          e do not often encounter something that is necessary because it is use-

W         ful. In the times in which we live, some needs are established based on
          opportunity, aesthetics and political correctness. Usefulness, the first
major objective of any enterprise, project, initiative or challenge, is not always
considered. Usefulness. Something that serves a purpose. Something that serves
a purpose for our benefit. Although it may seem repetitive, messages often re-
quire repetition to be clear, persuasive and convincing. Thus, in your hands, you
hold a tool that is both necessary and useful. Necessary, since the target popula-
tion group continues to grow larger, more heterogeneous and more complex. Use-
ful, since it is not just a tool or manual; it is a guide containing applicable, up to
date, and (as I mentioned above) useful information. A guide designed to assist
both those who have recently arrived and those who have been living among us
for some time. A guide designed to orient, lead, illustrate and lay out steps for im-
migrants wishing to make their way in our community. Once the desire to integrate
is expressed, our community also becomes their community.

Although I have not yet mentioned it, I have hinted at it. In your hands, you hold
the Municipal Information Guide for Immigrants. I would now like to go over these
terms. First, as I mentioned above, it is a guide. Although it is a book, it is not just
any book. This book includes information regarding current legislation, immigrant
rights and obligations, key questions relating to initiation and integration within
the local community, legal terms, available municipal services and public institu-
tions, information of interest, internet pages, and useful telephone numbers; and
most important in my view, information regarding non-profit entities, associations,
organisations, and civil societies which offer assistance and work with immigrants
free of charge to aid integration. Second, it is a Municipal Guide, prepared and pu-
blished by the Municipal Institute of Social Services (i.e., the City Council (Ayun-
tamiento) of Badajoz) as a sign of our commitment, solidarity and dedication to
immigrants. The City Hall (Ayuntamiento) is the house of the people and welco-
mes everyone. Here, all are equal and possess the same rights and obligations.
The primary message offered by the First local institution is as follows: we are al-
ways available to assist you. Third, this is a Municipal Information Guide. In other
words, it is an instruction manual specifically for starting out, since new starts
can be complicated and challenging. It is one of the many gateways through which
an immigrant must cross. It is the first of many steps. Our objective is to ensure
that this first step is as comfortable, clear, and easy as possible. Lastly, although
this guide is intended for immigrants, others already here may also find this guide
useful, regardless of whether or not they are immigrants. Additionally, it is a useful
guide to keep within reach in case the opportunity arises to work together in si-
milar circumstances.

I hope that this specific and dynamic guide serves as a contribution to those that
choose to start a better life in Badjoz.

he 1st Municipal Plan for Immigrant Integration specifically focuses on pro-

T       viding information, guidance and counsel to foreign residents of the city.
        This includes existing resources within the Municipality regarding immigra-
tion, legal framework, rights and obligations applicable to new citizens, and access
to various social protection systems (health, education, culture, social services,
etc.) from both the City Council (Ayuntamiento) of Badajoz and other public ad-
ministrations.

Along these lines, the Municipal Information Guide for Immigrants is intended as
a practical tool for foreign nationals already residing in the city, those who have
recently arrived, and the native population (general population, employers and
professionals). The Guide provides basic information, which is divided by subject
into areas that pertain most to groups that have recently arrived to the city.

The last section of the Guide includes a list of organisations that offer assistance
to the immigrant population. This section is vital due to the important role that
these social initiative entities play when initially assisting and welcoming foreign
nationals who have recently arrived to the city.

In closing, the Guide is intended for foreign nationals who have recently arrived
to the city. This includes those who desire to live among us, understand their
rights and obligations as citizens, educate their children, share the values of our
society in Badajoz, learn our official language, share in various cultural activities
and understand how our many institutions operate to represent each one of us to
everyone. On the other hand, it is also intended for the host society, which com-
prises the citizens of Badajoz who live with this new reality on a daily basis. This
will allow them to relate to immigrant communities on both a personal and pro-
fessional level, in the work force, etc. Therefore, the availability of this basic infor-
mation is invaluable and will enable all of us to begin the integration process
together.

WHO ARE WE?
 The Municipal Programme for the Social Inclusion of Immigrants was
 developed by the City Council (Ayuntamiento) of Badajoz, through the
 Municipal Institute of Social Services (Social Services Project) and the
 Universidad Popular de Badajoz (Education and Participation Project).

    GUIDANCE SERVICE (SIVO)
 SIVO offers public and free service, which are available to everyone.
 SIVO also facilitates first contact between citizens (individuals, fami-
 lies and groups) and social services.



WHAT DO WE OFFER?
 Professional and confidential assistance by a Social Worker assig-
 ned to each neighbourhood or area of the city, who provides the
 following:


 • Information to ensure citizens understand their rights, and are
  aware of existing resources, procedures and alternatives available
  within the Social Service system for specific social needs, such as:
  adoptions, domiciliary care, senior citizens centres, children’s cen-
  tres, non-contributory pensions, drug addiction centres, mistreat-
  ment situations, family cohabitation issues, etc.
 • Individual analysis of each consultation by studying the situation
  and assessing the case to identify the most suitable solution.
 • Specific social interventions, if required by the situation.
 • Channelling and referral of cases to assistance and protection ser-
  vices in the community or to Specialised Social Services.
 • Technical consulting for associations or entities working and colla-
  borating in the social welfare field.
 • Globally collecting and analysing requirements and issues that
  arise to design alternatives such as new programmes and social re-
  sources.

GRAMMES?
Request an appointment, either by appearing at the IMSS head office
in person or by telephone: 924 21 00 99, from 9:30 to 13:30.


For persons living in villages, call to make an appointment by tele-
phone or make an appointment at the Town Hall (Ayuntamiento).


