The Philippine Overseas Employment Administration
(POEA) is an attached agency of the Department of
Labor and Employment. Presidential Decree (PD) 797
created the agency on May 2, 1982 to develop and
manage the country’s overseas employment program
as well as to protect the rights of Filipino migrant
workers.

POEA - Caring All The Way!
POEA regulates the participation of the private sector,
meaning the Philippine Recruitment Agencies in the
overseas employment program, including all
processes involved in the recruitment and
deployment of Overseas Filipino Workers (OFWs).
It documents and registers all Filipinos leaving the
country to work abroad, provides placement facilities
for government-to-government clients and free
registration of all applicants in the manpower pool.
POEA also provides vital information to the overseas job applicants and the public on
labor migration to protect them from becoming victims of illegal recruitment and
trafficking in persons.

POEA - Caring All The Way!
The POEA has a Legal Assistance Division where
OFWs, overseas work applicants and walk-in clients
may approach for their legal problems concerning
overseas employment, especially those in relation to
recruitment violations. The legal officers will provide
free legal counseling services and referrals to
appropriate POEA units and other government
agencies for further assistance.
If the complaint concerns illegal recruitment, especially when undertaken by those
without license or authority and the illegal activity is in progress, the matter is referred to
the Operations and Surveillance Division for surveillance, entrapment and possible
closure of an establishment.

POEA - Caring All The Way!
But if recruitment activity has already been done, the
matter is referred to the Prosecution Division for
filing of appropriate case. The legal officers will assist
workers by taking their statements and putting
together pieces of evidence for filing of a criminal
action before the Prosecution Office.
They likewise provide legal representation as
collaborating counsel of public prosecutors in
prosecuting illegal recruitment cases.
The POEA’s Repatriation Unit also assists in repatriating or bringing home
distressed workers deployed by licensed agencies.

ADMINISTRATIVE ACTION
An aggrieved OFW or one who is applying for
overseas work may file an administrative action
against a recruitment agency for certain recruitment
violations, such as excessive collection of fees,
misrepresentation and contract substitution. These
violations are classified into light, less serious and
serious, with penalties ranging from Reprimand,
Suspension of License from one month to one year,
and Cancellation of License for serious violation and
for repeat offenders.
Disciplinary Action Against Employers/foreign principals or DAE may also be filed in
cases such as default on contractual obligations to the worker and/or to its Philippine
agent, gross violation of laws, rules and regulations on overseas employment, gross
negligence leading to serious harm or death of the worker, and grave misconduct. The
employer or principal may face disqualification to engage in the country’s
overseas employment program.

LABOR CLAIMS
In cases of unpaid salaries and other monetary
claims, you may file a case against your employer
before the National Labor Relations Commission
(NLRC). And because of the “JOINT AND
SEVERAL LIABILITY” policy, the recruitment
agency is equally liable and maybe included in the
case.
An OFW may also choose to have a voluntary
conciliation, wherein he and his recruitment agency
can have an expedient way to settle their dispute.
Voluntary conciliation cases are handled by DOLE
and its attached agencies (including POEA) through
the DOLE’s Single Entry Approach (SeNA).

Your Legal Remedies
Criminal action may also be pursued by an OFW or
an applicant for overseas employment for illegal
recruitment against a licensed or an unlicensed
recruitment agency.
Other criminal charges such as trafficking in persons
and estafa may also be taken against those
responsible.
Criminal complaints can be received by the Philippine
National Police, the National Bureau of Investigation
or the POEA.

If in case you are coming home after the end of your employment contract and
decided to stay in the Philippines for good, or you are repatriated due to crisis or
emergency, be assured that the government will continue to
care for you!
The Department of Labor and Employment (DOLE) issued Dept. Order no. 139-14 series of 2014,
establishing an Assist WELL Processing Center in DOLE offices and attached agencies to ensure
synchronized and systematic delivery of assistance to returning and/or repatriated OFWs.
