 CarMax Reports Increase In Used-Car Sales In 2Q

 CarMax Inc. reported net income of $103 million in the second quarter ended Aug. 31, compared with $14 million in the year-ago
 period. The company’s sales increased 13 percent $2.08 billion from $1.84 billion in the second quarter of last year. Comparable
 store used-vehicle sales increased 8 percent in the second quarter, while new-vehicle sales dropped 19 percent. Used vehicle gross
 profit increased to $2,120 per unit from $1,870 per unit in the prior year quarter. The company said the improvement resulted from
 a combination of factors, including the continued appreciation in used car wholesale values since January 2009, an increase in
 inventory turns and the robust sales environment experienced in the quarter.


 Copart Earnings Down, But Company Strengthens Balance Sheet

 Although Copart reported double-digit declines in its fourth-quarter earnings, president Jay Adair expressed optimism about the
 company's overall performance, and said he was pleased with how the company's strengthened its balance sheet throughout fiscal
 2009, which ended July 31. More specifically, operating income was $55.4 million, down 15.3 percent from a year ago. Income from
 continuing operations was $34.6 million, which dipped 15.2 percent year-over-year. Quarterly revenue was $184.3 million, which
 was off 10.6 percent from the same period of fiscal 2008.

Edmunds.Com Forecasts Sept Auto Sales: Industry Down Over 40 % From Cash For Clunkers Boon

U.S. new-vehicle sales are expected to hit the low point of the year, reflecting the absence of the government's cash-for-clunkers
program to get gas guzzlers off the road along with the resulting drop in inventory at most showrooms. Car-shopping Web site
Edmunds.com projected a 23% decline from a year ago to 742,000 units, which is a 41% plunge from August. Earlier Thursday, J.D.
Power & Associates projected a 29% drop on year to 710,000. Despite the downturn this month, Edmunds.com Chief Executive
Jeremy Anwyl said sales in recent days have gained some momentum, with vehicles bought through clunkers deals and being
delivered in September also aiding this month's results.

Ford Sees Super Duty Returning To The Top

Ford Motor Co. hasn't forgotten how to build big trucks. Although the automaker has been busy developing and promoting new cars
such as the Taurus sedan and Festiva compact, it will turn back to trucks today, unveiling the 2011 Super Duty pickup at the State
Fair of Texas. The new Super Duty - a heavy-duty behemoth that typically weighs more than 6,000 pounds - aims to help Ford
reclaim some of the profitable heavy-duty pickup sales that have sunk beneath the weight of high fuel prices and a collapsing
economy. Although the trucks are intended primarily for use in construction, agriculture and other heavy work, they also attract
casual or recreational buyers who tow boats, horse trailers and other big toys.


Ford To Build Third Car Assembly Plant In China - Continuing Coverage

Ford Motor Co. Friday announced it plans to build a new car assembly plant here, its third such facility in China, part of a broader
effort to overcome the auto maker's late start in China and catch up with key competitors. The new plant, to be built with an
investment of $490 million (3.34 billion yuan), will be run jointly with a Chinese partner, Chonqing Changan Automobile Co., and
Japan's Mazda Motor Corp., as are its two existing plants. It will produce Ford's next-generation Focus compact car and be capable
initially of producing 150,000 vehicles a year when it opens in the city of Chongqing in southwestern China in 2012, the company
said.

GM Speeds Up Supplier Payments

General Motors Co. said Thursday it will pay suppliers more frequently in a move to improve the company's cash flow and appease
struggling parts makers. Starting Nov. 1, GM will launch a system in which suppliers of auto parts and logistics materials are paid
weekly rather than every 47 days. The length of time between parts payments has been a major contributor to the financial problems
of U.S. auto suppliers, many of which have declared bankruptcy in recent years. GM's move covers 1,400 parts makers and 300
logistics suppliers in North America, with a plan to eventually implement the new schedule around the world.


Losing Ground In Auto Financing, GMAC To Offer New Financial Incentives To Dealerships

GMAC Financial Services, the former financing arm of General Motors Co., is making a new push to recapture its share in the auto
financing business by offering incentives to its most loyal dealers. The government-subsidized lender starting Oct. 1 will offer cash
incentives and services to its U.S. dealers, spokeswoman Sue Mallino said Thursday. The program will be called Ally Dealer Rewards
-- named after its newly rebranded consumer banking arm Ally Bank -- although the program will be administered by GMAC's
automotive unit.

