11. By Dec. 1992 the EIA Decree, now the Environmental Impact
Assessment Act (Cap E12) LFN 2004 (EIA Act), was enacted;
The enactment of the Environmental Impact Assessment (EIA) Act
No. 86 of 1992 is a clear demonstration of the Federal Government's
commitment to environmental sustainability. An Environmental
Impact Assessment (EIA) is an assessment of the potential impacts
whether positive or negative, of a proposed project on the natural
environment. Transformation of the EIA Act, into implementation
stage resulted in the formulation of the EIA procedural guidlines of
1995 and the EIA process.
The EIA procedure was developed as a step by step guide for the
prediction of environmental impacts of any development activity
and to provide an opportunity to mitigate against negative impacts
and enhance positive impacts. Thus, EIA has three main functions:
v To predict problems,
v To find ways to avoid them, and
v To enhance positive effects.

12. Benefits of carrying out EIA of planned projects are:
1. improved project design/siting;
2. promotes informed decision-making;
3. promotes environmentally sensitive decisions;
4. increased accountability and transparency during the
development process;
5. improved integration of projects into their environmental and
social setting;

7. improved corporate image of the developer;
8. a positive contribution towards achieving sustainability.
9. EIA ensures that the potential problems are foreseen and
addressed at an early stage in the project planning and design.
10. Avoidance or minimization of adverse environmental effects;
11. Increased protection of human health;
12. Reduced project costs and delays;
13. Reduced risks of environmental harm or disasters;
14. Increased government accountability and harmonization;
15. Lessened probability of trans-boundary environmental effects;
16. Informed decisions that contribute to responsible development
of natural resources.

13. General Objectives of EIA
The objectives of any environmental Impact assessment are:
To ensure that environmental considerations are explicitly
addressed and incorporated into the development decision making
process;
To anticipate and avoid, minimize or offset the adverse significant
biophysical, social and other relevant effects of development
proposals;
To protect the productivity and capacity of natural systems and the
ecological processes which maintain their functions; and
To promote development that is sustainable and optimizes resource
use and management opportunities.
The benefits of EIA are widely recognized, yet the approach has
palpable limitations:
• Time consuming and costly
• Partial implementation of the EIA process
• Non-availability of reliable data
