The Integrity of the General Election Commission is Questioned in the Case of the Failed Verification of the Ummat Party for the 2024 General Election Vicki Dwi Purnomo1, Kelik Endro Suryono2,Aida Dewi3 1,2,3 Widya Mataram University, Yogyakarta, Indonesia Abstract: The Indonesian nation will carry out the holding of the 2024 General Elections where the quality of democracy itself is largely determined by the organizers of the General Elections, which is the institution responsible for the implementation of the General Elections (KPU) itself. Election legitimacy can be damaged if this institution takes sides with one or several contestants, planning is not mature, the implementation of election stages is not neat, voter registration is discriminatory, vote counting is not transparent and so on, all of this depends on the credibility and integrity of the election organizers. However, in practice conflicts of interest also often occur, when a person KPU members have an emotional bond and/or indebtedness with a pair of candidates who have instilled a favor or helped them when registering as candidates for KPU members. So often this partiality arises when the General Election is held. From here, this research intends to deepen the study of the neutrality of the KPU of the Republic of Indonesia in the holding of the 2024 General Elections, with the main problem being how the neutrality of the KPU is in preparation for holding the elections. This research uses qualitative research methods, in which data sources are obtained by using library techniques and in-depth interviews. Keywords: Discriminatory1, Elections2, KPU INTRODUCTION Along with the progress of the times, elections occupy an important position because they are related to several things. Elections are the most important mechanism for the continuation of representative democracy. In this understanding, elections are considered as the most sophisticated mechanism invented so that the people remain in power over themselves. The rapid development of society, the large number of people, the wider distribution and the activities carried out are increasingly diverse, making the complexity of the problems faced by the people more varied. These conditions do not allow people to gather in one place and discuss problems which they facing in a manner are you serious and complete. The general election (Pemilu) is the maximum operationalization of democracy, not only operated as the use of people's sovereignty, but at the same time to determine political leaders and government. Such a combination of electoral systems is required by democracy which brings various benefits. In the perspective and practice of democracy, it can also be referred to as government by the people which is run by representatives they choose themselves through an election that takes place democratically and periodically. Representative democracy is a necessity with elections, as a mechanism for selecting representatives. Elections are a democratic state system. In fact, there is no country that claims to be democratic without holding elections even though that country is essentially authoritarian. Elections are important to discuss also related to the implications arising from the holding of elections. In the third wave Election democratization is a way to weaken and end authoritarian regimes. So that a form of embodiment of democracy in Indonesia is one of them by holding general elections. Elections are interpreted as a means of realizing people's sovereignty to produce people's representatives who are aspirational, have quality, and are able to be responsible according to Pancasila and the 1945 Constitution of the Republic of Indonesia. In a democratic country, elections are one of the main pillars of an accumulation of people's will. Elections are very important to determine the people's representatives

Every citizen has the right in a democracy. This right is regulated in Law No. 7 of 2017 article 198 paragraph (1 and 2) explaining that "Voters who have the right to vote are Indonesian citizens who have been registered by the election organizers in the voter list and on voting day 2 have reached the age of 17 (seven) fifteen) years or more, are married, or have been married before. According to Law No. 7 of 2017 concerning elections, Article 1 paragraph (8) states that the General Elections Commission is a national, permanent and independent election management body whose job is to carry out elections. The KPU institution has a working area covering the entire territory of the Unitary State of the Republic of Indonesia (NKRI). The KPU is independent as referred to in Article 7 paragraph (3) of Law No. 7 of 2017 in the administration of elections, the KPU is free from the influence of any party in accordance with the relationship between its duties and authorities. To assist the implementation of KPU's duties and authorities to run smoothly, a General Secretariat was formed which was led by a General Secretariat and was a Government Agency. Based on Law no. 15 of 2011 concerning the Organization of General Elections states that "to improve the quality of election administration which can guarantee the implementation of people's political rights, professional election organizers who have integrity, capability and accountability are needed through the General Election Commission (KPU)". The success of the election is determined by the level of political participation of the people in exercising their right to vote. The magnitude of the political participation of the community is influenced by the political awareness of the community, where this political awareness is manifested in how much public participation in elections by using their voting rights to vote. In preparation for holding the 2024 General Election, it is currently still in the process of verifying the parties participating in the election. Of these, 24 political parties have passed the administrative verification stage. At the verification stage, the KPU stated that there were 9 political parties in the DPR RI that