U.S. Watchdog To Study GM, Chrysler Dealer Closures

A U.S. Treasury Department watchdog will study decisions by General Motors Co and Chrysler to cut more than 2,000 dealers, a key
bailout watchdog said on Thursday. Neil Barofsky, special inspector general for the Troubled Asset Relief Program, said his office
will examine the process used by the automakers to identify which dealerships to maintain or terminate, as part of their
restructuring processes. The Obama administration's autos task force has provided more than $60 billion in bailout financing from
the TARP fund for GM and Chrysler, which have both emerged from bankruptcy. Hundreds of dealers assert that their rights were
trampled on during the automakers' bankruptcies, leaving them with little or no legal recourse.

FCC Defends Internet Regulation Authority; FCC Asserted Its Authority To Regulate The Internet Under Its
Ancillary Authority Over “All Interstate And Foreign Communication By Wire Or Radio”

The FCC this week told a D.C. federal appeals court that it had the authority to take action against Comcast for "covertly interfering"
with BitTorrent peer-to-peer traffic in violation of Internet openness principles, and doing so in an adjudicatory proceeding rather
than a rulemaking. That argument was made in a brief to the court on the same day FCC Chairman Julius Genachowski announced
he proposed codifying and expanding those principles. The commission also more broadly asserted its authority to regulate the
Internet. "Congress created the FCC for cases such as this one," it told the court. "Congress gave the agency broad and adaptable
jurisdiction so that it can keep pace with rapidly evolving communications technologies."


FCC Seeks Input On Finding More Wireless Spectrum; Wants Additional Comments About Whether
Allocations Are Sufficient For Wireless Broadband Needs

The Federal Communications Commission is seeking more comment on whether current wireless spectrum allocations are sufficient
for the growing needs of wireless broadband. In a public notice released Sept. 23, the commission said it wanted more facts and
data. It has already asked about wireless spectrum use in its just-opened proceeding on innovation in wireless, but is now
responding to specific comments in its national broadband plan proceeding about the need for more spectrum. Among the things
the commission wants to learn is the ability of current allocations to support next-generation services and what bands would be best
positioned to provide more spectrum.


Time Warner Cable Learning From "El Paquetazo" Rollout; Residential Services President Hirsch Discusses
L.A. Launch Mistakes

Time Warner Cable is still in the early stages of rolling out its "El Paquetazo" programming package, but it is already learning from
its mistakes in how to market it. Jeffrey Hirsch, president of residential services for Time Warner Cable's New York region discussed
the service at the B&C/Multichannel News Hispanic Television Summit Sept. 24. Hirsch says the goal is to make the product, which
features about 40 Spanish-language channels and 100 English channels, the go-to television package in the Hispanic marketplace.
"Because it is a new brand geared toward bicultural households, it gives us brand awareness that we didn't have in that community
before," he said.


Time Warner Cable Powers Up Wideband In Big Apple

Time Warner Cable's New York City division cut the ribbon Thursday on 50-Mbps DOCSIS 3.0-based Internet service, which the
operator will use to battle Verizon's FiOS Internet in the nation's biggest market. Time Warner Cable is marketing "wideband"
services to New York residents and businesses, touting top speeds of 50 Mbps downstream and 5 Mbps up. New York is the first
market TWC is rolling out DOCSIS 3.0 next-generation cable modem technology.

Wall Street Turns Wary Of Research In Motion; Blackberry Maker's Revenue Climbs 37%, But Disappointing
Forecast Sparks Fears Of Smart-Phone Competition

Research In Motion Ltd.'s quarterly profit fell 4% as a legal settlement charge offset strong sales of its BlackBerry devices. But
disappointing revenue guidance raised fears the company may finally be feeling the effects of the economic slowdown as well as
competitive pressure from Apple Inc.'s iPhone and other smart-phone rivals, leading shares to tumble as much as 12% in after-hours
trading on Thursday. The company, based in Waterloo, Ont., posted a profit of $475.6 million, or 83 cents a share, for its fiscal
second quarter ended Aug. 29, down from $495.5 million, or 86 cents a share, a year earlier.


