The recent ruling by the Supreme Court declaring a
portion of the Defense of Marriage Act (DOMA)
unconstitutional raised questions for employers in the
context of their benefit programs and tax reporting.
What should employers do with respect to the tax
treatment and reporting of benefits for same-sex
spouses? Would the state of residence apply, or would
there be another standard? How would the ruling
affect other aspects of employers’ benefits or policies,
such as Family and Medical Leave? Recent guidance
from the Treasury Department and the Department of
Labor has provided some assistance around these
issues. However, the guidance is not necessarily
leading to the same conclusions, and open questions
remain.
The Willis National Legal and Research Group will
explore the guidance and help you determine the
critical elements, the implications, and any action
employers need to take to comply with the DOMA
ruling.
