Licences and rights
Liability?
8. Limitation of Liability. In no event and under no legal theory, whether in tort (including negligence), contract, or otherwise, unless required by
applicable law (such as deliberate and grossly negligent acts) or agreed to in writing, shall any Contributor be liable to You for damages, including
any direct, indirect, special, incidental, or consequential damages of any character arising as a result of this License or out of the use or inability to
use the Work (including but not limited to damages for loss of goodwill, work stoppage, computer failure or malfunction, or any and all other
commercial damages or losses), even if such Contributor has been advised of the possibility of such damages.
1. LIMITATION ON AND EXCLUSION OF REMEDIES AND DAMAGES. YOU CAN RECOVER FROM MICROSOFT AND ITS SUPPLIERS
ONLY DIRECT DAMAGES UP TO U.S. $5.00. YOU CANNOT RECOVER ANY OTHER DAMAGES, INCLUDING CONSEQUENTIAL, LOST
PROFITS, SPECIAL, INDIRECT OR INCIDENTAL DAMAGES.
2. This limitation applies to
○ anything related to the software, services, content (including code) on third party Internet sites, or third party programs; and
○ claims for breach of contract, breach of warranty, guarantee or condition, strict liability, negligence, or other tort to the extent permitted by
applicable law.
3. It also applies even if Microsoft knew or should have known about the possibility of the damages. The above limitation or exclusion may not
apply to you because your country may not allow the exclusion or limitation of incidental, consequential or other damages. If your local law
allows you to recover other damages from Microsoft even though we do not, you cannot recover more than $5.00 USD, or the amount you paid
for the software, whichever is higher.