The appointment service will establish the place, day and time of the
service at the centre that corresponds to your place of residence.

1.2.2 CHILDREN AND FAMILY SERVICES PROGRAMME
 This service consists of various multi-professional teams that provide
 children in at-risk situations and their families with the resources and
 support necessary to guarantee the safety and integrity of the child
 and coverage of basic needs to remain in their home.


WHAT ARE THE OBJECTIVES?
 To protect the rights of children by reducing risk factors and social
 difficulties that affect their situation, safeguarding their physical and
 moral integrity and striving to maintain a suitable family environment
 for development.


WHAT DO WE OFFER?
 Individual, family and group intervention when family deprivation si-
 tuations are detected that could place the child in an at risk situation.

1.2.3 DOMICILIARY CARE SERVICES
 The objective of this service is to offer different types of in-home
 care for people and families, who due to special circumstances are
 unable to perform their normal activities.


 The objective is to ensure people and/or families with physical disa-
 bilities can remain in their home.


WHAT DO WE OFFER?
 • Domestic care: housecleaning, clothes washing and ironing, shop-
   ping, cooking, etc.
 • Personal care: companionship, personal hygiene, feeding, mobility
   inside the home, accompaniment outside the home to perform per-
   sonal business, etc.
 • Social support for family crisis situations (death, hospitalisation,
   etc.)


WHO DOES THIS APPLY TO?
 This service applies to people or families that lack personal auto-
 nomy and require any of the services described. Priority care is pro-
 vided to elderly, disabled or handicapped persons whose personal
 autonomy is significantly affected. Care is also provided to families
 with difficulties or who lack the personal resources for develop-
 ment.


HOW CAN YOU TAKE ADVANTAGE OF THESE SERVICES AND
PROGRAMMES?
 This service can be requested at the Information, Assessment and
 Guidance Service (SIVO) corresponding to your place of residence by

calling for an appointment (924-210099) and/or through your Health
 Centre for personal assistance.


COST OF THE SERVICE
 During a session held on 31/05/2000, the City Council adopted an
 agreement to approve a Regulatory Ordinance regarding charges to
 the public for services (B.O.P. 7-7-2000), modified by the Municipal
 Plenary Session (B.O.P. 3-3-2006).


 In this ordinance, the beneficiary must pay an amount depending on
 the monthly per capita income of the family. This service will be free
 for people or families with a monthly per capita income of less than
 50% of the S.M.I. (Salario Mínimo Interprofesional- Interprofessional
 Minimum Wage).

1.2.4 IN-HOME TELECARE SERVICE
 A 24 hour service designed to allow elderly or disabled persons to
 make immediate verbal contact with a Centre attended by professio-
 nals prepared to respond to any urgent need.


HOW DOES IT WORK?
 A mechanical device activates when the person presses a button on
 a watch or medallion, which is worn by the user at all times. A tele-
 phone line and electricity must be available in the home.


WHAT DO WE OFFER?
 • Immediate telephone support for cases of anxiety, loneliness, do-
   mestic accidents or falls.
 • Resource mobilisation in emergency situations.
 • Permanent follow-up by periodic telephone calls.
 • Diary to remind the user of important information: medication, pro-
   cedures, etc.


WHO IS IT FOR?
 People over the age of 65 or disabled persons who are alone, socially
 isolated, have mobility problems, are extremely elderly, etc., who live
 or spend a large portion of time alone or in the company of people
 in a similar at risk situation.

1.2.5 LEGAL COUNSEL
 An information service regarding rights and administrative procedu-
 res, which focuses on preventing and mitigating risk and exclusion si-
 tuations.


WHAT ARE THE OBJECTIVES?
 1 To prevent situations of marginalisation or risk for members of the
   family unit (particularly women and children) who are affected by
   family cohabitation crises, by providing information on rights and
   legal advice regarding the following issues:


     Family law:
     - Marriage rights and duties.
     - Separation and divorce rights.
     - Non-marriage unions. Rights. Measures in case of dissolution.
      Formalities and Procedures.
     - Parentage: Parent-child relationships: procedural rights. Fos-
      tering and Guardianship.
     - Incapacity. Internment authorisation. Procedural Formalities.


 2 To prevent certain social exclusion situations by eliminating the
   motivating causes. This includes providing information on rights
   and legal procedures regarding the following matters:

     Civil Registry:
     - Birth registration outside the established period.
     - Governmental files on correction of errors and name and sur-
      name changes.
     - Spanish nationality.

     - Urban renting: tenant rights

WHO ARE WE?
 A religious community (Hijas de la Caridad de San Vicente de Paúl)
 dedicated to caring for vagrants and families in great need (Spanish
 and immigrants).

WHAT DO WE OFFER?
 • SHOWER SERVICES: Tuesdays and Fridays from 8:30 to 10:45. Spe-
   aking with a Social Work is required during the first visit to the Cen-
   tre. Clean clothes are provided. Dirty clothes are collected, washed
   and returned at the next shower; towels, razors, gel and a sponge
   are also provided.
 • DINING HALL SERVICES: Daily, 365 days per year, from 13:00. A
   meal is offered, consisting of a first course, second course and des-
   sert. An individual bag containing a sandwich and fruit for dinner
   is also provided.
 • CLOTHING SERVICES: Tuesdays and Thursdays from 17:00, after
   requesting an appointment, clothing is provided to families in a spe-
   cific order.
 • ASSISTANCE FOR FAMILIES WITH A CHILD: This child must be at-
   tending school. The Social Worker will open a file, perform follow-up
   and home visits and will supply food every 20 days by appointment.

