ne of the most important sales of Sotheby’s Paris in 2016 was
undoubtedly the dispersion of the imposing collection of furniture,
old master paintings and fine clocks by Robert de Balkany which
reached a total of 19.3 million Euros.
The collection comes from the sumptuous Parisian mansion of Robert
Zellinger de Balkany, a legendary French entrepreneur of Hungarian origin
who passed away in 2015 and who was the mastermind behind most of
France’s most well-known shopping centers.
The three lots that reached the highest amounts were sold during
the session on 20 September 2016, including a hardwood, ebony and
bronze cabinet dating from the early 17th
century which belonged to Pope
Paul V Borghese and which was acquired by the J. Paul Getty Museum of Los
Angeles for 2.5 million Euros, a “world record for a piece of Roman furniture.”
The mansion located at 62, rue de Varenne is for sale by “Propriétés
Parisiennes Sotheby’s International Realty” for 40 million Euros.

ong before the retail chains we know, Woolworth’s was the most
successful American and international five-and-dime, the originator
of a model that is still relevant today. As a result, three decades
after his first Utica, New York, store opened in 1879, Frank W Woolworth
had become a genuine mogul, eager to secure a prominent corner of
Manhattan and erect the kind of trophy headquarters he would call
“an ornament to the city.”
To do so, Woolworth turned to Cass Gilbert, an architect trained in
the principles of Paris’s École des Beaux-Arts at the Massachusetts
Institute of Technology. A Midwesterner and early proponent of the
skyscraper, Gilbert seized the opportunity to develop his ideas on
an unprecedented scale. Woolworth famously asked him: “How
high can you make the tower?”
Originally designed to be 420 feet, the building
eventually reached 792 feet, nearly three times the
height of nearby Trinity Church, then New York’s
loftiest structure. Built in just two years, the daring
construction was amply chronicled throughout the
world.Finallyon24April1913,withtheflipofaswitch
from inside the White House, President Woodrow
Wilson officially illuminated the Woolworth Building,
thus inaugurating the world’s tallest construction.
First anointed “the Cathedral of Commerce” in
reference to its Gothic-style architecture, the
Woolworth Building has been continuously admired
for its gorgeous, polychromatic terracotta-clad
facade. Long a beacon of New York’s TriBeCa, the
neo-Gothic icon stands as the most imposing neighbour to the west of New
York’s administrative centre, City Hall, and the adjacent, newly restored
City Hall Park.
Today, just over a century after its completion, this National Historic
Landmark is experiencing a rebirth. Developed by Alchemy Properties
under the aesthetic direction of eminent New York-based design
architect Thierry W Despont, its top 30 floors have been reimagined
into 33 prized condominium homes, crowned by an extraordinary
eight-storey pinnacle penthouse.
Called The Woolworth Tower Residences, the homes honour the
pioneering spirit and exquisite attention to detail of the building’s

fut le modèle le plus réussi et international du commerce à bon
marché « Five-and-Ten-Cent-Stores », l’initiateur d’un modèle qui
est encore pertinent aujourd’hui. Ainsi, trois décennies après son premier
magasin Utica, à New York, ouvert en 1879, Frank W Woolworth est devenu un
véritable magnat, désireux de s’approprier un lieu prestigieux de Manhattan
et d’ériger son siège tel un trophée qu’il considère comme un « ornement à
la ville.”
Pour la construction, Woolworth confia le projet à Cass
Gilbert, un architecte formé aux principes de l’École
des Beaux-Arts de Paris au Massachusetts Institute of
Technology. Américain et pionnier de gratte-ciel, Gilbert a
saisi l’occasion de développer ses idées à une échelle sans
précédent. Woolworth lui demanda: «A quelle hauteur la
tour peut-elle être construite? ».
Initialement conçu pour mesurer 128 mètres, le bâtiment
atteint finalement 241 mètres, près de trois fois la hauteur
de l’église voisine de la Trinité, enfin la tour la plus élevée
de New York. Construite en seulement deux ans, la
construction audacieuse a fait des vagues à travers le
monde. Enfin, le 24 avril 1913, le président Woodrow Wilson
a officiellement illuminé le bâtiment Woolworth, inaugurant
ainsi la plus haute construction du monde.
D’abord baptisé « cathédrale du commerce » en référence
à son architecture de style gothique, le Woolworth Building
a toujours fasciné pour sa magnifique façade polychrome
en terre cuite. Tel le phare du quartier TriBeCa à New York,
l’icône néo-gothique est le gratte-ciel le plus imposant,
voisin du centre administratif de New York, l’hôtel de ville et
du tout nouvellement restauré City Hall Park.
Aujourd’hui, un peu plus d’un siècle après son achèvement,
ce monument historique national connaît une renaissance.
Développé par Alchemy Properties sous la direction artistique de l’éminent

n February 16, 2017, a unique sale comprising artistic
representations of love and sex from antiquity to the present
day, brought a total of almost £5.3 million at Sotheby’s London,
exceeding the combined pre-sale estimate of £3.1-4.6 million. The
inaugural Erotic: Passion & Desire sale – featuring over 100 lots of fine
art, photography, sculpture and design – saw almost half of the works
sold achieve prices above the high estimate.
A rare surviving work by Sarah Bernhardt – a rediscovered marble
relief of Ophelia – sparked frenzied bidding, driving the final sale price
to £308,750, six times its pre-sale low estimate (£50,000-70,000).
Further highlights included works on paper by Gustav Klimt and Egon
Schiele, who forged a new path in fearless depictions of the naked figure.
Schiele’s Akt (Nude), a prime example of the artist’s late work, fetched
£224,750, succeeded by Klimt’s unambiguously erotic pencil drawing,
half-nude reclining to the right, which sold for £175,000. The masters of
art photography were represented with a striking selection of powerful
images, including Helmut Newton’s a Domestic Nude III: In the Laundry
Room at the Château Marmont Hollywood, 1992, which realised £43,750.

