Division of Liquor Control 
 Responsible for controlling the manufacture, 
distribution, and sale of all alcoholic beverages in Ohio. 
 The Division is the State’s sole purchaser & distributor 
of spirituous liquor. 
 Process the issuance and renewal of over 24,000 
permits - including manufacturers, distributors, and 
retailers. 
 Spirituous liquor is sold through over 450 liquor 
agencies (private businesses contracted with the 
Division).

Ohio Investigative Unit 
 Enforcement of Ohio’s liquor laws and 
regulations at licensed and non-licensed 
locations. 
 Investigation of USDA SNAP Program (Food 
Stamp) violations. 
 Investigating tobacco sales violations.

Attorney General’s Office 
Liquor Unit 
 Responsible for the prosecution of all 
violations/citations before the Liquor Control 
Commission. 
 Schedules all hearings before the Commission. 
 Represents the Division of Liquor Control on any 
appeals of division decisions before the LCC. 
 Represents the Commission on any appeals of 
commission decisions through the court system.

Ohio Liquor Control 
Commission 
 A neutral and independent agency comprised of three 
members appointed by the Governor. 
 The Commission hears citation cases concerning 
alleged violations of Ohio’s liquor laws and rules. 
 The Commission considers the merits of each case and 
has the authority to suspend or revoke the liquor permit 
if it finds the permit holder guilty. They can also impose 
a monetary fine in lieu of suspension and /or revocation. 
In addition, the commission hears appeals. 
 The commission has general policy-making powers 
regarding production, sales, advertising, etc.

Division of Liquor Control  Responsible for controlling the manufacture, distribution, and sale of all alcoholic beverages in Ohio.  The Division is the State’s sole purchaser & distributor of spirituous liquor.  Process the issuance and renewal of over 24,000 permits - including manufacturers, distributors, and retailers.  Spirituous liquor is sold through over 450 liquor agencies (private businesses contracted with the Division). 7
  • 8. Ohio Investigative Unit  Enforcement of Ohio’s liquor laws and regulations at licensed and non-licensed locations.  Investigation of USDA SNAP Program (Food Stamp) violations.  Investigating tobacco sales violations. 8

Attorney General’s Office Liquor Unit  Responsible for the prosecution of all violations/citations before the Liquor Control Commission.  Schedules all hearings before the Commission.  Represents the Division of Liquor Control on any appeals of division decisions before the LCC.  Represents the Commission on any appeals of commission decisions through the court system. 9

Ohio Liquor Control Commission  A neutral and independent agency comprised of three members appointed by the Governor.  The Commission hears citation cases concerning alleged violations of Ohio’s liquor laws and rules.  The Commission considers the merits of each case and has the authority to suspend or revoke the liquor permit if it finds the permit holder guilty. They can also impose a monetary fine in lieu of suspension and /or revocation. In addition, the commission hears appeals.  The commission has general policy-making powers regarding production, sales, advertising, etc. 10

I am Bren Cueni, Manager, Member Services with the Ohio Restaurant Association It’s my pleasure to welcome you to “Serving Alcohol Responsibly to Your Guests”.   As you may know the ORA Restaurant Education Series (RES) provides members free access to educational events that help them sustain and grow their businesses and are developed based on member feedback. RES events support a key ORA initiative: the education of our members. The Viewer Window on the left, which allows you to see everything the presenters, will share on his screen, And the Control Panel at the right. Within that Control Panel is how you can participate in today’s event, so let’s look at that.

Our first speaker is Eric Wolf Enforcement Commander Eric Wolf is a nineteen year veteran of the Ohio Investigative Unit.  During that time, he has served as an Enforcement Agent, Sober Truth Instructor, Evidence Officer, Food Stamp Agent, Training Coordinator, and Agent in Charge of Administration.  Commander Wolf currently supervises the operations of the three northern districts of OIU – Toledo, Cleveland, and Canton.  He is a graduate of the Northwestern University School of Police Staff and Command and has earned a Bachelor of Science degree in forensic accounting from Franklin University.
  6. Gary Gillet is our next speaker Gary received my undergraduate degree from Vanderbilt University, and my JD from The Ohio State University Law School. He has been practicing for 29 years. He has worked at several law firms over a period of 25 years before opening his own practice in 2010 in downtown Columbus. The focus of his practice has been on assisting businesses that have liquor permits; including restaurants, bars and convenience stores. Gary has represented parties in the purchase and sale of businesses, liquor licensing and renewal matters, sales tax and audit matters, and liquor citations. His practice has also involved handling many different types of business matters including formation of businesses, and review and drafting of leases. He have also represented my clients in a variety of commercial litigation matters. Gary is a member of the Ohio Restaurant Association and the Ohio Business Brokers Association. He has been admitted to the Ohio Bar and the Bar for the U.S. District Court for the Southern District of Ohio.
  7. Our next speaker is Brad Toft Brad is a Restaurant Insurance Specialist from Kinker-Eveleigh Insurance in Cincinnati, OH. He has been an Independent Agent since 1992 and has specialized in covering restaurants since 2008. He is ServSafe Alcohol certified and enjoys working with the Ohio Restaurant Association in various capacities including membership development and writing articles for a’ la carte magazine

Our last speaker is Shellie O’Toole Shellie has been Managing Director, Member Services for Ohio Restaurant Association since April 2007   As Managing Director, Member Services of the Ohio Restaurant Association, Shellie leads the sales and service effort for Ohio’s largest trade association for the food service industry   Her primary responsibilities include developing and implementing strategic member recruitment and retention plans; and leading the sales and marketing effort for ORA products, including ServSafe food safety and alcohol safety training products.   Shellie has devoted more than 25 years of her professional career to the hospitality industry, most recently leading the convention sales and services effort for Experience Columbus.  O’Toole is a member of the Council of State Restaurant Associations, the Ohio Society of Association Executives and the American Society of Association Executives.   She is a native of Ohio, has an associate of applied business, culinary arts degree and an associate of applied business, foodservice management degree from Hocking College.  O’Toole is also a Certified Association Sales Executive (CASE.)

  13. The classroom session can be taught in 2 hour increments, of 2-4-or 6 hours, depending on the level of interaction and review you prefer. The online version takes 90 minutes to 2 hours. And once you purchase it, you have 90 days to complete it, so you don’t have to rush through it in a few days. The primary exam has 40 questions And the advanced exam, for those who want to be a ServSafe instructor, has 70 questions and must be proctored. You’ll get a 3 year national certificate once you’ve passed the exam.

Q: What is the score required to pass? A: A passing score for the ServSafe Alcohol Primary Exam is 75%.  This is obtained by answering at least 30 out of 40 questions correctly. A passing score for the ServSafe Alcohol Advanced, Proctored Exam (if you want to be an instructor) is 80% or higher.   Q: Will I have a better chance of passing the online class or in person? A: Classroom and online passing rates show no variance. Q: How can I know someone is intoxicated? What are signs to look for? Q: How do I handle an intoxicated individual?