RIGHTS AND DUTIES
        OF ALIENS
Organic Law 4/2000, of 11 January, on the rights and freedoms of
 aliens in Spain and their social integration (Alien Law) is currently in
 effect. However, this law has undergone various modifications as a
 result of the approval of subsequent organic laws which have subs-
 tantially modified its articles. The law includes the rights and duties
 listed below:


Art.3 The rights of aliens and interpretation of the regulation
 Aliens in Spain shall enjoy the rights and liberties recognised in Title
 I of the Constitution. As a general criteria, aliens shall exercise the
 rights granted to them by this Law in conditions of equality with Spa-
 nish nationals.


Art.4 The right to documentation
 Aliens in Spanish territory have the right and the obligation to pos-
 sess documentation which accredits their identity, as well as that
 which accredits their status in Spain.


 They may not be deprived of their documentation, except in those
 cases provided in this Law and in the Law on Citizen Security.


Art.5 The right to freedom of movement
 Aliens in Spain shall have the right to move freely within Spanish te-
 rritory and to choose their place of residence.

Art.6 Public participation
 Resident aliens in Spain shall have the right of suffrage in municipal
 elections by criteria of reciprocity (aliens from the EU, Argentina,
 Chile and Uruguay).


 Resident and registered aliens possess all of the rights established by
 the LBRL, and thus may be heard on issues which affect them.


 Local Town Councils (Ayuntamientos) shall incorporate them into the
 register and shall maintain updated information on aliens residing
 within the municipality.


Art.7 Freedom of assembly and public demonstration
 Aliens shall have the right of assembly and may exercise it when they
 have obtained authorisation for their stay or residence in Spain.


Art.8 Freedom of association
 Aliens shall have the right of association and may exercise it when
 they have obtained authorisation for their stay or residence in
 Spain.

Art.9 The right to education
 All aliens under the age of 18 have the right and the duty to an edu-
 cation in the same conditions as Spanish nationals, the right to free
 and compulsory basic education (basic and secondary compulsory
 education up to the age of 16), the right to obtain the corresponding
 academic certification and access to the scholarships and grants
 system.


 The Government shall guarantee a number of places sufficient to en-
 sure early childhood education – which is of a voluntary nature – for
 aliens.


 Resident aliens shall have the right to education of a non-compulsory
 nature in the same conditions as Spanish nationals (high school (ba-
 chillerato) and vocational training from 16 to 18 years of age).



Art.10 The right to work and to Social Security
 Aliens who meet the requirements specified in this Organic Law and
 its provisions, shall have the right to engage in remunerated activi-
 ties, on a basis of self-employment or otherwise, as well as access to
 the Social Security system (exercising this right shall be limited by
 work permit authorisation).


 Resident aliens in Spain shall have access, in conditions equal to
 those of nationals of EU Member States, to employment in Public Ad-
 ministration. To this effect, they may apply for positions of Public
 Employment offered by Public Administrations.

Art.11 Freedom to unionise and to strike
 Aliens shall have the right to unionise freely or to join a professional
 organisation, and may exercise this right when they have obtained
 authorisation for their stay or residence, in the same conditions as
 Spanish workers.


 Once authorised to work, they may exercise their right to strike, in
 the same conditions as Spanish nationals.


Art.12 The right to healthcare
 Aliens in Spain who are registered in the municipal register where
 they normally reside shall have the right to healthcare in the same
 conditions as Spanish nationals.


 Aliens in Spain have the right to emergency public healthcare in the
 case of serious illness or accident, and to the continuance of such
 care, until a medical release has been given.


 Aliens in Spain who are under the age of 18 shall have the right to he-
 althcare in the same conditions as Spanish nationals.


 Aliens in Spain who are pregnant shall have the right to pre-natal,
 childbirth and post-partum healthcare (up to six weeks after child-
 birth).

Art.13 The right to housing assistance
 Resident aliens have the right to access the public system of housing
 assistance in the same conditions as Spanish nationals.


Art.14 The right to Social Security and to social services
 Resident aliens shall have the right to access Social Security benefits
 and services; and general, basic and specific social services and be-
 nefits in the same conditions as Spanish nationals.


 Aliens, regardless of their administrative status, have the right to
 basic social services and benefits.


Art.15 The subjection to the same taxation as Spanish nationals
 Aliens are subject to the same taxes as Spanish nationals.


Art.16 The right to family privacy (and reunification
 Resident aliens have the right to family life and to family privacy.


 Resident aliens in Spain have the right to be reunited with family
 members (as set forth in Art. 17 of this Law).


 Spouses, who have acquired residency in Spain by family ties, as well
 as the family members living together with them, shall retain their re-
 sidency even if the marital tie has been broken.


Art.17 Reunified families
 • The spouse of the resident, not separated by fact or by law.

• The children of the resident and of his/her spouse, including those
   adopted, under the age of 18, disabled or unmarried.
 • Children under the age of 18, or disabled, for whom the resident
   alien serves as legal representative.
 • Ascendants of the reunited alien or of his/her spouse, when these
   are in his/her charge and when there exists reasons to justify the
   necessity of authorising their residency in Spain.


Art.20 The right to effective legal protection
 Aliens have the right to effective legal protection (by judges and
 courts).


Art.21 The right to appeal administrative acts
 Administrative acts and resolutions adopted in relation to aliens shall
 be open to appeal.


Art.22 The right to free legal assistance
 Aliens in Spain who lack sufficient economic resources shall have the
 right to free legal assistance in procedures related to: refusal of
 entry, return or expulsion from the territory and asylum. They also
 have the right to the assistance of an interpreter.

 Resident aliens who accredit insufficient economic resources shall
 have the right to free legal assistance in equal conditions to Spanish
 nationals.