passed and there were also 9 non-parliamentary political parties that passed the factual verification stage. Meanwhile, 6 other parties were declared disqualified. The six parties that did not pass the administrative verification sued the KPU to the Election Supervisory Body (Bawaslu). They are the Indonesian People's Swara Party (Parsindo), PKPI, the Indonesian Republican Party, the Adil Makmur People's Party (Prima), the Republican Party, and the Republican Party One. 18 Political Parties that Pass the 2024 Election Verification On October 14, 2022, the KPU announced the results of the administrative verification of political parties as candidates for the 2024 election for members of the People's Representative Council (DPR), Regional House of Representatives. There are 9 parliamentary parties that have passed verification:  Indonesian Democratic Party of Struggle (PDIP)  Prosperous Justice Party (PKS)  NasDem Party  Democratic party  National Awakening Party (PKB)  National Mandate Party (PAN)  Working Group Party (Golkar)  United Development Party (PPP)  Great Indonesia Movement Party (Gerindra) There are 5 parties participating in the 2019 election that did not qualify for parliament:  Crescent Star Party (UN)  People's Conscience Party (Hanura)  Indonesian Solidarity Party (PSI)  Perindo Party

There are 4 new ones that passed verification:  Indonesian Awakening Party (PKN)  Indonesian People's Wave Party (Gelora)  Labor Party  Community Party From the results of the plenary meeting by the General Elections Commission (KPU), the recapitulation of factual verification (verfak) of 18 political parties (parpol) candidates for the 2024 Election on Wednesday (14/12/2022). From the results of the verification, it shows that only the Ummat Party does not meet the requirements (TMS) for factual verification. Factual verification itself is research and matching by the KPU on the correctness of the required documents with objects in the field as a requirement for political parties to participate in the election. In the recapitulation results, it was found that the Ummat Party did not meet the membership and management requirements in East Nusa Tenggara (NTT) and North Sulawesi (North Sulawesi) . This made the Ummat Party feel disadvantaged and sued the KPU by bringing 6,000 pieces of evidence accompanied by attorney Denny Indrayana. In relation to the above, it is only natural that the general election is a momentum for the KPU to be able to strive to increase public trust in a neutral and open manner. Therefore, the KPU as the election management body must strive to be able to work properly and with integrity. THEORETICAL REVIEW The implementation of political education is very closely related to the General Election Commission. The General Election Commission (abbreviated as KPU) is the state agency that organizes general elections in Indonesia. In Law Number 22 of 2007 concerning Election Organizers, it is regulated regarding General Election organizers carried out by a General Election Commission (KPU) which is national, permanent and independent. The General Election Commission (KPU) itself is an incarnation of the General Elections Institute (LPU), the institution in charge of holding elections during the New Order era. The General Election Commission is a state institution that organizes general elections in Indonesia, which include the General Election for Members of the DPR/DPD/DPRD, the General Election for the President and Vice President, as well as the General Election for Regional Heads and Deputy Regional Heads. The General Election Commission cannot be on an equal footing with other state institutions whose powers are determined and granted by the 1945 Constitution. In terms of Organizational Behavior, this role is a component of the organization's social system, in addition to organizational norms and culture. Here in general 'role ' can be defined as "expectations about appropriate behavior in a job position (leader, subordinate)". There are two types of behavior expected in a job, viz  role perception: namely a person's perception of how that person is expected to behave; or in other words, is an understanding or awareness of the pattern of behavior or function expected of that person, and  role expectation: namely the way other people accept one's behavior in certain situations. With the role played by someone in the organization, an important component will be formed in terms of identity and ability to work. In this case, an organization must ensure that the roles are clearly defined. Some of the KPU's roles and authorities are to determine parties that are entitled to participate in elections, determine candidates who will participate in elections, determine election results, determine election procedures, schedule elections. The General Election Commission is the name given by the Law on Elections to the election management body. UUD 13 1945 Amendment to article 22E, explains that the name of the election organizing body is not required to be called the General Election Commission, but is a general word to refer to the election

Information regarding the general election commission is explained in RI Law no. 22 of 2007 concerning general election organizers article 1 paragraph 7 which states that the KPU is: Provincial General Election Commission and Regency/City General Election Commission, hereinafter referred to as Provincial KPU and Regency/City KPU, are election organizers at the province and regency/city level. KPU is an independent election organizer in Indonesia that is national, permanent and independent, as stated in Article 1 paragraph (6) of Law No. 22 of 2007 concerning the Organization of Elections, it is stated that the General Election Commission, hereinafter referred to as the KPU, is a national, permanent, and independent election organizer. Regional and Deputy Regional Heads. Prior to the 2004 election, members could be filled by elements from political parties, but after the issuance of Law no. 4 of 2000 KPU members are required to be non-participants. Over