Conditions (T&C) of a service used by

3. Here’s a quick background check on Instagram…
• ‘Instagram is an online photo-sharing, video-sharing and social
networking service.’
• Created by Kevin Systrom and Mike Krieger in 2010.
• 100 million active users in 2012.
• Bought out by Facebook in April 2012 for 1 Billion dollars in cash and
stock… Yes, with a ‘B’.
(Stern, 2012)
(Frommer, 2010)
4. Now, back to the important stuff... Your personal contract with Instagram.
5. Upon registering for Instagram, some of you may
notice the Terms and Conditions of use for the
service…
Now, normally one would just click
‘accept’ and be done with it..
6. But have you ever stopped and thought, ‘How do the T’s and C’s affect me?’
8. The Terms and Conditions you ‘accept’ can affect you
in a number of very important, and diverse ways.
Such as;
Your Privacy,
Your Content,
Your Use,
Your Rights,
And the do’s and don’t’s surrounding the service.
…just to name a few.
9. These Terms and Conditions applies to ‘all
visitors, users, and others who access the
Service’ (Instagram, 2013)
So it’s best to know exactly what
you’re up against…
10. Firstly, upon agreement of T’s and C’s;
‘Instagram does not claim ownership of any Content that you post on
or through the Service.’ (Instagram, 2013)
Instead,
‘You hereby grant to Instagram a non-exclusive, fully paid and royaltyfree, transferable, sub-licensable, worldwide license to use the Content
that you post on or through the Service.’ (Instagram, 2013)
11. This means that,
Instagram, although doesn’t own or claim
ownership of your content, has the right to store
and use your content which has been uploaded as
they see fit.
The content is generally used for, but not limited
to;
• Promotions,
• Advertising,
• Commercial use.
12. The conditions also state that;
‘You are solely responsible for your conduct
and any data, text, files, information,
usernames, images, graphics, photos,
profiles, audio and video clips, sounds,
musical works, works of authorship,
applications, links and other content or
materials (collectively, "Content") that you
submit, post or display on or via the Service.’
(Instagram, 2013)
13. So it is you, and only you
that must undertake the
complete responsibility to
manage your own
conduct, presentation
and all content uploaded
to the service
[Instagram].
‘Instagram is not responsible or
liable for the conduct of any
user.’ (instagram, 2013)

14. Instagram also state that, in a bid to protect the other millions of users, and
your individual self;
‘You may not post violent, nude, partially nude, discriminatory, unlawful,
infringing, hateful, pornographic or sexually suggestive photos or other
content via the Service.’ (instagram, 2013)
AND,
‘You must not defame, stalk, bully, abuse, harass, threaten, impersonate
or intimidate people or entities and you must not post private or
confidential information via the Service.’ (Instagram, 2013)
15. Along with Instagram’s further term,
‘You may not use the Service for any illegal or unauthorized purpose. You
agree to comply with all laws, rules and regulations (for example, federal,
state, local and provincial) applicable to your use of the Service and your
Content (defined below), including but not limited to, copyright laws.’
(Instagram, 2013)
Is a protection ploy that will help keep Instagram a
safe place for all users, and help protect each
individual from dangerous or illegal content.
16. It is these rules and codes of conduct that makes Instagram the great, friendly and
safe environment it is today…

17. ‘We may, but have no obligation to, remove,
edit, block, and/or monitor Content or
accounts containing Content that we
determine in our sole discretion violates
these Terms of Use.’ (Instagram, 2013)
‘We reserve the right to refuse
access to the Service to
anyone for any reason at any
time.’ (instagram, 2013)
Failure to comply with these terms and
conditions may result in termination of your
account.
‘We reserve the right to modify or terminate the Service or your
access to the Service for any reason, without notice, at any time, and
without liability to you.’ (Instagram, 2013)
18. Basically, If you don’t do anything bad, you
wont get terminated from the service.
19. Your privacy is next..
Instagram collect and store all information you provide on
the server, they use your information for marketing,
promotional and analytical purposes.
All information, such as photos, videos, comments, names,
phone numbers, or other material you provide is collected
and stored by Instagram in any area that Instagram is
based.
20. Instagram also track user movements over the service.
Instagram implement cookies, and similar technologies such as pixels, web
beacons, and local storage to collect and track information on ‘how’ you
use Instagram. (Instagram, 2013)
21. Although, debatable, this might seem as an violation of your basic privacy
rights, and morals.
BUT,
If you did agree to these terms and conditions, and claim a violation of
privacy… You will have no argument.
22. But don’t fret… This information is only used for analytical and
promotional purposes… Well, as far as we know…
If you still do not like or cannot handle the thought of your
movements being tracked over the service, you best have
another think about your usage of Instagram.
23. Instagram have these Terms and Conditions of usage for all active users,
visitors and members to abide by, it is these Terms and Conditions that
protect the company itself, and all of its millions of users, worldwide.
If you do not agree to these terms and condition, you can opt-out at
anytime, freely and the entire contract made with Instagram will cease
immediately. (Instagram, 2013)
24. So, in everyone's best interest….
Reading the Terms and Conditions = Knowing your rights and
responsibilities.
Thank you for watching.
