Unbeknownst to the Representative Plaintiffs and Members of the Putative Class, but known to the Defendants, in 2011 it had already been determined that the P-STIM was not percutaneous placement of a peripheral neurostimulator lead and that the billing and coding instructions being provided by the Defendants were knowingly false. Instead, in April of 2011, the Healthcare Common Procedure Coding System ("HCPCS") released a code, S8930 Electrical stimulation of auricular acupuncture points; each 15 minutes of personal one-on-one contact with the patient. Reimbursement under that code was substantially less.
IHS has taken the position that an appearance by a competitor, whom IHS has sued in separate and now-resolved proceedings before the Centers for Medicare Services in 2014 caused CMS to change its handling of claims relating to the P-STIM and that this change drove IHS out of the P-STIM business.
Despite knowing that the coding instructions they were giving were incorrect, the Defendants concealed that fact and falsely stated that their instructions were appropriate. They did so because the high reimbursement under the codes promoted by them encouraged purchases of P-STIM devices by medical providers.

I. BACKGROUND
1. Plaintiffsand PutativeClassRepresentativesPACIFICSURGICALINSTITUTE
OF PAINMANAGEMENT,INC., a Californiacorporation("SurgeryCenterPlaintiff'') and
SANDIEGOCOMPREHENSIVEPAINMANAGEMENTCENTER,INC., a California
professionalcorporation("MedicalClinicPlaintiff''),bring this action on behalf of themselves
and on behalf of all persons similarlysituated. The class that Plaintiffsseekto representis
composedof surgerycenters,medicalfacilities,physiciansand medicalclinicswho were sold
the P-STIMmedical deviceand givenadviceconcerninghow to bill and collectfor the device
and ancillaryservicesby the Defendants.
2. The P-STIMis a medicaldevicefor administeringautonomicnervous systemand
vascularstimulation. The devicecontainsthree leads implantedby trainedphysicians in the
arterialbundles of the skin of a patient's outer ear. Stimulationis providedby electricalpulses
emittedthroughselectivelypositionedneedles.
3. The devicewas sold and marketedthroughoutthe United Statesby Defendant
InnovativeHealth Solutions,Inc. ("IHS")under a licenseagreementwith the manufacturer,
BieglerGbmH. IHS investedsubstantialsums in advertisingand marketingthe P-STIM
throughoutthe United States,includingon its website, at trade shows,in brochures,in
newsletters,in videos and in on-sitepresentationsat physicianofficesand surgerycenters. IHS
has sold tens of thousandsof P-STIMdevicesthroughoutthe United Statesand touts itself as the
market leader in the industry.
4. As a means of marketingthe P-STIM,the Defendantsconceivedof promotingthe
P-STIMas billableunder a particularset of medicalbilling codes, includingCPT64555,
PercutaneousImplantationofNeurostimulator Electrodesat a PeripheralNerve. This code and
the ancillarycodesbilledwith it coveringfacilityand individualprovider chargesprovided for
between $3,000and $6,000in reimbursementfrom health insurersfor a procedurewith little

