10. 전기통신사업법 제2조
11. “기간통신역무”란 전화·인터넷접속 등과 같이 음성·데이터·영
상 등을 그 내용이나 형태의 변경 없이 송신 또는 수신하게 하는 전
기통신역무 및 음성·데이터·영상 등의 송신 또는 수신이 가능하도
록 전기통신회선설비를 임대하는 전기통신역무를 말한다. 다만, 방
송통신위원회가 정하여 고시하는 전기통신서비스(제6호의 전기통
신역무의 세부적인 개별 서비스를 말한다. 이하 같다)는 제외한다.
12. “부가통신역무”란 기간통신역무 외의 전기통신역무를 말한다.

12. 제50조(금지행위) ① 전기통신사업자는 공정한 경쟁 또는 이용자의 이익을 해치거나 해칠 우려가 있는
다음 각 호의 어느 하나에 해당하는 행위(이하 “금지행위”라 한다)를 하거나 다른 전기통신사업자 또는
제3자로 하여금 금지행위를 하도록 하여서는 아니 된다.
1. 설비등의 제공·공동활용·공동이용·상호접속·공동사용·도매제공 또는 정보의 제공 등에 관하여 불합
리하거나 차별적인 조건 또는 제한을 부당하게 부과하는 행위

른 전기통신사업자의 정보 등을 자신의 영업활동에 부당하게 유용하는 행위

이용·상호접속·공동사용·도매제공 또는 정보의 제공 등의 대가 등을 산정하는 행위
5. 이용약관(제28조제1항 및 제2항에 따라 신고하거나 인가받은 이용약관만을 말한다)과 다르게 전기
통신서비스를 제공하거나 전기통신이용자의 이익을 현저히 해치는 방식으로 전기통신서비스를 제공하
는 행위
6. 설비등의 제공·공동활용·공동이용·상호접속·공동사용·도매제공 또는 정보 제공의 대가를 공급비용
에 비하여 부당하게 높게 결정·유지하는 행위
7. 「전파법」에 따라 할당받은 주파수를 사용하는 전기통신역무를 이용하여 디지털콘텐츠를 제공하기
위한 거래에서 적정한 수익배분을 거부하거나 제한하는 행위

하나에 해당하는 행위로 한다.

• 2. Member States shall ensure that the relevant authorities are able to require undertakings
providing public communications networks and/or publicly available electronic communications
services to block, on a case-by-case basis, access to numbers or services where this is justified
by reasons of fraud or misuse and to require that in such cases providers of electronic
communications services withhold relevant interconnection or other service revenues.

• a. to minimize the effects of congestion, whereby equal types of traffic should be treated equally;
b. to preserve the integrity and security of the network and service of the provider in question or
the terminal of the enduser;
c. to restrict the transmission to an enduser of unsolicited communication as refered to in Article
11.7, first paragraph, provided that the enduser has given its prior consent;
d. to give effect to a legislative provision or court order.
• 2. If an infraction on the integrity or security of the network or the service or the terminal of an
enduser, refered to in the first paragraph sub b, is being caused by traffic coming from the terminal
of an enduser, the provider, prior to the taking of the measure which hinders or slows down the
traffic, notifies the enduser in question, in order to allow the enduser to terminate the infraction.
Where this, as a result of the required urgency, is not possible prior to the taking of the
measure, the provider provides a notification of the measure as soon as possible. Where this
concerns an enduser of a different provider, the first sentence does not apply.
• 3. Providers of internet access services do not make the price of the rates for internet access
services dependent on the services and applications which are offered or used via these services.
