1. The Charges against Dilbert
The Charges
i) Possible breach of Section 13 (3) of the PS Act 1999 which states that an APS employee, when
acting in the course of employment, must treat everyone with respect and courtesy, and without
harassment.
Particulars: On Tuesday 18 th February 2003 you sent an e-mail to one or more ATO employees containing
sarcastic and belittling commentary and a Dilbert cartoon graphic. The tone and content of this e-mail was
disrespectful and discourteous to other ATO employees and ATO managers.
ii) Possible breach of Section 13 (8) of the PS Act 1999 which states that an APS employee must use
Commonwealth resources in a proper manner.
Particulars: On Tuesday l8th February 2003, using ATO computer facilities, you sent an e-mail to other
ATO employees in which there was embedded a Dilbert cartoon graphic.
This use of the Dilbert graphic does not comply with the requirements of the ATO National Policy - The