associatedcost,takingten minutesto perform. Consequently,withthis type of promotion,the
utilizationof P-STIMskyrocketed.
5. On December19,2012,actingonbehalfof the Defendants,ThomasPalmerat
CoreNexussentinstructionsto the Plaintiffsandothersconcerningbillingfor the P-STIM,that
containedmaterialmisrepresentationsand omissions. A true and correctcopyof the instructions
is attachedheretoas Exhibit"A".
5. On January 12,2013,actingonbehalfof the Defendants,CoreNexushosteda
promotionaleventat the PowaySurgeryCenterlocatedinPoway,Californiafor the purposeof
promotingthe "NIPProcedure(NonInvasivePan Procedure)utilizingthe P-STIMdevice." The
SurgeryCenterPlaintiffandthe MedicalClinicPlaintiffattendedthe event. Atrue and correct
copyof the CoreNexuspromotionalmaterialis attachedheretoas Exhibit"B". Thepromotional
materialslaudedthe procedureas a "greatmedicalalternativeto traditionalpain treatments"and
FDAclearedfora dozenmedicalconditions.Also attendingthe eventwas RickMalywho acted
as a distributoronbehalfof the Defendantsthroughhis company,DefendantMedical
Innovations,LLC,anda physicianlecturerfromthe MicrosurgeryInstituteof Dallas.
6. Becauseof the statementsconcerningreimbursementand efficacy,the Plaintiffs
decidedto purchaseand didpurchasea numberof P-STIMSfor use in theirpatients.
7. On January 16,2013,actingonbehalfof the Defendants,MedicalInnovations
and CoreNexusforwardeda numberof promotionalmaterialsto encouragethe purchaseof the
P-STIMby Plaintiffswhichreiteratedthe instructionson codingmedicalbillingandincludedan
explanationof benefitsformshowingthe paymentof $28,000in connectionwith the use of the
P-STIM. A true andcorrectcopyof the promotionalmaterialsis attachedheretoas Exhibit"C".
8. Unbeknownstto the RepresentativePlaintiffsandMembersof the PutativeClass,
but knownto the Defendants,in 2011it had alreadybeen determinedthat the P-STIMwas not
percutaneousplacementof a peripheralneurostimulatorlead andthat the billingand coding
instructionsbeingprovidedby the Defendantswereknowinglyfalse. Instead,inApril of 2011,

the patient. Reimbursementunder that code was substantiallyless.
9. IHS has taken the positionthat an appearanceby a competitor,whom IHS has
sued in separateand now-resolvedproceedingsbeforethe Centersfor Medicare Servicesin 2014
caused CMSto changeits handlingof claimsrelatingto the P-STIM and that this changedrove
IHS out of the P-STIMbusiness.
10. Despiteknowingthat the codinginstructionsthey were givingwere incorrect,the
Defendantsconcealedthat fact and falselystatedthat their instructionswere appropriate. They
did so becausethe high reimbursementunder the codespromotedby them encouragedpurchases
of P-STIMdevicesby medicalproviders.
11. On December 12,2014, on behalf of the Defendants,RyanKuhlmanatAcclivity
Medicale-mailedthe SurgeryCenterPlaintiffand falselystated"nothing is changingfrom a
codingperspective."
12. On January6, 2015,on behalf of the Defendants,RyanKuhlmanatAcclivity
Medical,again offeredreassuranceon the matter of the billing instructionsstating: "I also have a
billingresrouceif you need to speakwith someoneelse. She is responsiblefor settingup the
most successfulgroupofASC's that we have. It may be worthpickingher brain."
13. Consistentwith the instructionsand reassurancesgiven to the SurgeryCenter
Plaintiffand the MedicalClinicPlaintiff,eachbilled health insurersfor P-STIMproceduresand
services. Nationwide,between2012 and 2015 millionsof dollarsin P-STIMreimbursementwas
paid by health insurersto medicalproviders.
14. In an abruptabout face, on January7, 2015, on behalf of the Defendants,Ryan
KuhlmanatAcclivityMedical,gave the first indicationthat the billing and coding instructions
may not have been correctwhen he wrote to the SurgeryCenterPlaintiff: "However,I do feel
obligatedto tell you that our legal council [sic] has indicatedthat billingP-STIMwith coding
outsideof CMS' publishedrecommendationwouldbe fraudulentand indefensible,even if you
are using the P-STIMoff label and differentfrom how it was presentedto CMS."
15. On May 10,2016,the Defendantsrepresentativestatedthat there were problems
gettingsecondor third placementsof the P-STIMpaid by Medicareand Plaintiffsbegan to