time, one way to improve the quality of elections is to organize elections. The KPU as the organizer of the election is required to be independent and non-participant. For this reason, several revisions to the law regarding elections after the New Order took place. Previously, the implementation of elections was regulated by Law no. 12 of 2003 concerning the Election of the DPR, DPD and DPRD, Law no. 23 of 2003 concerning Presidential and Vice Presidential Elections. Then came Law No. 22 of 2007 concerning Election Organization. Prior to the 2009 election, Law no. 42 of 2008 concerning the General Election of the President and Vice President accompanied by revisions to regional government laws, namely Law no. 32 of 2004 revised by Law no. 12 of 2008 concerning Regional Government. Then the DPR and the Government passed Law No. 15 of 2011 concerning the Implementation of Elections. In Law no. 15 of 2011 concerning the Implementation of Elections is further regulated regarding other bodies tasked with realizing fair and liberal elections. These bodies are:  Election Supervisory Body (Bawaslu)  Provincial Election Supervisory Board (Provincial Bawaslu)  Regency/Municipal Election Supervisory Committee  District Election Supervisory Committee (District Panwaslu)  Field Election Supervisory Committee  Field Election Supervisor  Overseas Election Supervisors  Election Honorary Board (DKKP)  District Election Committee (PPK)  Voting Committee (PPS)  Overseas Election Committee (PPLN)  Voting Organizing Group (KPPS)  Overseas Voting Organizing Group KPU has an important meaning in the course of elections in Indonesia as an institution that plays a very important role in regulating the implementation of elections so that it is hoped that its role can bring elections to an honest and fair democracy. Implementation in the context of carrying out the mandate of Law No. 32 of 2004 includes the implementation of direct regional head elections in the regions, so that each region has a Regional KPU which is called the Provincial KPU, Regency or City KPU. As a result of the mandate of Law No. 32 of 2004, the regional KPU has a role. CONCLUSIONS Types and Types of Research Types and types of research used in research on the duties and powers of the KPU in preparation for general elections in the Republic of Indonesia:

Volume: 03 | Issue: 01 | 2023 | Open Access | Impact Factor: 5.735 International Journal of Current Researches in Sciences, Social Sciences and Languages 5 All rights are reserved by IJCRSSSL.  Type of Research This type of research is qualitative research, is research to answer a problem in depth in the context of the time and situation in question, carried out fairly and naturally in accordance with objective conditions in the field.  Type of Research This research uses the type of case study approach which is a scientific activity that is carried out intensively, in detail and in depth about a program, event and activity, both at the level of an individual, a group of people, an institution or an organization to gain in-depth knowledge about the task and the authority of the KPU Based on the formulation of the problem, this study has the following objectives:  Analyze the role of the General Election Commission (KPU) in carrying out honest, fair and transparent elections to produce good elections and gain the trust of the public.  Assess the seriousness of the General Election Commission in carrying out the 2024 election process. BENEFITS OF RESEARCH The benefits of research can be divided into two characteristics, namely the benefits of theoretical research and the benefits of practical research to build the nation. Types and Sources of Legal Materials Sources of legal research can be in the form of primary legal materials and secondary legal materials. Primary legal material is legal material that is authoritative or means having authority. Legal materials that are binding and are the main foundation used in this research, namely laws and regulations related to the object of research, including:  Law Number 22 of 2007 concerning General Election Organizers;  Law Number 12 of 2011 concerning Formation of Legislation;  Law Number 7 of 2017 concerning General Elections; and  General Election Commission Regulations. While the secondary legal materials used are in the form of legal books and journals related to the legal object of this research. Especially books on election law and the drafting of statutory regulations. RESULTS AND DISCUSSION The General Election Commission is the name given by the Law on Elections to the election management body. The 1945 Constitution Amends article 22E, explaining that the name of the election organizing body is not required to be called the General Election Commission, but is a general word to refer to the election organizing body, so that actually the law may provide another name to refer to the election organizing body. According to Law Number 15 of 2011 concerning Organizing General Elections Article 1 paragraph 1 Affirms that General Elections, hereinafter referred to as Elections, are a means of implementing the people which are held directly, publicly, freely, confidentially, honestly, fairly in the Republic of Indonesia based on Pancasila and the Law The 1945 Constitution states that in carrying out its main tasks, the KPU has the duties and authorities regulated in Law Number 15 of 2011 concerning the Organization of General Elections 15 changes from Law Number 22 of 2007 concerning the Implementation of General Elections. The duties, powers and obligations of the KPU are regulated in Law No. 15 of 2011 article 8, namely: A. The duties and authorities of the KPU in organizing the election for members of the People's Representative Council, Regional Representative Council and Regional People's Representative Council, include: 1) Plan programs and budgets and set schedules. 2) Coordinate, organize and control all stages of the election. 3) Carry out socialization of the election administration and/or those related to the KPU's duties and authorities to the public.

