Introduction of the chemical distributors’ industry and
role within REACH and CLP Regulations
Overview of the most relevant legal requirements for
chemical distributors
Supply chain communication challenges

supply chain
Index
4. Distributors (including retailers) who store and
place chemicals on the market for third parties.
REACH and CLP obligations are limited to
forwarding information in the supply chain.
4
Who is a distributor under REACH?
Distributors sometimes do more than store and
place a substance on the market, and these
additional activities may give rise to obligations
under REACH and CLP
5. If distributors use chemicals, for example if they
blend or re-fill the substances or mixtures
… they are also downstream users
If distributors import hazardous chemicals from
outside the EU
… they are also importers

9. Distributors’ experience
2 ways of communicatng
• Communicate a copy of the SDS/ext-SDS from the rupplier
to the curtomerr.
• Communicate OWN SDS/ext-SDS consolidated from what
har been received from rupplierr.
9
Some fgures on SDSs from distributors:
• handle up to 60.000 substances and/or mixturer
• dirtribute up to 350.000 SDSr per year, of which
approximately 100.000 (30%) directly forwarded ar
received from rupplier
up to 250.000 (71%) generated in houre: OWN SDS

10
Consolidaton of e-SDS meanr comparing and grouping
data from diferent rupplierr of a rubrtance into one
conrolidated e-SDS.

• Exporure Scenarior
Consolidaton requires resources

12. A Formulator receives multiple extended SDS -
may have to ”consolidate” the received info on substance
level before considerations on mixture level can start

Distributors
recommendation for the
improvement of
communication:
• Use harmonised structures:
− Templates
− Phrases
• Use electronic communication
standards

SDSCom and ESCom
promotion
15. 15
Objective: is to make communication in the supply chains work in practice.
The actions aim to:
• Determine information needs of the different actors.
• Connect practices under REACH with practices under other legislation (OSH,
environment, consumer safety).
• Develop/maintain methods and tools available.
• Adapt exposure assessment methods/tools to support the REACH Safety
Assessment Framework.
• Demonstrate usefulness and feasibility.

ENES Porgramme Action 1.4. Lead
Objective: to identify the nature and the extent of the inconsistencies on the safe use
information coming from different joint registrants for the same substance.
Actions:
• Harmonise consolidation procedure.
• Identify main challenges and inconsistencies that create obstacles for the consolidation.
• Carry out a representative analysis on these inconsistencies.
• Potentially identify the sources.

• ultple rupplierr for the rame rubrtance
• ultple rubrtancer
• For the clarrifed rubrtancer variour rituatonr
− SDS with no REACH Regirtraton Number yet
− SDS with REACH Regirtraton Number and including Exporure Scenarior (ES)
− SDS with REACH regirtraton number but no ES
• Current analyrir bared on fgurer from our companier
− 15-20 % of the clarrifed, regirtered rubrtancer comer without ES from all rupplierr
− In parallel there are alro carer when ES exirt from rome rupplierr, from otherr not

Distributors’ experience
29. • Being in the middle of the supply chain
• Being the link between manufacturers and downstream users
• For Distributors communication is key
• Need to optimise communication flows
• Move towards more standardisation and digitalisation
• Supply chain communication efficient
• Alignment/implementation across supply chain needed