White Spaces Could Fetch $100 Billion

The empty TV spectrum known as "white spaces" could be worth as much as $100 billion in 15 years, according to a report
commissioned by Microsoft. Perspective Associates performed the study, which said using white spaces in conjunction with Wi-Fi
could generate between $3.9 and $7.3 billion in value per year over the next 15 years. The report said the unlicensed usage of white
spaces could lead to cheap wireless broadband access in rural communities because white spaces can essentially provide Wi-Fi-like
connections over a much larger space. Additionally, the study said the spectrum will lead to a plethora of new devices and services
because the unlicensed usage means there will be a lower barrier of entry.

Coalition Calls On FCC To Crack Down On Product Placement; Says The FCC Needs To Act On Its Notice Of
Inquiry Into How Its Sponsorship Identification Rules Apply To Embedded Advertising

A coalition of 50 groups including Consumers Union and the American Academy of Pediatrics has called on the FCC to crack down
on product placement. In a letter to FCC Chairman Julius Genachowski sporting 50 signatures, the groups, calling themselves the
Fairness and Integrity in Telecommunications Media, said the FCC needs to act on its notice of inquiry into how its sponsorship
identification rules apply, and should apply, to embedded advertising. The coalition argues that current broadcast sponsorship ID
are ineffective because they are confusingly worried or buried at the end of the show, while cable networks, unless local origination
channels, are not subject to the sponsorship rules at all.


Evolving DVRs Offer Up New Benefits; Broadcasters View Brand As Aud-Capturing Device

DVRs aren't just about skipping commercials anymore. They're about providing a digital entertainment connection. Commercial
broadcasters who've seen personal video recorders as an ad-skipping threat might now view them as an audience-capturing
opportunity. In global markets where DVRs are just arriving, they're promoted not as recording and storage devices but as "an
experience," says TiVo CEO Tom Rogers, a Mipcom keynote speaker. TiVo's iconic brand is built around the company's much lauded
search-and-suggestion interface. Connected to broadband, DVRs can deliver dozens of branded channels like TiVoCast and can
access users' digital video and photo libraries. TiVo is also a content retailer for downloadable video. Rogers sees "the ability to get
anything you want whenever you want -- linear or broadcast video, online video, broadband content -- with the consumer not having
to know what the underlying delivery mode is. All they know is the Google-of-television approach."


Musicians Ask FCC To Probe Radio Boycott

You won't hear Bruce Springsteen on KXIT in the Texas Panhandle—or Sheryl Crow or Tim McGraw or Rod Stewart or dozens of
other artists either. It's not their music that station owner George Chambers finds objectionable. It's their membership in
MusicFirst, a coalition that wants to change the law to require AM and FM radio stations to pay royalties for the music they
broadcast. Other radio stations across the country have allegedly refused to air the group's advertisements supporting performance-
royalty legislation, as well as blackballed individual artists who are members. Now the Federal Communications Commission (FCC)

is being called upon to investigate whether such tactics run afoul of broadcasters' obligation to serve the public interest. The agency
 put out a notice last month seeking information regarding whether broadcasters are "targeting and threatening artists" or engaging
 in a media campaign that "disseminates falsities," and to determine the effect of refusing to air the ads.


 Survey: More Using Radio, Online For News

 More Americans are turning to radio and online sources for news and information, according to a new survey. The second annual
 survey, conducted by Opinion Research Corp. for ARAnet, found that consumers report getting 19.4 percent of their news from
 radio, up from 16.5 percent in last year's survey, and 14.6 percent from online sources, up from 12.7 percent. Television still leads, at
 31.1 percent, but that's down from 34.7 percent a year ago.

   Google Boosts Windows Mobile App

   Google said Thursday it has improved its mobile applications for rival Microsoft's Windows Mobile operating system. The
   company boosted its Google Mobile App, and one of the most notable improvements is the inclusion of the My Location feature.
   This utilizes cell phone tower information to determine where the user is in order to deliver location-relevant search results
   without the user having to specify their location. The company also added Google Suggest to the app, and this offers suggestions
   for search queries.



   Judge Delays Hearing On Google Books Deal - Continuing Coverage
   September 25, 2009 ~ Reuters News
   A judge delayed a hearing on a $125 million deal that would allow Google Inc to create a massive digital library. In a two-page
   order on Thursday, U.S. District Judge Denny Chin postponed the fairness hearing scheduled for October 7 regarding a
   controversial settlement between Google and groups representing authors and publishers. The settlement, which would allow
   Google to distribute and sell digital versions of out-of-print, copyrighted books, was criticized by the U.S. Justice Department on
   Friday. Judge Chin said that while the proposed settlement would offer many benefits to society, it also raises significant issues, as
   demonstrated by the number of objections to the deal by various parties, including countries, states and nonprofit organizations.