Art.23 Discriminatory acts
 Discrimination is defined as all acts which, directly or indirectly, in-
 volve a distinction, exclusion, restriction or preference against a fo-

reign person based on race, colour, ancestry, national or ethnic origin,
or religious convictions and practices; and which have as their object
or effect the destruction or limitation of the recognition or exercise,
in conditions of equality, of human rights and fundamental freedoms
in the political, economic, social or cultural spheres.


Acts of discrimination constitute:


a) Those affected by public authorities or officials, or personnel res-
   ponsible for a public service who in the exercise of their duties,
   by action or omission, perform any discriminatory act prohibited
   by the law against a foreign citizen, merely for his/her condition
   as such or for belonging to a determined race, religion, ethnic

b) All those who impose more undue burden than for Spanish natio-
   nals, or who imply a resistance to supplying to the foreign person
   goods or services offered to the public, merely for his/her condi-
   tion as such, or for belonging to a determined race, religion, ethnic
   group or nationality.


c) All those who illegally impose more undue burden than for Spanish
   nationals or who restrict or limit access to work, housing, educa-
   tion, professional training, social services and social assistance to
   aliens residing legally in Spain, merely for his/her condition as
   such or for belonging to a determined race, religion, ethnic group
   or nationality.

   of an economic activity undertaken legitimately by an alien re-
   siding legally in Spain, merely for his/her condition as such or

    adoption of criteria to the detriment of workers for their condition
    as aliens, or for belonging to a determined race, religion, ethnic
    group or nationality.

7.1 HOW AND WHY SHOULD I REGISTER?

 A municipal register is an administrative register which includes all
 inhabitants normally living or residing in that municipality. Your in-
 formation provides proof of residency in the municipality. According
 to the law, all persons residing in Spain must register in the munici-
 pality in which they reside. In order to register, you must establish a
 legal residence. Ownership of the legal residence is not required.
 Your legal residence may be rented or may be the residence a family
 member or acquaintance.


 Registration is performed at the City Hall (Ayuntamiento) correspon-
 ding to the city or town in which you reside.


 The procedure is very simple. This document will be necessary for
 the following:


 • To request regularisation, residence permits or work permits.
 • To request a health card.
 • To exchange your driver's license if an agreement exists with your
  country of birth.
 • To register your children for school.
 • And for all other requirements pertaining to aliens.


 One of the most important reasons to register in the municipal regis-
 ter is as follows: this registration is proof that you have established
 roots in order to obtain a residence permit due to exceptional cir-
 cumstances (social roots). Registration also allows you access to mu-
 nicipal benefits, such as social assistance.

REQUIRED DOCUMENTATION FOR REGISTRATION
 Requests for the following documentation can be made at the City
 Hall Office corresponding to your place of residence:


 • Individual or group registration forms.
 • Photocopy and original of your DNI (National Identity Card), pass-
  port or TIE (Identity Card for Foreigners).
 • Photocopy and original of your rental agreement/lease or signed
  authorisation by the owner of the residence in which you are living.
  In this case, this person must be included on the form to be regis-
  tered at that address. Likewise, the owner of the residence will have
  to renew his/her registration to include you.
 • In regard to children, a photocopy and original DNI (National Iden-
  tity Card), TIE (Identity Card for Foreigners) or Family Record Book.

7.3 DO IMMIGRANTS HAVE THE RIGHT
    TO HEALTHCARE?


 Spain has a public and free healthcare system; everyone in Spanish
 territory has the right to this benefit.



HEALTHCARE BENEFITS FOR IMMIGRANTS IN SPAIN

 The type of benefit will depend on your status:


 1 If you are irregular and not registered in the municipal register of
  any Spanish municipality, you only have the right to emergency he-
  althcare. This benefit covers:
  • Care for grave illnesses.
  • Accidents.


 You have the right to continuous care until the day of your medi-
 cal release.


 2 If you are irregular, but you are registered or you are authorised
  to reside in Spain, you have the right to healthcare (in both cases);
  in the same conditions as Spanish nationals, with the only require-
  ment that you register in the municipal register of in which you re-
  side, regardless of your legal status. This benefit covers:
  a) Care for grave illnesses
  b) Accidents
  c) Primary and specialised healthcare

7.4 HOW DO I REQUEST HEALTHCARE?

 • First, request the health card at your health centre and you will be
  assigned a family doctor. You will then be assigned a patient num-
  ber. You will need to provide the following documentation:
  - Certificate of registration in the municipal register (empadronamiento).
  - TIE (Identification Card for Foreigners) and/or passport.


 You will be issued an individual health card which will accredit you as
 a user of the National Healthcare System. It will also entitle you to
 Social Security pharmaceutical benefits.

LEGAL
TERMS
ASYLUM: Merciful protection offered by the State to foreign natio-
nals who are in any of the circumstances contemplated in the Law. The
primary and essential protection is that of not returning the person to
the State pursuing them.


REFUGEE: A person who due to well founded fears of persecution for
reasons of race, religion, nationality, belonging to a certain social group
or for their political opinions, is outside their country of nationality;
and due to these fears cannot be protected in that country; or if wi-
thout nationality, and due to these events, is outside the country of
habitual residence, and cannot, due to these fears, return to it.


REFUGEE/DISPLACED PERSONS: Refugees are foreign natio-
nals or stateless people who have abandoned their country of origin
due to well founded fears of persecution for reasons of race, religion,
nationality, belonging to a certain social group or for their political opi-
nions. Displaced persons are foreign nationals (or stateless people)
who are fleeing from war, general violence and flagrant violations of
fundamental human rights, but who cannot prove “well founded fears
of persecution” for the reasons enumerated in the 1951 Geneva Con-
vention.

