safety Administration (NHTSA), 93,000 motorcyclists were injured in 2012, which is a 15% increase over 2011.
In 1997, 2,116 motorcyclists were killed on our roads and highways. That number has steadily increased each year. By 2005, that number had more than doubled to 4,576 deaths and in 2008 fatalities reached an all-time high of 5,312 deaths. The NHTSA estimates that “per vehicle traveled, motorcyclists were more than 26 times more likely than passenger car occupants to die in a traffic crash.” Even with the increased awareness of motorcycle safety because of federal and state safety programs, 4,957 motorcyclists lost their lives during 2012.

Common Causes of Motorcycle Accidents Driver Inattentiveness
One of the most common causes of motorcycle accidents is other drivers. Due to the inattentiveness of other drivers and their failure to properly yield to motorcycles, motorcyclists are at a greater risk of injury from accidents. Motorcycles are smaller than other vehicles on the road and some drivers simply do not pay enough attention to motorcycles on the roadways. Therefore, drivers of trucks and cars turn left in front of motorcycles, rear-end motorcyclists and shift lanes in front of motorcyclists. Motorcyclists must be very cautious while riding because they must pay attention to road conditions and their own driving while trying to avoid an accident caused by an inattentive driver.
Even though a motorcycle may be more difficult to see because of its smaller size and only having one headlight, it is no excuse for an inattentive driver. When a driver negligently or recklessly causes an accident, the motorcyclist has the same rights as any other driver on the road. Unfortunately, motorcyclists

face a certain level of prejudice and negative attitudes toward motorcyclists on the road. Many people automatically assume that it is the motorcyclist’s fault when an accident happens. Therefore, motorcyclists should hire an experienced motorcycle accident attorney who has expertise in overcoming predisposed opinions about motorcyclists and who knows what resources to use to prove that the driver was at fault for the accident. Dangerous Road Conditions and Intersections
Another common cause of motorcycle accidents are bad road conditions and dangerous intersections. While the motorcyclist cannot control road conditions or intersections, he or she should be very cautious when riding and remain alert for changes in road conditions or intersections with limited visibility. However, in some cases, a third party may be at fault for bad road conditions or dangerous intersections. Consulting with an experienced personal injury attorney is the best way to determine if you have a claim against a third party for your injuries.

Types of Damages You Can Recover in a Motorcycle Accident Case
Because motorcyclists are at a greater risk for severe and catastrophic injuries from accidents, the damages associated with motorcycle accidents can be astronomical. Not only do victims have current medical expenses, many have long-term medical conditions that will require ongoing medical and/or personal care. The costs of these services can easily reach into the hundreds of thousands if not millions of dollars. For this reason, you want a highly-skilled motorcycle accident attorney who understands what is needed to prove current and future damages.
Damages that you may be entitled to include but are not limited to:
Past and future medical costs including costs for ongoing medical care or future medical treatments Pain and suffering Funeral expenses in the event of a fatality Past and future lost wages Lost earning capacity Property damage Loss of spousal relations Loss of enjoyment of life Permanent disfigurement or disability Mental anguish

What Should I Do If I Am Involved In A Motorcycle Accident?
Immediate medical attention is your first priority when you are involved in a motorcycle accident. As soon as possible, contact our office to speak with one of our attorneys to discuss how to proceed. It is important that we begin an investigation as soon as possible to preserve evidence such as taking photographs of the accident scene as close to the time of the accident as possible and gathering evidenced from the accident scene before it is destroyed (i.e. skid marks, debris, etc.).
It is important that you do not discuss your case with the other party, his or her insurance company or representatives. An insurance adjuster may ask for a recorded statement or medical release; however, you should decline until you have consulted with an attorney. Do not be fooled by an insurance adjuster who appears to have your best interest at heart. His or her job is to pay the lowest amount of money to settle your claim.
It is our job, as your attorney, to maximize the amount you receive as compensation for your injuries. Contact our office so that we can handle the

About Bolton & Gross
Richard Bolton and Mitchell Gross have been practicing together for approximately 20 years. Initially, the firm was focused on representing insurance companies, their insureds, self insureds, and Fortune 500 companies. At that point, Bolton and Gross represented these entities as defendants. We took many cases to trial on behalf of these entities as defendants.
Over the years, we learned how insurance companies and self insured corporations handled their legal matters. They showed no compassion to the injured parties and would go to all lengths to win a case. This type of work left us totally unfulfilled.
Approximately 10 years ago we changed the focus of our practice. We now represent, exclusively, the injured parties. We use our experience representing the defendants to obtain the maximum possible recovery for our client.
At Bolton and Gross we view each case individually. We realize each and everyone of our clients are people who have different needs and different motivation, etc. We try to advise our clients as to their possible decisions and do everything we can to get them the best recovery that is consistent with their desires.
Here at Bolton and Gross we provide our clients with compassionate, aggressive, and individualized representation.