 Growing Hispanic Market Awaits "Cultural Mind-Shift"; Marketing, Sales Executives Say Mainstream
 Advertisers Need Better Understanding Of Latino Consumers

 While the 2010 Census is very likely to back up Hispanic marketing executives claims that the increasing population will lead to a
 thriving consumer marketplace, advertisers may still be reluctant, according to a panel of marketing and sales executives at the 7th
 annual Hispanic Television Summit on Sept. 23. The Census numbers are certainly generating excitement among Hispanic
 marketers, but as Bromley Communications COO Jessica Pantanini said, "what really counts is the action that is taken by corporate
 America." Pantanini said marketers need to take the Census data but also approach advertisers with metrics that show increased
 Hispanic viewership means increased consumer spending in the market.

 The harsh reality of marketing in a recession: Three-quarters of marketers had their budgets cut this year, and two-thirds were
 expected to drive more sales with an equal or lesser budget, according to the “2009 ANA/MMA Marketing Accountability Survey”
 from the Association of National Advertisers and Marketing Management Analytics. The No. 1 strategy for marketers who wanted to
 improve effectiveness without spending more, according to the June 2009 poll, was shifting from traditional to digital media. More
 than one-half of respondents also reported shifting spending away from brand-building initiatives, and 38% were putting more
 spending into lower-cost media.


 Smartphone Social Networking Sees Enormous Growth

 Although Smartphones come with a multitude of Web capabilities, consumers are more often than not using these mobile devices for
 social networking. Social networking usage on Smartphones has skyrocketed by 187 percent to 18.3 million unique users in July
 2009, per The Nielsen Co. The increase, which nearly tripled the 6.4 million seen in July 2008, allowed social networking sites to
 account for 32 percent of all Smartphone activity during the year. Facebook was the most popular social network with 14.7 million
 users, followed by MySpace (7.1 million) and Twitter (4.1 million). Overall, the three sites made up 26 percent, 13 percent and 7
 percent of Smartphone users, respectively.


 Twitter Appears Set To Raise $100 Million, Valuing It At $1 Billion

 Twitter has trained people to compress their thoughts into 140 characters and given a public stage to both dissidents in Iran and
 voluble stars like Shaquille O'Neal. Now the start-up appears to have chalked up another achievement. Twitter, which has no
 discernible revenue, is set to raise about $100 million of new funding that would value the company at around $1 billion, a person
 briefed on the company's plans said Thursday. For context, that is almost double the market capitalization of Domino's Pizza, which
 has 10,500 employees and had $1.4 billion in sales last year.

 Highest Average Time Spent Among Top 30 Newspaper Sites

 Congratulations, Star Tribune of Minneapolis -- more people spent time on your site in the month of August than any other
 newspaper site in the top 30. According to Nielsen Online, visitors to StarTribune.com spent an average 20 minutes and 47 seconds
 during that month. Nielsen defines time spent per person as the average over the course of the month. Within the top five newspaper
 Web sites, more people lingered at the Wall Street Journal Online at 14 minutes during August. For a listing of time spent on the top

 Tribune And Mediaspectrum Team For Self-Service Advertising

 Mediaspectrum and Tribune Company announced a partnership, a joint effort to support publishers industry-wide by enabling what
 the companies called fast and secure self-service advertising. The solution, recently implemented across Tribune, will now be
 available to any media company to implement customer-centric, self-service advertising sales for print, Web, rich media and beyond.
 Mediaspectrum was selected by Tribune a year ago to power its self-service advertising initiative. Tribune's goal was to generate
 more ad volume in a very efficient manner, making it economically attractive for many more advertisers.

