General Information
Agency Commission: 15% of gross billing allowed to recognized agencies on
space, color, bleed, and position, provided account is paid within 60 days
of invoice date. Commission not allowed on any other special charges,
Marketplace advertising and Directory Listings. If charges due the publisher
from agency for advertisements placed in conformance with this rate card
are not paid properly, the publisher may, at its option, collect said charges
from the advertiser, and the agency shall execute all necessary assignments.
In addition, publisher may hold advertiser and its agency jointly and severally
liable for all sums due and payable to publisher, even if the advertiser has
previously paid the agency.
Service Charge: A 1.5% per month (18% annual percentage rate) will
be added to all charges for space, color, bleed, position premium, and
Frequency Discounts: Advertising contracts will be set up on a calendar
year basis, unless notified by advertiser or advertising agency that a
different contract period is requested. In no instance will a contract
period be longer than 12 months. Advertisers will be short-rated if, within
a calendar year and/or a 12-month period from date of first insertion,
they do not use the amount of space upon which their billings have
been based. Schedules composed of mixed space units of at least
one-sixth standard page are entitled to frequency rates at all size levels.
Marketplace advertisements do not count toward frequency of display
space; nor does display space count toward the Marketplace advertising
and Directory listings frequency. Frequencies may be combined between
insertions in Human Resource Executive®
and Risk & Insurance®
. Insertion
orders may not be cancelled after closing date.
Order Errors: Oral agreements will not be binding on the publisher. Orders
containing incorrect rates or conditions will be inserted and charged
in compliance with rates and conditions shown in this rate card. Rate
stated on insertion order creates the assumption of frequency intended,
and billing is done accordingly. Short rates will apply if this assumed
frequency is not met. Such errors will be considered clerical only.
Publisher Liability: The publisher assumes no liability for errors or
omissions in any advertiser index, or in any advertising typeset by the
publisher. The publisher is not liable for any failure to publish or circulate
all or any part of any issue because of circumstances beyond its control.
The liability of the publisher for any error or omission or delay for which
it may be held legally responsible shall in no event exceed the cost of
the space paid for and occupied by such individual advertisement. In
consideration of the acceptance of any advertising from the advertiser
and/or the advertising agency for publication at the rates set forth in
the publisher’s rate card, the advertiser and/or the advertising agency
represents and warrants that all material delivered to the publisher for
publication shall be free of libel and that publication thereof will not violate
or infringe any copyright, trademark, right of privacy, or any other statutory
or common law property right of any person, and that the advertiser and/
or the advertising agency will indemnify, defend and hold harmless the
publisher, its agents, assigns and successors against any claim, demand,
cost, expenses and damages, including reasonable attorneys’ fees
incurred by the publisher, rising out of or in connection with any breach by
the advertiser and/or the advertising agency of any of the foregoing.
Publisher Approval: All advertising is accepted subject to the terms
and provisions in this rate card. The publisher reserves the right to
reject advertising which it feels is not in keeping with the publication’s
standards. Publisher reserves the right to place the word “Advertisement”
in advertising or to order other changes in the ad’s format which, in the
publisher’s opinion, resembles editorial.
Other: The publisher reserves the right to change rates and terms herein
at any time without notice. Contract advertisers will be given a grace
period to the end of their current contract. All rates in U.S. dollars.
