means for the Internet
What is Article 13
Also known as the 'Upload Filter', Article
13 is a section of the recently passed
European Union Directive on Copyright
in the Digital Single Market.
Essentially, the new law dictates that
content hosting websites are
responsible for making sure copyrighted
material isn't being illegally shared on
their platform, rather than copyright
holders.

information society service providers
storing and giving access to large
amounts of works and other subject-
matter uploaded by their users"
A Divisive Policy ?
Article 13 makes websites
accountable for what is on their site,
meaning under this policy sites must
implement mass filtering technology
that prevents copyrighted content
from being uploaded.
Supporters of the law
think its about time that
regulations were put in
place to protect artists
and creators against
unfair use of their
content online.
Previously it has been
the creators' burden to
monitor the web and
report misuse of their
material, often with no
results once reported.
Now, the sites that host
this material will be held
to account.
Opposers believe the
upload filters will not
be able to distinguish
between genuine
infringements and fair
use of copyrighted
content for the
purpose of
commentary, critique,
or parody. This has
lead to fear that Article
13 is a 'slippery slope'
to more drastic
censorship of opinion
online.

A War on Memes ?
Many memes use images
from copyrighted material
(fairly, by purpose of parody).
Copyright filters could prevent
memes from being uploaded
and spread.
The End of Online News ?
Online commentators that
critique film, TV, music and other
copyrighted material are at risk
of their content being incorrectly
removed or banned if they host
their content on sites such as
YouTube.
'Startup' Killer ?
The cost required to implement the
mass filtering technology that this
law requires is extremely high and
time consuming. New sites trying to
enter the market may not have the
resources to comply, leading to a
continued reliance on the
dominating social media empires
already in place.
Why this Matters
With the recent removal of Net Neutrality in the US, and
now the passing of this legislation it is clear that the world
is moving to a more regulated Internet. Although these
policies are sold on the basis of protecting copyright
holders, there is no denying the increase in power given
to governments and big business as a result.
Much of the controversy surrounding Article 13 has not
been opposing the idea that copyright holders reserve
the right to protect their material, but rather highlighting
the issues of shifting the ways the Web operates.
We as members of the Internet population must be
careful not to let our online freedoms be slowly removed
through the quiet introduction of laws that have the
potential to fundamentally alter the Web.
