3. 3 Orphan works directive in the German cultural heritage domain • Europeana Licensing Workshop • Luxembourg • 13. Juni 2013
1) What are the aims of the directive?
• Establish a reliable framework to clarify rights for orphan works
• Legal security
2) What do we need?
• Stability and persistence
• Linked open metadata
• Sustain workflow for data exchange
• Suitable cataloguing systems and common metadata descriptions
• Tools to harmonise metadata
• Enrich metadata (legal information) and tools to manage rights infromation
Initial position: Questions
4. 4 Orphan works directive in the German cultural heritage domain • Europeana Licensing Workshop • Luxembourg • 13. Juni 2013
3) What can DDB and DNB (as project co-ordinator) offer?
• Harmonise and exchange data in EDM as cross-domain aggregator
• Establish persistent links between entities that carry rights-relevant
information
− Aggregation, ProvidedCHO, Web Ressource, Agents, Events, Place, Time
• Provide persistent identifers and resp. services to cultural institutions:
• For works (URN)
• For creators and contributors (URI, German National Authority File), soon:
Integrating publishers (German book traders) in GND
• For digital items (URN)
• Competency network
− Bring together various stakeholders: rights holders, cultural heritage
institutions, collecting societies, metatadata and rights clearing experts

• Distributes echriched metadata: DPMA, cultural institution, Europeana
• DDB publishes:
− web ressource with respective rights mark in portal (DDB Licensing Model)
− link to the registry of due diligent search documentation (DPMA)

13. 13 Orphan works directive in the German cultural heritage domain • Europeana Licensing Workshop • Luxembourg • 13. Juni 2013
• Cultural Institution:
• Makes due diligent search for orphan works:
− Enriches metadata with all necessary information (creators, contributors)
− Researches missing rights-relevant information, documentation
− Submits research results to Clearing Center (DPMA) via Aggregator DDB
• Orphan work or licence agreement with rights holder?
− Digitisation
• Clearing Center (DPMA - Germany):
• Clarifies possible conflicts with (newly identified) rights holders
• Saves rights holders´ interests (patent)

17. 17 Orphan works directive in the German cultural heritage domain • Europeana Licensing Workshop • Luxembourg • 13. Juni 2013
• Meet relevant stakeholders to agree upon workflow for print works
• Define use cases
• Pilot infrastructure (DNB):
– Due diligent search and documentation
– Expand cataloguing and metadata workflow
– Service for unified ID-registry (print works, rights holders)
• Clarify rights modelling and clearing issues:
– Exchange format (EDM)
– Rights Registry at DPMA
– Which contributors for which type of work?
– Distinguish between IPR and usage rights?
• Discuss workflows with other cultural heritage domains
