Dear Sirs,
The Tribunal refers to the Respondent’s application made by letter dated 12 July 2017, opposed by the
Claimants by letter dated 19 July 2019.
By its application, the Respondent requests the Tribunal to order the prompt dissolution of the First,
Second, and Fourth Interim Awards dated 25 January 2012, 16 February 2012 and 7 February 2013
respectively. (The grounds for this application are not the same as the Respondent’s pending application
for the Tribunal’s reconsideration of these Interim Awards which is scheduled for Track III under
Procedural Order No. 23).
The Tribunal requests the Parties to address in writing the following queries arising from the
Respondent’s current application and the Parties’ recent correspondence related to that application.
First, the Claimants are requested to elaborate on their references to enforcement proceedings currently
taking place elsewhere than Canada, Brazil and Argentina (see p. 3 of the Claimants’ letter).
Second, the Respondent is requested to comment on the account provided by the Claimants as a factual
chronology of the progress to date of the enforcement proceedings in Canada, Brazil and Argentina (see
pp. 4-5 of the Claimants’ letter).
Third, the Respondent and the Claimants are requested to address further, insofar as relevant to the
Respondent’s current application, the decision of The Hague Court of Appeal of 18 July 2017, and to
provide copies of that decision in Dutch and, if possible, agreed English translation (see footnote 6 of
the Respondent’s letter; and p. 2 of the Claimants’ letter).
The Parties are invited to respond to these requests as soon as practicable.