16. On July 20, 2016, followingan investigationby the Plaintiffs,it was determined
that the instructionsgivenby the Defendantsfor billing and codingthe P-STIMwas completely
incorrect. As a result,health insurers,includingMedicarehave soughtreimbursementfor and
are recoupingmore than $2.5 millionfrom the PutativeClass Representativesand hundredsof
millionsof dollarsfrom other similarlysituatedmedicalproviders.
II. JURISDICTION&VENUE
17. This Courthasjurisdictionpursuantto CaliforniaConstitutionArticleVI, section
10,becausethis case is a causenot givenby statuteto othertrial courts.
18. Venueis proper in this Courtbecausethe cause, or somepart of the cause, arises
in LosAngelesCounty.
III. PARTIES
19. DefendantInnovativeHealth Solutions,Inc. is an Indiana corporationwhich at all
relevanttimes herein, was and is engagedin the business of marketing,sellingand distributinga
medicaldevice calledP-STIM,as more fully describedherein, throughoutCaliforniaand the
United States. It may be servedwith process of this Courtupon its registeredagent for serviceof
process,CorporationServiceCompany,135North PennsylvaniaStreet, Suite 1610,Indianapolis,
Indiana 46204.
20. DefendantAcclivityMedical,LLC, is a Kentuckylimitedliabilitycompany
which at all relevanttimes herein,was and is engagedin the business of marketing,selling and
distributinga medicaldevice calledP-STIM,as more fully describedherein and on behalf of
IHS, throughoutCaliforniaand the United States. It may be servedwith process of this Court
upon its registeredagent,RyanKuhlman,456 GlengarryWay,Fort Wright,Kentucky 41011.
21. DefendantCoreNexus,LLC is a Texaslimitedliabilitycompanywhich at all
relevanttimes herein,was and is engagedin the business of marketing,sellingand distributinga

24. Plaintiffsare informedandbelieve,and on such informationandbelief allege,that
each defendantactedin all respectspertinentto this actionas the agent of the otherdefendants,
carriedout ajoint scheme,businessplan or policyin all respectspertinenthereto,andthat the
acts of each defendantare legallyattributableto the otherdefendants.
IV. CLASS ACTION ALLEGATIONS
25. Plaintiffsbringthe claimspresentedhereinon behalf of themselvesand the
PlaintiffClass("Class")pursuantto section382of the CaliforniaCodeof CivilProcedure. The
Classis comprisedof:
All personsand entitieswhopurchasedP-STIMdevicesfromthe
Defendantswith instructionsfromthe Defendantsconcerninghow to bill insurers
andthird partypayors for reimbursementbetweenDecember 1,2012 and July 31,
2016.
26. Numerosity: The membersof the Classare sufficientlynumerousthatjoinder of
all membersis impracticable. Duringoneyear in the classperiod, CPTCode 64555was billed

to Medicaremorethan 11,000timesby 151medicalproviders,resultingin over $14 million in
allowedcharges. Plaintiffsare informedandbelieve, and on that basis allege,that Defendants
soldthousandsof P-STIMdeviceswith instructionsconcerninghow to bill for those devicesto
individualand facilitymedicalprovidersand that more than one hundred of thoseprovidersnow
face recoupmentor other actionby third party payors to recoverthe sumspaid as reimbursement
for P-STIMdevicesand ancillaryservices.
27. Commonality:There are questionsof law and fact commonto the Class that are
answerableon a commonbasis, and these questionspredominateover individualquestions. The
questionsof law and fact commonto the Class include,withoutlimitation:
a. Whetherthe Defendantssold P-STIMdevicesto membersof the Class
with instructionson how to bill for those devicesand related servicesto third party payors and
health insurers;
b. Whetherthe Defendantsknowinglyconveyedfalse information
concerninghow to bill for P-STIMdevicesand related servicesto third party payors and health
msurers;
c. Whetherthe Defendantsprofited and enrichedthemselvesfrom knowingly
conveyingfalse informationconcerninghow to bill for P-STIM devicesand related servicesto
third party payors and health insurers;
d. Whetherthe Defendantsare liableto the ClassMembersfor breach of
contract;
e. Whetherthe Defendantsare liableto the ClassMembersfor negligence;
f. Whetherthe Defendantsare liableto the ClassMembersfor intentional
misrepresentation;