 Businesses Find New Ways To Save Energy, Cost In Data Centers

Whether it’s a novel technique to cool data centers like the one tested by Lawrence Berkeley National Laboratory, installation of new
hardware chosen by Skyservice Airlines, or leveraging rebates through utilities like PG&E, businesses are looking at a variety of ways
to reduce the cost of cooling their data centers as well as saving energy. The reason is because cooling equipment accounts for almost
half the energy used in a typical data center. A team of engineers led by Lawrence Berkeley National Laboratory, working with Intel,
Hewlett-Packard, IBM and Emerson Network Power, have successfully tested a novel system that could improve the efficiency of
data center cooling, reports PC World. PC World said the experiment entailed feeding temperature readings from sensors that are
built into most modern servers directly into the data-center building controls, which allow the air conditioning system to keep the
facility at the right temperature to cool the servers.


Disputed Solar Energy Project In California Desert Is Dropped

A proposed solar energy project in the California desert that caused intense friction between environmentalists and the developers of
renewable energy has been shelved. BrightSource Energy Inc. had planned a 5,130-acre solar power farm in a remote part of the
Mojave Desert, on land previously intended for conservation. The company, based in Oakland, Calif., said Thursday that it was
instead seeking an alternative site for the project. The Wildlands Conservancy, a California environmental group, had tried to block
the solar development, as had Senator Dianne Feinstein, Democrat of California, who proposed that the area become a national
monument.

compromising the ability of future generations to meet their own needs." Sustainable businesses can ride the storms, whether they
are economic crises, climate change, terrorism, or pandemics. These businesses not only survive, they often thrive. As their less
sustainable peers suffer, these businesses garner greater strength and build new capabilities.


More Americans Seek Jobs With Focus On Social Impact

Now that the financial system has been rocked to its core, "social capital" is getting a lot of buzz. But what is it? It boils down to
putting your efforts into jobs with a socially positive impact, connecting money with meaning and investing with those principles in
mind. People of all ages are pursuing those mantras -- from twentysomethings seeking socially responsible jobs straight out of
college to Gen X-ers in their 30s and 40s leaving highly paid posts in major corporations to launch socially aware start-ups to Baby
Boomers investing or advising companies on how to be more socially aware. "A lot of organizations are forming social enterprises in
a way that they didn't used to highlight their social mission," said Amy Benziger, co-producer of SoCap09, a San Francisco-based
conference on social capital. "It might be perceived as potentially sacrificing profit, but now it's looked at as a positive thing."

The company’s sales increased 13 percent $2.08 billion from $1.84 billion in the second quarter of last year. Comparable store used-vehicle sales increased 8 percent in the second quarter, while new-vehicle sales dropped 19 percent. Used vehicle gross profit increased to $2,120 per unit from $1,870 per unit in the prior year quarter. The company said the improvement resulted from a combination of factors, including the continued appreciation in used car wholesale values since January 2009, an increase in inventory turns and the robust sales environment experienced in the quarter. The new plant, to be built with an investment of $490 million (3.34 billion yuan), will be run jointly with a Chinese partner, Chonqing Changan Automobile Co., and Japan's Mazda Motor Corp., as are its two existing plants. It will produce Ford's next-generation Focus compact car and be capable initially of producing 150,000 vehicles a year when it opens in the city of Chongqing in southwestern China in 2012, the company said. Starting Nov. 1, GM will launch a system in which suppliers of auto parts and logistics materials are paid weekly rather than every 47 days. The length of time between parts payments has been a major contributor to the financial problems of U.S. auto suppliers, many of which have declared bankruptcy in recent years. GM's move covers 1,400 parts makers and 300 logistics suppliers in North America, with a plan to eventually implement the new schedule around the world. Losing Ground In Auto Financing, GMAC To Offer New Financial Incentives To Dealerships September 24, 2009 ~ Associated Press Newswires GMAC Financial Services, the former financing arm of General Motors Co., is making a new push to recapture its share in the auto financing business by offering incentives to its most loyal dealers. The government-subsidized lender starting Oct. 1 will offer cash incentives and services to its U.S. dealers, spokeswoman Sue Mallino said Thursday. The program will be called Ally Dealer Rewards -- named after its newly rebranded consumer banking arm Ally Bank -- although the program will be administered by GMAC's automotive unit. 2

