The Centre wants to increase maternity leave for working women from 12 weeks to
26 weeks, but doctors working on short-du ration contracts with govern ment
hospitals get none at all Some women doctors have had to quit their jobs to plan a
baby .“In the past six months, I have received more than 50 complaints from
women col leagues who found it difficult to get maternity leave. Most of them were
employed in Delhi hospitals on ad hoc basis,“ said Dr Pankaj Solanki, president of
Federation of Resident Doctors' Association (FORDA). He added that few got leave
despite FORDA's intervention.
The Maternity Benefits Act, 1961 entitles a working woman to 12 weeks of
maternity leave, of which six weeks can be taken before the expected date of
delivery .
Delhi has public hospitals run by the municipal corporations, the state government
and the Centre, besides a few under Delhi Cantonment Board. Doctors say that the
problem prevails in all of them due to lack of clarity and, in some cases,
unwillingness to support an ad hoc employee seeking maternity leave.

“The common refrain is, quit your job or do not apply for extension if you
want to have a baby ,“ said an ad hoc doctor at Cantonment General
Hospital.
Dr Balvinder Singh, assistant professor with the orthopaedics department at
Safdarjung Hospital, added: “Most of our senior residents working on ad hoc
basis do not plan their family until they get a regular job, to avoid
confrontation with the administration over maternity leave. Others quit.“ A
senior army doctor, ho wever, said ad hoc appointments are made for short
durations and it is not possible to grant long leave.
“We make ad hoc appointments for three months to six months, or till the
time regular appointment is done. If the ad hoc employee is allowed to go on
paid leave during this short duration, the very purpose of hiring is defeated,“
said a senior health official at Directorate of Health Services, Delhi
government.

TOI spoke to Swati Maliwal, chairperson of Delhi Commission for
Women. She said the law allows for maternity leave to both contractual
and regular employees.
“There should be no discrimination. We are aware of some issues in
the implementation of this policy and we are working to change the
situation.“
Women's rights activist Ranjana Kumari said that the law for maternity
leave is openly flouted in many hospitals across the city. “We have been
working in this area for long but there is little improvement.“