SUBSIDIARY PROTECTION: (also referred to as complementary
protection) The protection that States grant to persons who are out-
side the definition of refugee, but should not be returned to the
country from which they came due to danger to their life or liberty, or
to fear of suffering from torture or other cruel, inhumane or degrading
treatment or punishment. This is applicable to the Regime of Displaced
Persons in Spain, also referred to as Status B.


TEMPORARY PROTECTION: An immediate response to an emer-
gency after the arrival of massive flows of refugees (e.g.: War in Bos-
nia). The cases are not studied individually. Instead, a group procedure
is performed. After a reasonable period of time has passed, the tem-
porary statute is unsustainable: Either the person is willing and able to
return or they must obtain refugee status or subsidiary protection.


EUROPEAN CITIZENSHIP: (or European Union citizenship) is en-
joyed in addition to national citizenship without replacing it. Any per-
son with nationality in a Member State possesses European Union
nationality (A Constitution for Europe Treaty).


ALIEN OR FOREIGN NATIONAL: An individual who does not
have Spanish nationality.

RESIDENT ALIEN: A foreign citizen who has requested, and has
been granted, administrative authorisation to reside in Spain.


STAY: Status of aliens who do not possess a residence permit, but
who are authorised to remain in Spain for a period not longer than ni-
nety days.


TEMPORARY RESIDENCE: Status of aliens who are authorised
to remain in Spain for a period longer than 90 days and less than 5
years.


PERMANENT RESIDENCE: Status of aliens who are authorised to
remain in the territory of a nation indefinitely and to work in conditions
equal to Spanish nationals.


UNDOCUMENTED PERSON: Aliens who do not possess documen-
tation to accredit their identity or personal circumstances.


FAMILY REUNIFICATION: The right of resident aliens to request
residence for certain family members in the country in question, under
certain legal conditions.

ALIEN WORKER: A person who, without Spanish nationality,
exercises or attempts to exercise a remunerated, labour or profes-
sional activity in Spain, either self employed or otherwise.

their legal status in Spain (similar to the Spanish D.N.I. or National Iden-

  • 5. PRÓLOGO • e do not often encounter something that is necessary because it is use- W ful. In the times in which we live, some needs are established based on opportunity, aesthetics and political correctness. Usefulness, the first major objective of any enterprise, project, initiative or challenge, is not always considered. Usefulness. Something that serves a purpose. Something that serves a purpose for our benefit. Although it may seem repetitive, messages often re- quire repetition to be clear, persuasive and convincing. Thus, in your hands, you hold a tool that is both necessary and useful. Necessary, since the target popula- tion group continues to grow larger, more heterogeneous and more complex. Use- ful, since it is not just a tool or manual; it is a guide containing applicable, up to date, and (as I mentioned above) useful information. A guide designed to assist both those who have recently arrived and those who have been living among us for some time. A guide designed to orient, lead, illustrate and lay out steps for im- migrants wishing to make their way in our community. Once the desire to integrate is expressed, our community also becomes their community. Although I have not yet mentioned it, I have hinted at it. In your hands, you hold the Municipal Information Guide for Immigrants. I would now like to go over these terms. First, as I mentioned above, it is a guide. Although it is a book, it is not just any book. This book includes information regarding current legislation, immigrant rights and obligations, key questions relating to initiation and integration within the local community, legal terms, available municipal services and public institu- tions, information of interest, internet pages, and useful telephone numbers; and most important in my view, information regarding non-profit entities, associations,
  • 6. organisations, and civil societies which offer assistance and work with immigrants free of charge to aid integration. Second, it is a Municipal Guide, prepared and pu- blished by the Municipal Institute of Social Services (i.e., the City Council (Ayun- tamiento) of Badajoz) as a sign of our commitment, solidarity and dedication to immigrants. The City Hall (Ayuntamiento) is the house of the people and welco- mes everyone. Here, all are equal and possess the same rights and obligations. The primary message offered by the First local institution is as follows: we are al- ways available to assist you. Third, this is a Municipal Information Guide. In other words, it is an instruction manual specifically for starting out, since new starts can be complicated and challenging. It is one of the many gateways through which an immigrant must cross. It is the first of many steps. Our objective is to ensure that this first step is as comfortable, clear, and easy as possible. Lastly, although this guide is intended for immigrants, others already here may also find this guide useful, regardless of whether or not they are immigrants. Additionally, it is a useful guide to keep within reach in case the opportunity arises to work together in si- milar circumstances.   • 7. he 1st Municipal Plan for Immigrant Integration specifically focuses on pro- T viding information, guidance and counsel to foreign residents of the city. This includes existing resources within the Municipality regarding immigra- tion, legal framework, rights and obligations applicable to new citizens, and access to various social protection systems (health, education, culture, social services, etc.) from both the City Council (Ayuntamiento) of Badajoz and other public ad- ministrations. Along these lines, the Municipal Information Guide for Immigrants is intended as a practical tool for foreign nationals already residing in the city, those who have recently arrived, and the native population (general population, employers and professionals). The Guide provides basic information, which is divided by subject into areas that pertain most to groups that have recently arrived to the city. The last section of the Guide includes a list of organisations that offer assistance to the immigrant population. This section is vital due to the important role that these social initiative entities play when initially assisting and welcoming foreign nationals who have recently arrived to the city. In closing, the Guide is intended for foreign nationals who have recently arrived to the city. This includes those who desire to live among us, understand their rights and obligations as citizens, educate their children, share the values of our society in Badajoz, learn our official language, share in various cultural activities and understand how our many institutions operate to represent each one of us to everyone. On the other hand, it is also intended for the host society, which com- prises the citizens of Badajoz who live with this new reality on a daily basis. This will allow them to relate to immigrant communities on both a personal and pro- fessional level, in the work force, etc. Therefore, the availability of this basic infor- mation is invaluable and will enable all of us to begin the integration process together.   • 18. 1.2.1 INFORMATION, ASSESSMENT AND GUIDANCE SERVICE (SIVO) SIVO offers public and free service, which are available to everyone. SIVO also facilitates first contact between citizens (individuals, fami- lies and groups) and social services. WHAT DO WE OFFER? Professional and confidential assistance by a Social Worker assig- ned to each neighbourhood or area of the city, who provides the following: • Information to ensure citizens understand their rights, and are aware of existing resources, procedures and alternatives available within the Social Service system for specific social needs, such as: adoptions, domiciliary care, senior citizens centres, children’s cen- tres, non-contributory pensions, drug addiction centres, mistreat- ment situations, family cohabitation issues, etc. • Individual analysis of each consultation by studying the situation and assessing the case to identify the most suitable solution. • Specific social interventions, if required by the situation. • Channelling and referral of cases to assistance and protection ser- vices in the community or to Specialised Social Services. • Technical consulting for associations or entities working and colla- borating in the social welfare field. • Globally collecting and analysing requirements and issues that arise to design alternatives such as new programmes and social re- sources. 18

