Lawsuit Against Chesapeake Energy's Ohio Utica Shale Buell 8H Well

A lawsuit filed by landowner Kenneth Buell in Harrison County, OH requesting the court stop Chesapeake Energy from continuing its operations at what is known as the Buell 8H well--Ohio's single, largest-producing Utica Shale well. Chesapeake does own the mineral rights under Buell's property, but a local judge ruled in a similar case that the drilling could only go straight down and not horizontally, passing the boundary of the property--even if the driller owns the mineral rights on adjacent properties. It centers on language in the deed limiting mineral harvesting "through and under" to a 21-year period. This document also contains a similar filing (in January 2012) by the Jewett Sportsmen & Farmers Club which was granted.