represent,do not have any conflictsof interestwith the putativeClass,willprosecutethe case
vigorouslyon behalf of the Class,andhave alreadydevotedsubstantialtime and resourcesto the
initialinvestigationof these claims. Plaintiffs' attorneysare competentand experiencedin
litigatingcomplexlitigationactionsand are specialistsin the field of health care law.
30. Superiorityof a ClassAction: A classactionis superiorto otheravailable
methodsforthe fair and efficientadjudicationof this controversy. In particular,Plaintiffsare
informedandbelievethat ClassMembersareunablefinanciallyto bring lawsuitsagainstthe
Defendants. Becausehealth insurersare creatingfinancialdistressto the ClassMembersthrough
recoupmentandrecoveryof sumspaid in connectionwithP-STIMservices,Plaintiffsare
informedandbelievethat ClassMembersare largelyunableto pursuetheir claimsseparatelyand
classactiontreatmentwill allowthose similarlysituatedindividualsand entitiesto litigatetheir
claimsin the mannerthat is most efficientand economicalfor the parties andthejudicial system.
Classactiontreatmentwill also avoid inconsistentoutcomesbecausethe sameissuescan be
adjudicatedin the samemannerfor all membersof the Class. Classactiontreatmentwill also
benefitthe Defendantswho will avoida multiplicityof litigationnationwideconcerningthe
claimsmade herein.
V. DAMAGES& RESTITUTION
31. As a direct,foreseeable,and proximateresult of Defendants'conduct,Plaintiffs
and similarlysituatedindividualand facilitymedicalprovidersare owed compensationfor the
sumsexpendedin purchasingthe P-STIMSandthe sumsfor whichrecoveryhas been had and

VI. CAUSESOFACTION

FIRSTCAUSEOFACTION
BREACHOFCONTRACT

Civil Code section 1549provides:"A contractis an agreementto do or not to do a
certainthing." Courtshave definedthe term as follows:"A contractis a voluntaryand lawful
agreement,by competentparties, for a goodconsideration,to do or not to do a specifiedthing."
Robinsonv.Magee,9 Cal. 81, 83 (1858).
33. The agreementbetweenthe Plaintiffsand the PutativeClassMemberson the one
hand and the Defendantson the otherwas that the formerwouldpurchaseP-Stimsthat couldbe
billed and collectedat a particularreimbursementlevel. In purchasingP-Stims from the
Defendants,the Plaintiffsand the PutativeClassMembersrelied on the representationsfrom the
Defendantsconcerningreimbursementin agreeingto purchaseP-STIM devices. The Plaintiffs
and the Putative ClassMembersfulfilledall of their obligationsunder the terms of the P-STIM
purchaseagreements.
34. The Defendantsbreachedthe purchaseagreementswith the Plaintiffsand the
PutativeClassMembersbecausethe former soldP-STIMdevicesthat could not be billed as the
Defendantshad represented.
35. As a direct andproximateconsequenceof Defendants' foregoingbreach of the
allegedcontracts,Plaintiffsand PutativeClassMembershave sustainedgeneral,special,and
consequentialdamagesin an amountpresentlyunknown. Plaintiffswill establishthe precise
amountof damagesat trial, accordingto proof.

36. When Plaintiffs sold P-STIM devices to the Plaintiffs and Putative Class
Members, the Plaintiffs represented that the P-STIM was billable in a particular way and at a
particular rate to third party payors and health insurers. The Plaintiffs knew or, in the exercise of
reasonable diligence, should have known that their representations were incorrect and false. The
Plaintiffs and the Putative Class Members, owing to Plaintiffs' superior position (having obtained
FDA approval and having direct dealings the Medicare and other third party payors in connection
with P-STIM reimbursement), reasonably relied upon the representations,promises and
instructions given to them by the Defendants concerning billing and collections in connection
with P-STIM devices.
37. The Defendants owed Plaintiffs and the Putative Class Members a duty to provide
them with accurate instructions concerning billing and collections in connection with P-STIM
devices or to refrain from giving any billing instructions at all.
38. The Defendants breached this duty to the Plaintiffs and the Putative Class
Members by providing materially false instructions and information concerning billing and
collections.
39. As a direct and proximate consequence of this breach, the Plaintiffs and the
Putative Class Members suffered damages in an amount to be determined at trial.

