• Marital rape is any unwanted sexual acts by
a spouse or ex-spouse, committed without
consent and/or against a person's will, obtained
by force, or threat of force, intimidation, or when
a person is unable to consent.
3. TYPES OF MARITAL RAPE
• 1. Battering rape:
▫ In battering rape, women experience both physical and
sexual violence in the relationship and they experience
this violence in various ways.
• 2. Force-only rape:
▫ In what is called force-only rape, husbands use only the
amount of force necessary to coerce their wives
• 3. Obsessive rape:
▫ Other women experience what has been labeled as
sadistic or obsessive rape
4. KEY FACTS ABOUT MARITAL RAPE LAW
AND THE REALITIES OF MARITAL RAPE.
• Until 1976, rape laws in all 50 states contained a Marital
Rape Exemption specifically to prevent husbands
who raped their wives from being charged with a
crime BEFORE.
• As of 1996, only 17 states and the District of Columbia had
abolished this exemption completely.
• While all 50 U.S. states have laws against marital rape, 33
of the states consider marital rape a lesser crime
than other types of rape–typically they charge the
attacker with spousal abuse or battery instead of
rape.

common type of rape. Ten to 14 percent of all
completed rapes are committed by husbands
or ex-husbands, and in keeping with rape
reporting statistics nationwide, experts believe
this is an underestimation of the actual
incidence of marital rape.

7. Act for marital rape in Malaysia
• Rogol isteri dipenjara 10 tahun, 4 kali sebatan KUALA
TERENGGANU 17 Jun 2007.
• Mahkamah Sesyen di sini hari ini menjatuhkan hukuman
penjara 10 tahun dan empat kali sebatan terhadap seorang
lelaki atas tuduhan merogol isterinya. Hakim Zainal
Azman Abdul Aziz membuat keputusan itu terhadap
Zainal Muda, 38, berdasarkan Seksyen 375 Kanun
Keseksaan selepas mengambil kira perintah ex-parte oleh
Mahkamah Tinggi Syariah yang mengarahkan supaya
pasangan itu dipisahkan serta tidak melakukan hubungan
seks sebelum kejadian berlaku. Mengikut kertas
pertuduhan, Zainal dari Kampung Durian Mas, Manir di
sini dituduh merogol isterinya di rumah Lot 16061,
Kampung Hulu Takir, Kuala Terengganu kira-kira pukul
7.45 pagi pada 10 Mac 2005.

ordinance made such a crime a cognizable offence.
