How should the Judge Decide? The criterion is the weighing mechanism for the judge. In other words, it helps the judge decide which arguments to consider and how they should be interpreted
Different Types of Resolutions Each type of claim has a criterion that is most commonly used Claim of Fact Preponderance of evidence Claim of Value On balance Claim of Policy Net benefits
Unique Criterion Notice how all of these are fairly general Criterion do not need to be this general if they can be justified Any philosophical concept that allows for judgment of the rightness or wrongness of an action can usually be a criterion