he acquisition process in France does not consist of a simple exchange
of letters, but is structured in various stages. At the beginning of the
process stands usually a “promesse d’achat”, a written offer by the
potential buyer. Although this step is not mandatory, it is usually undertaken in
case the initial asking price is not matched by the potential buyer.
After the parties have reached an agreement about the main parameters of
the sale, they sign a “compromis de vente”. The “compromis” already contains
the terms of the sale, and constitutes, in general, a binding contract for both
parties. The signing of the “compromis” is accompanied by a deposit, the
“indemnité d’immobilisation”, of usually approximately 10 % of the purchase
price. The buyer has a seven day “cooling - off” period during which he can
withdraw from the contract (by registered mail and confirmation of receipt)
without incurring any legal disadvantages. The seller, however, cannot
withdraw from a written “compromis” without cause.
After this cooling - off period has expired, the contract becomes binding for
both parties. At this stage, the buyer cannot withdraw from the contract without
losinghisdeposit.Thedepositis,ofcourse,fullyaccountedagainstthepurchase
price upon the realisation of the sale.
However, the “compromis” may contain a number of suspensive conditions
(“clauses suspensives”) upon which the validity of the contract is made
dependent. For the most part, these conditions concern the ability of the buyer
to secure (mortgage) financing for the purchase through a lender. However,
other conditions may include the ability of the buyer to obtain building
permission. In case such a condition is not fulfilled, the buyer has the right to
abstain from the acquisition without contractual penalties.
The signing of the final contract, the “acte de vente” or “acte authentique,”
takes place in a notary’s office. In France, a “notaire” is not a mere “notary
public” in the US - sense, but a highly regarded, qualified lawyer who acts in
the capacity of a government official. He is required by law to act impartially,
i.e. for both the buyer and the seller, ensuring that the sale conforms to all legal
requirements. The published sales price usually includes the commission of
the real estate agent; in France, the sales commission is paid by the seller.
However, the negotiation process will of course determine the structure of the
final deal.
In addition to the agreed – upon purchase price, the buyer pays, in any event,
the notary’s fees, as well as the registration fees (transfer tax, registration
costs, etc.) which usually amount to around 10 % of the purchase price.

e processus d’ acquisition d’ un bien immobilier en France ne se compose
pas d’ un simple échange de lettres, mais il est structuré en plusieurs
étapes. Au début du processus se trouve généralement une “promesse

soit pas obligatoire, elle est généralement effectuée au cas où le prix initial

Après avoir conclu un accord sur les principaux paramètres de la vente, les
parties signent un « compromis de vente ». Le «compromis» contient déjà les
termes de la vente, et constitue, en général, déjà un contrat fixe et ferme pour
les deux parties. La signature du compromis est accompagnée d’ un dépôt, « l’
indemnitéd’immobilisation»,d’environ10%duprixd’achat.Suiteàlasignature
du compromis, l’ acheteur dispose d’ une « période de rétractation » de sept
jours pendant laquelle il peut résilier le contrat (par courrier recommandé avec
accusé de réception), sans encourir les inconvénients juridiques. Le vendeur,
cependant, ne peut plus se retirer d’ un « compromis » signé sans motif valable.
Après l’ expiration de la période de rétractation, le contrat devient obligatoire
pour les deux parties. A ce stade, l’ acheteur ne peut plus résilier le contrat
sans perdre son dépôt. Le dépôt est, bien entendu, entièrement pris en compte
dans le prix d’ achat lors de la réalisation de la vente. Toutefois, le compromis
peut contenir un certain nombre de conditions suspensives (les « clauses
suspensives ») desquelles la validité du contrat dépend. Pour la plupart, ces
conditions concernent la capacité de l’ acheteur à obtenir un financement pour
l’ achat par un prêteur. Dans le cas où une telle condition n’ est pas remplie, l’
acheteur a le droit de s’ abstenir de l’ acquisition sans pénalité contractuelle.
La signature du contrat final, l’ « acte de vente » ou l’ « acte authentique », se
déroule devant un notaire.
En France, le prix de vente publié inclut habituellement la commission de l’ agent
immobilier; la commission de vente est payée par le vendeur. Toutefois, c’ est
le processus de négociation qui va déterminer la structure de l’ accord final. En
addition au prix d’ achat, l’ acheteur paie en tout cas, les honoraires du notaire
ainsi que les frais d’ inscription (droits de mutation, frais d’ enregistrement, etc)
qui représentent généralement environ 10% du prix d’ achat.
