You can “search patents” on the Internet, but you can’t
“do a patent search!”
To “do a patent search” is to legally determine the
“patentability” of a given invention
Internet searchers can’t search back far enough or
examine all public-domain ‘prior art’
Can’t search the full-text of all US or foreign patents
Internet sites are less authoritative, less reliable; many
have disappeared in time
6. How Can We Determine the
Right Classification Number?
Use the Manual of Classification and other USPTO
classification tools
Search by keyword, company, or inventor in USPTO Web
Patent Database for related inventions, and look at the
classifications for those patents you think are similar to your
idea (the “fishing” technique)
Find similar, patented products in the marketplace, and look
up their classification numbers
Submit a Field of Search request form to USPTO and wait
for results to be mailed back (7 - 10 days)
Consult a patent attorney or agent

Begin with this alphabetical subject index to
the Manual of Classification. Look up
common terms describing the invention and
its function, effect, end-product, structure,
and use. Note suggested class and subclass
numbers.

Implementing a Patent Search Strategy
Since “helmets” might be what we’re looking for, we’re going to begin by examining the Manual of Classification in Class 2, Apparel, starting with subclass 410 and the following subclasses (indicated by the plus signs to the right).
Scan main line subclasses in Class 2 - capitalized letters, looking for most appropriate subclass: Guards and Protectors.
Examine the one-dot indents available under 455, “GUARDS AND PROTECTORS.”
Now let’s collapse all of the one-dot indents from 456 through 2.5, and show just the two-dot indented subclasses available under 410, “for wearers’ head..”
We pick subclass 424 - “and face” - as being appropriate for the technology we’re looking for.
If we remove all the indents that are not related to our invention, we see the hierarchy of classification for our invention, a type of motorcycle helmet.
Paragraph 2 = “fishing technique”
Once we have a possible classification number for our technology, we search by that number in the Patents BIB CD-ROM. This gives us patent abstracts for the most recent three to four years, and patent titles back to 1969. We may also search the USPTO Home Page on the Internet for a patent database with patent abstracts back to 1971. Examining these abstracts and titles will help us decide if we’re in the right classification.
