• The AGENT guarantees that they will replace
(one time only) a worker who is found to have
performed serious form of misconduct that
led to his immediate repatriation back to The
Philippines or for those workers who on his
own accord decided to resign and return to
the Philippines within the probationary period
of the worker. This is provided that the
COMPANY is not at fault and that due process
was strictly observed.
19. • The AGENT does not accept responsibility for
the work performance of the worker if the
worker has been selected by the COMPANY or
its representative, however the AGENT will
replace the worker if the worker is unable to
carry out the duties for which he was
originally recruited by the AGENT within the
first three (3) months of employment. The
AGENT will replace the worker free of charge.
20. • The AGENT shall pay for the airfare of the
worker back to The Philippines where the
worker is declared by the authorized Physician
to be quot;unfit to workquot; overseas or in the
assigned position, immediately upon arrival in
Australia to commence work;