U.S. Watchdog To Study GM, Chrysler Dealer Closures September 24, 2009 ~ Reuters News A U.S. Treasury Department watchdog will study decisions by General Motors Co and Chrysler to cut more than 2,000 dealers, a key bailout watchdog said on Thursday. Neil Barofsky, special inspector general for the Troubled Asset Relief Program, said his office will examine the process used by the automakers to identify which dealerships to maintain or terminate, as part of their restructuring processes. The Obama administration's autos task force has provided more than $60 billion in bailout financing from the TARP fund for GM and Chrysler, which have both emerged from bankruptcy. Hundreds of dealers assert that their rights were trampled on during the automakers' bankruptcies, leaving them with little or no legal recourse. BROADBAND FCC Defends Internet Regulation Authority; FCC Asserted Its Authority To Regulate The Internet Under Its Ancillary Authority Over “All Interstate And Foreign Communication By Wire Or Radio” September 24, 2009 ~ Broadcasting & Cable The FCC this week told a D.C. federal appeals court that it had the authority to take action against Comcast for "covertly interfering" with BitTorrent peer-to-peer traffic in violation of Internet openness principles, and doing so in an adjudicatory proceeding rather than a rulemaking. That argument was made in a brief to the court on the same day FCC Chairman Julius Genachowski announced he proposed codifying and expanding those principles. The commission also more broadly asserted its authority to regulate the Internet. "Congress created the FCC for cases such as this one," it told the court. "Congress gave the agency broad and adaptable jurisdiction so that it can keep pace with rapidly evolving communications technologies." FCC Seeks Input On Finding More Wireless Spectrum; Wants Additional Comments About Whether Allocations Are Sufficient For Wireless Broadband Needs September 24, 2009 ~ Multichannel News The Federal Communications Commission is seeking more comment on whether current wireless spectrum allocations are sufficient for the growing needs of wireless broadband. In a public notice released Sept. 23, the commission said it wanted more facts and data. It has already asked about wireless spectrum use in its just-opened proceeding on innovation in wireless, but is now responding to specific comments in its national broadband plan proceeding about the need for more spectrum. Among the things the commission wants to learn is the ability of current allocations to support next-generation services and what bands would be best positioned to provide more spectrum. Time Warner Cable Learning From "El Paquetazo" Rollout; Residential Services President Hirsch Discusses L.A. Launch Mistakes September 24, 2009 ~ Multichannel News Time Warner Cable is still in the early stages of rolling out its "El Paquetazo" programming package, but it is already learning from its mistakes in how to market it. Jeffrey Hirsch, president of residential services for Time Warner Cable's New York region discussed the service at the B&C/Multichannel News Hispanic Television Summit Sept. 24. Hirsch says the goal is to make the product, which features about 40 Spanish-language channels and 100 English channels, the go-to television package in the Hispanic marketplace. "Because it is a new brand geared toward bicultural households, it gives us brand awareness that we didn't have in that community before," he said. Time Warner Cable Powers Up Wideband In Big Apple September 24, 2009 ~ Multichannel News Time Warner Cable's New York City division cut the ribbon Thursday on 50-Mbps DOCSIS 3.0-based Internet service, which the operator will use to battle Verizon's FiOS Internet in the nation's biggest market. Time Warner Cable is marketing "wideband" services to New York residents and businesses, touting top speeds of 50 Mbps downstream and 5 Mbps up. But disappointing revenue guidance raised fears the company may finally be feeling the effects of the economic slowdown as well as competitive pressure from Apple Inc.'s iPhone and other smart-phone rivals, leading shares to tumble as much as 12% in after-hours trading on Thursday. The company, based in Waterloo, Ont., posted a profit of $475.6 million, or 83 cents a share, for its fiscal second quarter ended Aug. 29, down from $495.5 million, or 86 cents a share, a year earlier. White Spaces Could Fetch $100 Billion September 24, 2009 ~ CMP TechWeb The empty TV spectrum known as "white spaces" could be worth as much as $100 billion in 15 years, according to a report commissioned by Microsoft. Perspective Associates performed the study, which said using white spaces in conjunction with Wi-Fi could generate between $3.9 and $7.3 billion in value per year over the next 15 years. The report said the unlicensed usage of white spaces could lead to cheap wireless broadband access in rural communities because white spaces can essentially provide Wi-Fi-like connections over a much larger space. Additionally, the study said the spectrum will lead to a plethora of new devices and services because the unlicensed usage means there will be a lower barrier of entry. BROADCASTING Coalition Calls On FCC To Crack Down On Product Placement; Says The FCC Needs To Act On Its Notice Of Inquiry Into How Its Sponsorship Identification Rules Apply To Embedded Advertising September 24, 2009 ~ Broadcasting & Cable A coalition