3. Brief History of Music Piracy
Since 1999 and the emergence of Napster, music piracy has
become more widespread and prevalent because of the accessibility
of the Internet. The file sharing program Napster was developed by
Shawn Fanning in order to make finding and downloading music
over the Internet easier. Napster quickly grew, and was used by
millions but this got the attention of the Recording Industry
Association of America (RIAA). They sued Napster at the U.S.
District Court of San Francisco for “assisting others in the copying,
downloading, uploading, transmission, or distribution of copyrighted
musical work".

Napster was shut down shortly after this case, but many other
similar file sharing sites appeared in its stead. Since then, millions
of people all across the world have adopted music piracy as a
regular practice.

5. What is Music Piracy
Music piracy is generally described as the
deliberate infringement of copyright and/or trade marks
for commercial gain. It covers both physical and
internet piracy. There are three types of physical
piracy:
1. Simple Piracy;
2. Counterfeits; and
3. Bootlegs
6. What is Music Piracy
• Simple piracy - the packaging of the pirate copy is different
from the original. They are often compilations, such as the
"greatest hits" of a specific artist, or a collection of a specific
genre, such as dance tracks
• Counterfeits - the packaging of the pirate copy resembles the
original as closely as possible. The record companies' trade
marks are reproduced in order to mislead the consumer into
believing that they are buying an original product.
• Bootlegs - these are the unauthorised recordings of live or
broadcast performances.

costs that would be incurred if you would have
decided to buy it.
• Supporters of downloading music claim that
making music readily available contributes to the
increased popularity of the artists.

Cons
• Though downloading music makes it easily
available to the masses, it also makes it spread
far and wide overly. Something that is very
easily available is also of a lesser value.
• The practice of downloading music leads to the
diminishing of sales of music cassettes, CDs
and DVDs.

Cons
• Downloading music gives rise to copyright and
piracy issues. By downloading music you lose its
originality. When you use the copied versions of
music; you indirectly encourage piracy. As you
download music, you do not go for the purchase
of the original copies of music, which may result
in an indirect violation of copyright.
