  4. 5 Simple E-­‐2 Visa Requirements Below are some key requirements you must fulfill when applying for an E-­‐2 Visa. For each requirement I have listed a few examples of types of evidence that you will need to submit so you can meet the requirements to participate the E-­‐2 Visa program. In either scenario, the trick is, you need to prove you have enough money to buy or start a business. The amount of money you need to prove depends on your basic living requirements. In another words, the business you buy needs to make you enough money for it to support you and you family. Requirement 2 -­‐ Your investment must be in a real business. What I mean by a real business is one that is a real, active, and makes money. You cannot invest in some sort of “shell” business. It must be real, operational and it must be making money. Again, the business must earn enough money to support you and your family. It MUST be an operational business. Investing in an apartment building, land, or anything other type of real estate does not qualify, unless the real estate is part of the operating business.
  5. How Much Money Do You Need To Get Started? E-­‐2 Visas can be accomplished with as little at $50,000 . EB-­‐5 Visas require a minimum investment of $500,000. The business must be making money: You must prove the business you are buying will produce more than a minimal living for you and your family. Financial Statements, Payroll Summaries, and the like are ample proof. Requirement 3 -­‐ You must be in possession of the funds you will invest and the funds must be committed to your business. Liquid funds that are available to you. The funds must be your own, and you need to prove it. Proof of funds can be any of the following: • Canceled money orders and/or checks • Corresponding personal and/or business bank statements • Itemized list of goods and materials you are buying • Corresponding financial accounting documentation • Lease agreement

You must show a clear and legitimate path regarding the source of the capital you will be investing. You must also demonstrate that the money you are investing has not been obtained through criminal means. How do you demonstrate where the money came from? • Wire transfers, money orders, and/or canceled checks • Foreign and domestic bank statements • Foreign tax returns • Pay records • Property records • Loan and/or mortgage agreements Requirement 5 -­‐ You must be coming to the United States to develop and run the business. You must prove ownership of at least 50 percent of the business. Don’t think you can buy 51% of a business and not be involved -­‐ it won't work that way. (That would put you at risk of losing your entire investment and being expelled from the country.) You need to work in the business one fashion or another.