of 50 groups including Consumers Union and the American Academy of Pediatrics has called on the FCC to crack down on product placement. In a letter to FCC Chairman Julius Genachowski sporting 50 signatures, the groups, calling themselves the Fairness and Integrity in Telecommunications Media, said the FCC needs to act on its notice of inquiry into how its sponsorship identification rules apply, and should apply, to embedded advertising. The coalition argues that current broadcast sponsorship ID are ineffective because they are confusingly worried or buried at the end of the show, while cable networks, unless local origination channels, are not subject to the sponsorship rules at all. Evolving DVRs Offer Up New Benefits; Broadcasters View Brand As Aud-Capturing Device September 24, 2009 ~ Daily Variety DVRs aren't just about skipping commercials anymore. They're about providing a digital entertainment connection. Commercial broadcasters who've seen personal video recorders as an ad-skipping threat might now view them as an audience-capturing opportunity. In global markets where DVRs are just arriving, they're promoted not as recording and storage devices but as "an experience," says TiVo CEO Tom Rogers, a Mipcom keynote speaker. TiVo's iconic brand is built around the company's much lauded search-and-suggestion interface. Connected to broadband, DVRs can deliver dozens of branded channels like TiVoCast and can access users' digital video and photo libraries. TiVo is also a content retailer for downloadable video. It's not their music that station owner George Chambers finds objectionable. It's their membership in MusicFirst, a coalition that wants to change the law to require AM and FM radio stations to pay royalties for the music they broadcast. Other radio stations across the country have allegedly refused to air the group's advertisements supporting performance- royalty legislation, as well as blackballed individual artists who are members. Survey: More Using Radio, Online For News September 24, 2009 ~ radioink.com More Americans are turning to radio and online sources for news and information, according to a new survey. The second annual survey, conducted by Opinion Research Corp. for ARAnet, found that consumers report getting 19.4 percent of their news from radio, up from 16.5 percent in last year's survey, and 14.6 percent from online sources, up from 12.7 percent. Television still leads, at 31.1 percent, but that's down from 34.7 percent a year ago. The company boosted its Google Mobile App, and one of the most notable improvements is the inclusion of the My Location feature. This utilizes cell phone tower information to determine where the user is in order to deliver location-relevant search results without the user having to specify their location. The company also added Google Suggest to the app, and this offers suggestions for search queries. Judge Delays Hearing On Google Books Deal - Continuing Coverage September 25, 2009 ~ Reuters News A judge delayed a hearing on a $125 million deal that would allow Google Inc to create a massive digital library. In a two-page order on Thursday, U.S. District Judge Denny Chin postponed the fairness hearing scheduled for October 7 regarding a controversial settlement between Google and groups representing authors and publishers. The settlement, which would allow Google to distribute and sell digital versions of out-of-print, copyrighted books, was criticized by the U.S. Justice Department on Friday. Judge Chin said that while the proposed settlement would offer many benefits to society, it also raises significant issues, as demonstrated by the number of objections to the deal by various parties, including countries, states and nonprofit organizations. Social networking usage on Smartphones has skyrocketed by 187 percent to 18.3 million unique users in July 2009, per The Nielsen Co. The increase, which nearly tripled the 6.4 million seen in July 2008, allowed social networking sites to account for 32 percent of all Smartphone activity during the year. The reason is because cooling equipment accounts for almost half the energy used in a typical data center. A team of engineers led by Lawrence Berkeley National Laboratory, working with Intel, Hewlett-Packard, IBM and Emerson Network Power, have successfully tested a novel system that could improve the efficiency of data center cooling, reports PC World. PC World said the experiment entailed feeding temperature readings from sensors that are built into most modern servers directly into the data-center building controls, which allow the air conditioning system to keep the facility at the right temperature to cool the servers. Disputed Solar Energy Project In California Desert Is Dropped September 19, 2009 ~ The New York Times A proposed solar energy project in the California desert that caused intense friction between environmentalists and the developers of renewable energy has been shelved. BrightSource Energy Inc. had planned a 5,130-acre solar power farm in a remote part of the Mojave Desert, on land previously intended for conservation. The company, based in Oakland, Calif., said Thursday that it was instead seeking an alternative site for the project. The Wildlands Conservancy, a California environmental group, had tried to block the solar development, as had Senator Dianne Feinstein, Democrat of California, who proposed that the area become a national monument.
