GOI - in view of lockdown in India due to Covid-19, the validity of licenses granted under The Contract Labour
(R&A) Act, 1970 & The Inter State Migrant Workers(CS&RE) Act, 1979 extended up to 31.05.2020 for those
licenses whose renewal due in the months of March, April and May 2020.

The Central Govt. issued guidelines to pay 24% contribution into EPF accounts of employee for next three months
whose salary is <= to Rs. 15K pm for establishments having up to 100 employees and 90% of their employees
monthly earning is less than Rs.15K pm.

The GOI has enhanced the wage ceiling limit under The Employees Compensation Act 1923, from existing Rs.
8000/ to Rs. 15,000/- per month w.e.f 03.01.2020

9 ESIC has enhanced the dependent parent’s income limit for medical benefit under ESI Scheme from existing Rs.
5000/- to Rs. 9000 from all sources of income.

- The Ministry of Skill Development and Entrepreneurship, GOI has amended The Apprenticeship Rules, 1992.
- As per the said amendment, now the apprenticeship training will be for minimum of 06 months and maximum
of 03 years.
- Establishments having four or more workers shall be eligible to engage apprentices under the Act whereas
the establishments having 30 or more number of workers shall be obligated to engage apprentices.

- The GOI has amended The Employees’ State Insurance (Central) Rules 1950 wherein the existing rates of
employer and employee contribution has been now reduced from 6.5% to 4%.
- The rate of contribution for employers is reduced from 4.75% to 3.25% and employees' contribution is reduced
from 1.75% to 0.75%. The said amendment will be effective from 1st July 2019

Under The Payment of Bonus Act, 1965, employer shall, on or before the 1st February, upload a unified
annual return in prescribed Form D on the web portal of the Central Government in the Ministry of Labour and
Employment giving information as to the particulars specified in respect of the preceding year.

Under Rule 16 of The Maternity Benefit (Mines and Circus) Rules, 1963, employers of every Mines and Circus
shall now online upload a unified annual return in prescribed Form X on the portal of Ministry of Labour &
Employment by providing relevant information to the particulars as provided in respect of preceding year.

- The GOI has amended the BOCW (RE&CS) Central Rules, 1998.
- As per the said amendment, the registration is compulsorily to be filed online on the Shram Suvidha Portal

The Ministry of Labour & Employment has revised the administration charges under Employees Provident
Funds Scheme to 0.50 %. The revised administration charges are effective from 01.06.2018.

The Central Govt, in exercise of powers conferred under Section 4(3) of the Payment of Gratuity Act,
1972, specified that the amount of gratuity payable shall not exceed Rupees Twenty lakh rupees with effect
from 29.03.2019.

- The GOI has amended the schedule under The Industrial Employment (Standing Orders) Act, 1946 wherein
"Fixed Term Employment" has now been introduced irrespective of the industry of work.
- The amendment also directs that no employer shall convert the posts of the permanent workmen existing
in his Industrial establishment as fixed term employment.
The hours of work, wages, allowances shall not be less than permanent workman.

- The Central Government has amended the Employees’ Deposit Linked Insurance Scheme, 1976.
- As per the said amendment - Now, the assurance benefits under the said scheme shall not be less than 02
lakhs and 50 thousand rupees and the assurance benefit shall not exceed six lakhs. The said changes shall be
in force for a period of 02 years from 15.02.2018.
- The Minimum assurance benefit irrespective of the average salary of the deceased employee shall be
awarded at Rs. 2,50,000. This means Rs. 2,50,000 minimum is guaranteed.

EPFO has directed that employers cannot be forced to contribute over and above the wage ceiling in respect of
their employees. However, an option is available for the employees to contribute beyond the statutory wage
ceiling if they want but subject to the conditions as enumerated under the Para 26 (6) of the EPF Scheme,
1952.

The Ministry of Labour and Employment has specified rupees twenty-four thousand per month as the wages
under said sub-section (6) of the Payment of Wages Act, 1936. Earlier it was Rs. 18,000/- PM.

ESIC authorities have directed that the Insured person who went out of coverage ceiling of Rs 15K- but he
subsequently covered under wage ceiling of Rs 21000 w.e.f. 1st January 2017 shall be entitled for the Extended
Sickness Benefits and Super Specialty Treatment for the period of interruption subject to fulfilment of the
eligibility conditions as prescribed under the ESI Rules.

- The Maternity Benefit Amendment Act has increased the maternity leave from the existing 12 weeks to 26 weeks.
- Now benefit under the Act is extending up to a maximum of 8 weeks before the expected delivery date and the
remaining time can be availed after childbirth.
- For women who are having 2 or more surviving children, the duration of paid maternity leave shall be 12 weeks

The said changes shall be in force for a period of 02 years from 15.02.2018. - The Minimum assurance benefit irrespective of the average salary of the deceased employee shall be awarded at Rs. 2,50,000. However, an option is available for the employees to contribute beyond the statutory wage ceiling if they want but subject to the conditions as enumerated under the Para 26 (6) of the EPF Scheme, 1952. https://abcaus.in/wp-content/uploads/2018/01/epfo-direction.pdf Aug-17 21 The Ministry of Labour and Employment has specified rupees twenty-four thousand per month as the wages under said sub-section (6) of the Payment of Wages Act, 1936.