  • 20. 1.2.2 CHILDREN AND FAMILY SERVICES PROGRAMME This service consists of various multi-professional teams that provide children in at-risk situations and their families with the resources and support necessary to guarantee the safety and integrity of the child and coverage of basic needs to remain in their home. WHAT ARE THE OBJECTIVES? To protect the rights of children by reducing risk factors and social difficulties that affect their situation, safeguarding their physical and moral integrity and striving to maintain a suitable family environment for development. WHAT DO WE OFFER? Individual, family and group intervention when family deprivation si- tuations are detected that could place the child in an at risk situation.   • 22. 1.2.3 DOMICILIARY CARE SERVICES The objective of this service is to offer different types of in-home care for people and families, who due to special circumstances are unable to perform their normal activities. The objective is to ensure people and/or families with physical disa- bilities can remain in their home. WHAT DO WE OFFER? • Domestic care: housecleaning, clothes washing and ironing, shop- ping, cooking, etc. • Personal care: companionship, personal hygiene, feeding, mobility inside the home, accompaniment outside the home to perform per- sonal business, etc. • Social support for family crisis situations (death, hospitalisation, etc.) WHO DOES THIS APPLY TO? This service applies to people or families that lack personal auto- nomy and require any of the services described. Priority care is pro- vided to elderly, disabled or handicapped persons whose personal autonomy is significantly affected. Care is also provided to families with difficulties or who lack the personal resources for develop- ment. HOW CAN YOU TAKE ADVANTAGE OF THESE SERVICES AND PROGRAMMES? This service can be requested at the Information, Assessment and Guidance Service (SIVO) corresponding to your place of residence by 22
  • 23. calling for an appointment (924-210099) and/or through your Health Centre for personal assistance. COST OF THE SERVICE During a session held on 31/05/2000, the City Council adopted an agreement to approve a Regulatory Ordinance regarding charges to the public for services (B.O.P. 7-7-2000), modified by the Municipal Plenary Session (B.O.P. 3-3-2006). In this ordinance, the beneficiary must pay an amount depending on the monthly per capita income of the family. This service will be free for people or families with a monthly per capita income of less than 50% of the S.M.I. (Salario Mínimo Interprofesional- Interprofessional Minimum Wage). • • • • • • • • • 23
  • 24. 1.2.4 IN-HOME TELECARE SERVICE A 24 hour service designed to allow elderly or disabled persons to make immediate verbal contact with a Centre attended by professio- nals prepared to respond to any urgent need. HOW DOES IT WORK? A mechanical device activates when the person presses a button on a watch or medallion, which is worn by the user at all times. A tele- phone line and electricity must be available in the home. WHAT DO WE OFFER? • Immediate telephone support for cases of anxiety, loneliness, do- mestic accidents or falls. • Resource mobilisation in emergency situations. • Permanent follow-up by periodic telephone calls. • Diary to remind the user of important information: medication, pro- cedures, etc. WHO IS IT FOR? People over the age of 65 or disabled persons who are alone, socially isolated, have mobility problems, are extremely elderly, etc., who live or spend a large portion of time alone or in the company of people in a similar at risk situation. HOW CAN YOU TAKE ADVANTAGE OF THESE SERVICES AND PROGRAMMES? Request telecare service at the Information, Assessment and Gui- dance Service (SIVO) centre corresponding to your place of residence 24

  • 67. Organic Law 4/2000, of 11 January, on the rights and freedoms of aliens in Spain and their social integration (Alien Law) is currently in effect. However, this law has undergone various modifications as a result of the approval of subsequent organic laws which have subs- tantially modified its articles. The law includes the rights and duties listed below: Art.3 The rights of aliens and interpretation of the regulation Aliens in Spain shall enjoy the rights and liberties recognised in Title I of the Constitution. As a general criteria, aliens shall exercise the rights granted to them by this Law in conditions of equality with Spa- nish nationals. Art.4 The right to documentation Aliens in Spanish territory have the right and the obligation to pos- sess documentation which accredits their identity, as well as that which accredits their status in Spain. Art.5 The right to freedom of movement Aliens in Spain shall have the right to move freely within Spanish te- rritory and to choose their place of residence. • • 67
  • 68. Art.6 Public participation Resident aliens in Spain shall have the right of suffrage in municipal elections by criteria of reciprocity (aliens from the EU, Argentina, Chile and Uruguay). Resident and registered aliens possess all of the rights established by the LBRL, and thus may be heard on issues which affect them. Local Town Councils (Ayuntamientos) shall incorporate them into the register and shall maintain updated information on aliens residing within the municipality. Art.7 Freedom of assembly and public demonstration Aliens shall have the right of assembly and may exercise it when they have obtained authorisation for their stay or residence in Spain. Art.8 Freedom of association Aliens shall have the right of association and may exercise it when they have obtained authorisation for their stay or residence in Spain. • • • 68

