35. Lead Based Paint Disclosure
If property was built prior to 1978, the three page
Lead Based Paint Disclosure (LBP) form will be required
with the contract packet.
The LBP Disclosure form can be found under the“Addendums” tab
of property details on HUDHomestore.com.
• Manging Broker must initial one of the three financing types.
• Purchaser(s) must initial two acknowledgements on page
three, Managing Broker to initial third acknowledgement.
• Both Purchaser(s) and Managing Broker must sign page three.
36. Buyer’s Prequalification Letter
Must be on lender letterhead dated within thirty days of the bid
date with no contingencies and include the following:

Loan Type, Amount and Sales Price
Must State Credit Has Been Reviewed and Approved
Must State that a Written Application has been Made

37. Proof of Funds
If the purchaser(s) is paying cash for the property they
must show proof of available funds equal to or greater
than the accepted bid amount.
Proof of funds needs to be dated within thirty days of the bid date
and signed by a bank official and include the case number
and property address on it.
38. Earnest Money
MUST be certified funds payable to the buyer selected title
company or the buyer. (Unified Title or John Doe).
The physical earnest money check, a copy of the sales contract
and a copy of the Buyer Select Closing Agent Addendum
MUST be delivered to the listing agent’s office within
two business days of bid acknowledgement.
