a. Homeowner submits a Notice ofClaim form to 2-10 Home BuyersWarranty® (2-10 HBW) WarrantyAdministration (WA).1. initial report
a. WA reviews the claim andverifies that there is a validstructural warranty in place.b. WA educates the homeownerregarding the claims process andattempts to screen out the claimif it is clearly not covered bythe warranty.2. verification
c. If the homeowner wishes to moveforward with the claim, WA collects therequired $250 claim investigation feeand transfers the file to the warrantyinsurer, New Home Warranty InsuranceCompany (NHWIC), for handling.2. verification
a. Upon receipt of the claim, NHWICsends acknowledgement letters tothe builder and the homeownerand contacts the homeowner andbuilder within 24 hours to beginthe investigation.3. investigation
3. investigationb. NHWIC dispatches an engineer toperform an inspection and prepare adistress inventory report. This reportprovides a detailed inventory of allvisible damages or signs of structuraldistress and includes photographs,measurements, elevation surveys anddiagrams for analysis.
4. evaluationa. Upon receipt of the distressinventory report, NHWIC conductsan internal review of the report andcompletes an assessment, includinga Technical Coverage Reviewprepared by a professionalengineer, if necessary.
4. evaluationb. The claim is submitted for finalreview and a recommendation ismade to accept or deny. During thefinal review it is determined if thereis actual physical damage to a load-bearing element caused by the failureof the load-bearing element thataffect the load-bearing functionsto the extent that the home hasbecome unsafe, unsanitary orotherwise unlivable*.*Definition of structural failure differs in Texas and New Jersey.Refer to warranty booklet for structural failure definition.
5. claim decisiona. If the claim is accepted, NHWICdevelops a plan of repair, securesthe appropriate contractors, managesthe repair process to completionand obtains a final inspection by anengineer or NHWIC settles the claimfor cash. When repairs are completeand/or the claim is settled, NHWICsecures a signed release from thehomeowner and the claim is closed.
5. claim decisionb. If the homeowner does not acceptNHWIC’s offer to repair or settle for cash,the homeowner is advised of their rightto submit the claim to Arbitration. Or, ifthe claim is denied, a letter is sent tothe homeowner and builder providinga summary of the investigation andthe conditions that were considered inmaking the claims decision. The homeowneris advised of their right to submit theclaim to Arbitration, if they disagreewith the denial.
6. arbitrationa. If the homeowner does notaccept the final claim decision,the homeowner must submit thematter to arbitration.b. The Arbitrator’s decision islegally binding upon all parties,and is enforceable in a courtof law.