Art.9 The right to education All aliens under the age of 18 have the right and the duty to an edu- cation in the same conditions as Spanish nationals, the right to free and compulsory basic education (basic and secondary compulsory education up to the age of 16), the right to obtain the corresponding academic certification and access to the scholarships and grants system. The Government shall guarantee a number of places sufficient to en- sure early childhood education – which is of a voluntary nature – for aliens. Resident aliens shall have the right to education of a non-compulsory nature in the same conditions as Spanish nationals (high school (ba- chillerato) and vocational training from 16 to 18 years of age). Art.10 The right to work and to Social Security Aliens who meet the requirements specified in this Organic Law and its provisions, shall have the right to engage in remunerated activi- ties, on a basis of self-employment or otherwise, as well as access to the Social Security system (exercising this right shall be limited by work permit authorisation). Resident aliens in Spain shall have access, in conditions equal to those of nationals of EU Member States, to employment in Public Ad- ministration. To this effect, they may apply for positions of Public Employment offered by Public Administrations. 69

Art.11 Freedom to unionise and to strike Aliens shall have the right to unionise freely or to join a professional organisation, and may exercise this right when they have obtained authorisation for their stay or residence, in the same conditions as Spanish workers. Once authorised to work, they may exercise their right to strike, in the same conditions as Spanish nationals. Art.12 The right to healthcare Aliens in Spain who are registered in the municipal register where they normally reside shall have the right to healthcare in the same conditions as Spanish nationals. Aliens in Spain have the right to emergency public healthcare in the case of serious illness or accident, and to the continuance of such care, until a medical release has been given. Aliens in Spain who are under the age of 18 shall have the right to he- althcare in the same conditions as Spanish nationals. Aliens in Spain who are pregnant shall have the right to pre-natal, childbirth and post-partum healthcare (up to six weeks after child- birth). • • 70
  • 71. Art.13 The right to housing assistance Resident aliens have the right to access the public system of housing assistance in the same conditions as Spanish nationals. Art.14 The right to Social Security and to social services Resident aliens shall have the right to access Social Security benefits and services; and general, basic and specific social services and be- nefits in the same conditions as Spanish nationals. Aliens, regardless of their administrative status, have the right to basic social services and benefits. Art.15 The subjection to the same taxation as Spanish nationals Aliens are subject to the same taxes as Spanish nationals. Art.16 The right to family privacy (and reunification Resident aliens have the right to family life and to family privacy. Resident aliens in Spain have the right to be reunited with family members (as set forth in Art. 17 of this Law). Spouses, who have acquired residency in Spain by family ties, as well as the family members living together with them, shall retain their re- sidency even if the marital tie has been broken. Art.17 Reunified families • The spouse of the resident, not separated by fact or by law. 71
  • 72. • The children of the resident and of his/her spouse, including those adopted, under the age of 18, disabled or unmarried. • Children under the age of 18, or disabled, for whom the resident alien serves as legal representative. • Ascendants of the reunited alien or of his/her spouse, when these are in his/her charge and when there exists reasons to justify the necessity of authorising their residency in Spain. Art.20 The right to effective legal protection Aliens have the right to effective legal protection (by judges and courts). Art.21 The right to appeal administrative acts Administrative acts and resolutions adopted in relation to aliens shall be open to appeal. Art.22 The right to free legal assistance Aliens in Spain who lack sufficient economic resources shall have the right to free legal assistance in procedures related to: refusal of entry, return or expulsion from the territory and asylum. They also have the right to the assistance of an interpreter. Resident aliens who accredit insufficient economic resources shall have the right to free legal assistance in equal conditions to Spanish nationals. Art.23 Discriminatory acts Discrimination is defined as all acts which, directly or indirectly, in- volve a distinction, exclusion, restriction or preference against a fo- 72
  • 73. reign person based on race, colour, ancestry, national or ethnic origin, or religious convictions and practices; and which have as their object or effect the destruction or limitation of the recognition or exercise, in conditions of equality, of human rights and fundamental freedoms in the political, economic, social or cultural spheres. Acts of discrimination constitute: a) Those affected by public authorities or officials, or personnel res- ponsible for a public service who in the exercise of their duties, by action or omission, perform any discriminatory act prohibited by the law against a foreign citizen, merely for his/her condition as such or for belonging to a determined race, religion, ethnic group or nationality. b) All those who impose more undue burden than for Spanish natio- nals, or who imply a resistance to supplying to the foreign person goods or services offered to the public, merely for his/her condi- tion as such, or for belonging to a determined race, religion, ethnic group or nationality. c) All those who illegally impose more undue burden than for Spanish nationals or who restrict or limit access to work, housing, educa- tion, professional training, social services and social assistance to aliens residing legally in Spain, merely for his/her condition as such or for belonging to a determined race, religion, ethnic group or nationality. 73
  • 74. d) All those who impede, through actions or omissions, the exercise of an economic activity undertaken legitimately by an alien re- siding legally in Spain, merely for his/her condition as such or for belonging to a determined race, religion, ethnic group or na- tionality. e) Indirect discrimination constitutes all treatment derived from the adoption of criteria to the detriment of workers for their condition as aliens, or for belonging to a determined race, religion, ethnic group or nationality. • • • • • • • • • • • 74

