AKTA 174
      Iaitu Akta Institusi-Institusi Pelajaran (Tatatertib) 1976.

      Memperuntukkan perkara-perkara yang berkaitan dengan tatatertib pelajar dalam institusi-
       institusi pelajaran iaitu Maktab Perguruan, Politeknik dan Kolej Matrikulasi seluruh Malaysia
       (Jadual I, Akta 174).

      Mula dilaksanakan pada Januari 1998.

      TAFSIRAN

Ketua Eksekutif

      Membawa maksud Pengarah Institusi yang bertugas sebagai eksekutif utama

      TAFSIRAN

Pegawai Hal Ehwal Pelajar

      Membawa maksud Pengarah yang ditetapkan oleh Menteri Pendidikan yang berkuasa
       mengambil apa-apa tindakan tatatertib dan mengenakan hukuman tatatertib kepada pelajar di
       bawah Jadual Kedua Akta 174.

      TAFSIRAN

Pihak Berkuasa Tatatertib

      Membawa maksud Pengarah Institusi atau mana-mana kakitangan Institusi atau lembaga yang
       ditubuhkan yang diwakilkan kuasa secara bertulis oleh Pengarah mengambil apa-apa tindakan
       tatatertib dan mengenakan hukuman tatatertib kepada pelajar di bawah Jadual Kedua Akta 174.
       (Pegawai Hal Ehwal Pelajar mempunyai kuasa untuk menyemak, membatal atau mengubah apa-
       apa keputusan kakitangan / lembaga).

      Dalam Jadual 2 Akta 174, iaitu Kaedah-Kaedah Institusi Pelajaran (Tatatertib Pelajar-Pelajar)
       1976, antara lain memperuntukkan:

1.       Tatatertib Am (Kaedah 3 – 26)

         (Mengandungi Perintah-Perintah dan Larangan-Larangan)

                  Contoh:

                         Kaedah 4: Kehadiran di kuliah

                         Kaedah 5: Menduduki peperiksaan
2. Tatatertib Asrama (Kaedah 27 – 34)

     3. Tatatertib Lalulintas (Kaedah 35 – 47)

     4. Acara Tatatertib (Kaedah 48 – 66)

Contoh:

        Kaedah 48: Hukuman Tatatertib

Pelajar yang bersalah boleh dijatuhkan mana-mana satu atau gabungan

dua atau lebih hukuman berikut:

            a) Amaran;

            b) denda tidak lebih daripada lima ratus ringgit;

            c) penggantungan daripada menggunakan apa-apa atau kesemua kemudahan Istitusi
               selama tempoh yang ditentukan;

            d) penggantungan daripada mengikuti kursus pengajian di Institusi selama tempoh yang
               ditentukan;

            e) penghalangan daripada menduduki sebahagian atau keseluruhan peperiksaan di
               Institusi;

            f)   penyingkiran daripada mana-mana bahagian Institusi selama tempoh yang
                 ditentukan;

            g) pembuangan daripada Institusi.

5.      Rayuan-Rayuan (Kaedah 67 – 70)

Rayuan secara bertulis boleh dibuat oleh pelajar kepada Menteri Pendidikan dalam tempoh 14 hari
melalui Pegawai Hal Ehwal Pelajar (Pengarah) sama ada:

          a) terhadap sabit kesalahan tatertib, atau

          b) terhadap hukuman yang dijatuhkan, atau

           c) kedua-dua (a) atau (b) di atas.
PROSES MENGAMBIL TINDAKAN TATATERTIB
 PERINGKAT I       - Menerima aduan dan laporan

 PERINGKAT II - Memaklumkan kepada PBT

       –   kalau ada kredibiliti, buka fail (action file) atas nama pelajar,

           ATAU

       –   atas nama kes atau kesalahan      (jika pelajar tidak dikenalpasti)

 PERINGKAT III - Siasatan

       –   PBT arah unit HEP untuk dapatkan bukti yang mencukup

                  ambil bukti

                  ambil gambar jika perlu

 PERINGKAT IV - Laporan siasatan

       –   diteliti oleh pegawai lain (biasanya pegawai penyelia kepada pegawai penyiasat)

       –   jika tidak berasas, tutup kes. Simpan fail sebagai rekod.

       –   Jika bukti cukup, fail dihantar kepada PBT untuk diteliti.

 PERINGKAT V - Keputusan PBT

 sama ada:

 Arahan tutup kes (NFA)- jika tuduhan tidak berasas

 Arahan siasatan lanjut – jika bukti tidak mencukupi

 Arahan tindakan secara pentadbiran sahaja

 Beri nasihat

 Kaunseling

 Tindakan pentadbiran lain

 Arahan supaya dibicarakan

Akta 174

  • 1.