The KPU's duties and authorities in organizing the Presidential and Vice-Presidential Election, such as: 1. Plan programs and budgets and set schedules. 2. Carry out socialization on the implementation of elections and/or those related to the duties and authorities of the KPU to the public. 3. Evaluate and prepare reports for each stage of the Election. C. The duties and authorities of the KPU in holding elections for governors, regents and mayors, such as: 1. Develop and establish technical guidelines for each election stage after consulting the DPR and the Government. 2. Coordinate and monitor the selection process. 3. Conduct an annual evaluation of the holding of elections. Putri (2015) states that the central KPU, Provincial KPU, and Regency/City KPU, have the duty to carry out socialization of the election administration related to the duties and powers of the KPU to the community. Socialization here is not just socialization that touches on procedural aspects such as election stages and election techniques, but also substantive aspects such as explaining the benefits and importance of an election, as well as forming intelligent voters. In addition to being responsible for the implementation of elections at each stage, the KPU is also required to carry out elections in a safe and peaceful manner. Therefore, the KPU is required to work in a transparent, independent and independent manner. Independent and professional election administration officers are one of the main factors in creating democratic and peaceful elections. In Article 10 of Law Number 15 of 2011 concerning General Election Organizers, the duties and powers of the KPU include:  Describe the program and implement the budget as well as determine the schedule in the District/City.  Carry out all stages of implementation in the Regency/City based on the provisions of the laws and regulations.  Form PPK, PPS, and KPPS in their working area.  Coordinate and control the implementation stages by PPK, PPS, and KPPS in their working area.  Updating voter data based on population data prepared and submitted by the Government by taking into account the last 7 Election data and/or Elections for Governors, Regents and Mayors and stipulating them as voter lists.  Deliver voter lists to the Provincial KPU.  Recapitulate the vote counting results for the Presidential and Vice-Presidential Election in the relevant Regency/City based on the results of the vote counting recapitulation at the PPK by preparing an official report on vote counting and a certificate of vote counting results.  Make an official report on vote counting and vote counting certificates and must hand them over to witnesses participating in the Election, Regency/Municipal Panwaslu and Provincial KPU.  Follow up immediately the recommendations of the Regency/Municipal Panwaslu on findings and reports of alleged election violations.  Imposing administrative sanctions and/or temporarily disabling PPK members, PPS members, Regency/Municipal KPU secretaries, and Regency/City KPU secretariat employees who are proven to have committed an act that disrupted the stages of the Election administration based on the recommendation of the Regency/Municipal Panwaslu and/or provisions of laws and regulations invitation.  Carry out outreach on the implementation of elections and/or related to the duties and authorities of Regency/Municipal KPU to the public.  Evaluate and prepare reports for each stage of the Election.

ACKNOWLEDGMENT  With the return of the ummat party as an election participant, it created a stigma that the KPU's performance was reckless and without consideration in deciding on activities. Because this is growing wildly in the community, the integrity of the KPU is down.  The report on the chairman of the Republican Party One or Hasnaeni Moein has become a bad stigma for the General Election Commission as an Election Organizing Body, however , the KPU chairman was reported on suspicion of immorality.  The problem with the weakness of the Sipol system is that people's fears of trust in the KPU are decreasing due to a lack of preparedness. RECOMMENDATION The General Election Commission must have high integrity, the elections have been held several times but public dissatisfaction with the KPU's performance is still high. This needs to be the KPU's evaluation starting from:  The recruitment of KPU members must be reviewed, for example, at least 3 years of not being involved in organizations affiliated with politics. This is to reduce the form of nepotism and collusion in the election process.  It is better if cases like this are immediately resolved or put on trial, so that the KPU's marwah is well maintained.  It is better if the quality of KPU technology is properly tested first so that when it is used there are no errors The KPU should start working openly and without any pressure from any party to maintain the integrity of the election. CONFLICT OF INTEREST However, it cannot be denied that from year to year the holding of elections is inseparable from various problems, one of which is related to the unprofessionality of the organizers. The obstacles faced by the KPU in holding elections/local elections are divided into two, namely, the existence of juridical and non- juridical obstacles. Juridical obstacles in elections are related to regulations and non-juridical obstacles related to obstacles faced directly in the field so that in preparation for holding the 2024 elections, the General Election Commission has carried out several stages including the party verification process, here the performance of the General Election Commission has been shaken by several reports that is :  The Ummat Party will file a lawsuit against the Election Supervisory Body (Bawaslu) after the General Elections Commission (KPU) stated that the Ummat Party will not qualify as a participant in the 2024 election.  The general chairman of the Republican Party One Hasnaeni Moein alias 'Golden Woman' reported the General Election Commission (KPU) chairman of the Republic of Indonesia Hasyim Asy'ari to the Election Organizer Ethics Council (DKPP) regarding allegations of sexual harassment. The report was received by DKPP under number 01-22/SET-02/XII/2022 on Thursday (22/12)  The problem of the Political Information System (Sipol) in the 2019 Election repeated itself in the 2024 Simultaneous Election stages. At that time, according to him, Sipol could not read the duplication of data which caused problems with the data that had been entered by election participants, even the Sipol server was down so that it could not accessed.