  • 79. 7.1 HOW AND WHY SHOULD I REGISTER? A municipal register is an administrative register which includes all inhabitants normally living or residing in that municipality. Your in- formation provides proof of residency in the municipality. According to the law, all persons residing in Spain must register in the munici- pality in which they reside. In order to register, you must establish a legal residence. Ownership of the legal residence is not required. Your legal residence may be rented or may be the residence a family member or acquaintance. Registration is performed at the City Hall (Ayuntamiento) correspon- ding to the city or town in which you reside. The procedure is very simple. This document will be necessary for the following: • To request regularisation, residence permits or work permits. • To request a health card. • To exchange your driver's license if an agreement exists with your country of birth. • To register your children for school. • And for all other requirements pertaining to aliens. One of the most important reasons to register in the municipal regis- ter is as follows: this registration is proof that you have established roots in order to obtain a residence permit due to exceptional cir- cumstances (social roots). Registration also allows you access to mu- nicipal benefits, such as social assistance. 79

REQUIRED DOCUMENTATION FOR REGISTRATION Requests for the following documentation can be made at the City Hall Office corresponding to your place of residence: • Individual or group registration forms. • Photocopy and original of your DNI (National Identity Card), pass- port or TIE (Identity Card for Foreigners). • Photocopy and original of your rental agreement/lease or signed authorisation by the owner of the residence in which you are living. In this case, this person must be included on the form to be regis- tered at that address. Likewise, the owner of the residence will have to renew his/her registration to include you. • In regard to children, a photocopy and original DNI (National Iden- tity Card), TIE (Identity Card for Foreigners) or Family Record Book. • • • • • • • • 80

  • 82. 7.3 DO IMMIGRANTS HAVE THE RIGHT TO HEALTHCARE? Spain has a public and free healthcare system; everyone in Spanish territory has the right to this benefit. HEALTHCARE BENEFITS FOR IMMIGRANTS IN SPAIN The type of benefit will depend on your status: 1 If you are irregular and not registered in the municipal register of any Spanish municipality, you only have the right to emergency he- althcare. This benefit covers: • Care for grave illnesses. • Accidents. You have the right to continuous care until the day of your medi- cal release. 2 If you are irregular, but you are registered or you are authorised to reside in Spain, you have the right to healthcare (in both cases); in the same conditions as Spanish nationals, with the only require- ment that you register in the municipal register of in which you re- side, regardless of your legal status.   • 84. 7.4 HOW DO I REQUEST HEALTHCARE? • First, request the health card at your health centre and you will be assigned a family doctor. You will then be assigned a patient num- ber. You will need to provide the following documentation: - Certificate of registration in the municipal register (empadronamiento). - TIE (Identification Card for Foreigners) and/or passport. You will be issued an individual health card which will accredit you as a user of the National Healthcare System. It will also entitle you to Social Security pharmaceutical benefits. • • • • • • • • • • 84

  • 87. ASYLUM: Merciful protection offered by the State to foreign natio- nals who are in any of the circumstances contemplated in the Law. The primary and essential protection is that of not returning the person to the State pursuing them. REFUGEE: A person who due to well founded fears of persecution for reasons of race, religion, nationality, belonging to a certain social group or for their political opinions, is outside their country of nationality; and due to these fears cannot be protected in that country; or if wi- thout nationality, and due to these events, is outside the country of habitual residence, and cannot, due to these fears, return to it. REFUGEE/DISPLACED PERSONS: Refugees are foreign natio- nals or stateless people who have abandoned their country of origin due to well founded fears of persecution for reasons of race, religion, nationality, belonging to a certain social group or for their political opi- nions. Displaced persons are foreign nationals (or stateless people) who are fleeing from war, general violence and flagrant violations of fundamental human rights, but who cannot prove “well founded fears of persecution” for the reasons enumerated in the 1951 Geneva Con- vention. • • • • 87

SUBSIDIARY PROTECTION: (also referred to as complementary protection) The protection that States grant to persons who are out- side the definition of refugee, but should not be returned to the country from which they came due to danger to their life or liberty, or to fear of suffering from torture or other cruel, inhumane or degrading treatment or punishment. This is applicable to the Regime of Displaced Persons in Spain, also referred to as Status B. TEMPORARY PROTECTION: An immediate response to an emer- gency after the arrival of massive flows of refugees (e.g.: War in Bos- nia). The cases are not studied individually. Instead, a group procedure is performed. After a reasonable period of time has passed, the tem- porary statute is unsustainable: Either the person is willing and able to return or they must obtain refugee status or subsidiary protection. EUROPEAN CITIZENSHIP: (or European Union citizenship) is en- joyed in addition to national citizenship without replacing it. Any per- son with nationality in a Member State possesses European Union nationality (A Constitution for Europe Treaty). ALIEN OR FOREIGN NATIONAL: An individual who does not have Spanish nationality. • • • 88
  • 89. RESIDENT ALIEN: A foreign citizen who has requested, and has been granted, administrative authorisation to reside in Spain. STAY: Status of aliens who do not possess a residence permit, but who are authorised to remain in Spain for a period not longer than ni- nety days. TEMPORARY RESIDENCE: Status of aliens who are authorised to remain in Spain for a period longer than 90 days and less than 5 years. PERMANENT RESIDENCE: Status of aliens who are authorised to remain in the territory of a nation indefinitely and to work in conditions equal to Spanish nationals. UNDOCUMENTED PERSON: Aliens who do not possess documen- tation to accredit their identity or personal circumstances. FAMILY REUNIFICATION: The right of resident aliens to request residence for certain family members in the country in question, under certain legal conditions. • • • 89