59. Section 17200 of the California Business & Professions Code ("UCL") prohibits
unfair competition in the form of any unlawful, unfair, or fraudulent business act or practice.
60. Section 17204 of the California Business & Professions Code allows "any person
acting for the interests of itself, its members or the general public" to prosecute a civil action for
violation of the UCL.
61. Beginning at an exact date unknown to Plaintiffs, but at least since on or about
December 2012, Defendants have improperly, fraudulently, and unlawfully provided false and
inaccurate billing and coding instruction and attributed false and inaccurate reimbursement
concerning the P-STIM and have thereby committed unlawful, unfair, and/or fraudulent business
acts and practices as defined by section I7200 of the California Business & Professions Code as
alleged herein. Without limiting the foregoing, the Defendants have engaged in false advertising
as defined by section 17500 of the California Business & Professions Code;
62. The violations of these laws serve as unlawful, unfair, and/or fraudulent predicate
acts and practices for purposes of section 17200 of the California Business & Professions Code.
63. As a result of the aforementioned actions, Plaintiffs and the Putative Class
Members have lost and continue to lose money or property and suffered and continue to suffer
injury in fact, including the sums paid for the purchase of P-STIMS.
64. Plaintiffs and the Putative Class Members are entitled to restitution for all sums
received by the Defendants in connection with their sale of the P-STIM, and interest since four
years prior to the filing of this complaint.
65. Plaintiffs and the Putative Class Members are entitled to: (a) restitution of money
acquired by Defendants by means of their unfair business practices, in amounts not yet
ascertained but to be ascertained at trial; (b) a declaration that Defendants' business practices are
unfair within the meaning of the statute, (c) a permanent injunction to prohibit Defendants from

changesin arterialpressureand heartrateinducedby standingor passivetilt. Typically,
thetiltshouldbeheadupat least60degreesforat least5-10minutes.
So to bill the 95922, documentationmust show vasomotoradrenergicinnervation(sympathetic
adrenergicfunction)testinginduding beat-to-beatblood pressureand R-R intervalchangesduring

INDICATIONS:
The patient is __ year old _male /_female with intractable chronic pain
syndrome. The patient has failed all conservative treatments and has elected to
proceed with operative treatment Allrisks, benefits, alternatives and complications
have been thoroughly discussed with the patient, and the patient has acknowledged
understanding of what has been discussed ..
PROCEDURE:
The patient has been brought to the operating room and positioned supine on the
operative table. Allbony prominences were well padded. Surgical field was
prepped and draped in usual sterile fashion.
The neurostimulator was as~embled on the operative table. The multi-point stylus
was placed on the three leads to confirm the activation of the device. Then the three
leads were attached to the three microelectodes percutaneous implantation.
Then, left/ right auricular region was mapped for intraoperative programming.
Multi-point stylus was used to identify three maximum electrical stimulation to
identify three peripheral vagal, sympathetic, cranial nerve and trigeminal nerve

endings in the auricular region. Three nerve endings were carefully mapped and
then sterile pen was used to mark the sites.
The Tacgel was applied behind the auricular region as well as the circumference of
the mapped sites. Then the percutaneous neurostimulator motor unit was carefully
place behind the auricular region. The microelectrodes were then carefully
implanted on the marked sites. The neurostimulator/PSTIM device was analyzed
using HRVgraphing. Then, the microelectrodes were secured with a tape. Then, the
implant was protected with tagaderm.
Post-operative care instruction was discussed with the patient Patient confirmed
the activation ofthe percutaneous peripheral neurostimulator.
The patient tolerated the procedure well, and there was no complication during the
case.
