Dear Ms. Bose:
I have just learned of the latest attempt by Crown Hydro to delay FERC's initiation of
termination proceedings of the license to construct a hydroelectric facility on public land
in Minneapolis. The letter (reference 4, above) submitted by the Law Offices of GKRSE
on behalf of Crown Hydro, LLC is nothing more than a desperate effort to drag out the
termination of a project by misleading FERC into believing that by some miracle the
Minnesota Legislature will approve the seizure of the land Crown Hydro wants.
The legislation that was introduced during the last session to seize the land died without
action, and with very few supporters, when the regular session of the Minnesota
Legislature ended May 23, 2011.
The Special Session of the legislature that was convened on July 19, 2011 and ended on
July 20, 2011 was called by the Governor solely for consideration of passing a state
budget and ending a government shutdown. No other legislation was introduced or
considered, least of all the Crown Hydro bills.
Crown Hydro's claim that another Special Session is anticipated in October or November
2011 "to address substantial unfinished legislative business" is totally misleading. The
only reason Governor Dayton has stated he would even consider calling another Special
Session would be if an agreement is reached by numerous business and government
entities for the construction of a new football stadium for the Minnesota Vikings in Arden
Hills, MN. Whether such agreement can be reached is very much in doubt at this time,
and no Special Session is likely to be called.

Crown Hydro's claim that they "have commitments from the legislative leadership" to
seek passage of the two failed bills is just more smoke and mirrors. Prior to the end of the
regular legislative session, several of the original sponsors of the bills requested that their
names be stricken, indicating that once the members became aware of the facts of the
situation, they declined to support Crown Hydro's efforts to seize public land for a
private for-pmfit enterprise.
It is time for FERC to put this project out of its misery by terminating the License No.
11175-024 immediately. No progress has been made on this project since 1999 when the
license was first issued. Crown Hydro has continued to string FERC along with promises
of action to secure site control that never happen.
I urge FERC to cease listening to this fantasy that is being spun by Crown Hydro's legal
team and terminate their license now so that our community can move on without the
constant harassment by a developer with a bad idea that has virtually no local support.
