11. What is E-Verify? E-Verify is an Internet-based system operated by U.S. Citizenship and Immigration Services (USCIS) in partnership with the Social Security Administration (SSA). E-Verify provides an automated link to federal databases to help employers determine employment eligibility of new hires and the validity of their Social Security numbers.
12. IC 22-5-1.7-3 "E-Verify program"Sec. 3. As used in this chapter, "E-Verify program" means the electronic verification of work authorization program of the Illegal Immigration Reform and Immigration Responsibility Act of 1996 (P.L. 104-208), Division C, Title IV, s. 403(a), as amended, operated by the United States Department of Homeland Security or a successor work authorization program designated by the United States Department of Homeland Security or other federal agency authorized to verify the work authorization status of newly hired employees under the Immigration Reform and Control Act of 1986 (P.L. 99-603).
13. IC 22-5-1.7-10 State Agencies & Political Subdivisions Required to Use E-Verify: exception Sec. 10. (a) Except as provided in subsection (b), a state agency or political subdivision shall use the E-Verify program to verify the work eligibility status of all employees of the state agency or political subdivision hired after June 30, 2011. (b) A state agency or political subdivision is not required to use the E-Verify program as required under subsection (a) if the E-Verify program no longer exists.

This section of SEA 590 does apply to school corporations as they are designated at political subdivisions in IC 36-1-2-13. Please share this with your human resources personnel. This section of the law is very general and states that schools have to verify the eligibility of individuals, but there is no language that states what schools do with the verification. As State Examiner Hartman says in his memo, "The State Board of Accounts will not be able to answer when and how this new law applies to your circumstances."
