•What is Compliance?
Consent –Compliance
In simple language, a set of process, standards, or law that is
established to specify the protocol is called compliance
The definition of compliance is “the action of complying with a
command,” or “the state of meeting rules or standards.” In the
corporate world, it's defined as the process of making sure your
company and employees follow all laws, regulations, standards,
and ethical practices that apply to your organization
It is a Package of Events related to Conformity and assurance of
Human Right, Legal Rights, Health & Hygiene, Safety, Welfare &
Freedom of Association of an employee within the organization or
the business.

are having many demands in their rights & privileges
in their working place within the particular time
period, occasion & in the various intervals of their
work.
Compliance confirms all these issues to get good
production for the enterprise, maintains good &
healthy inter personal relations within management
& employs and excellent working environment.
On the other hand, in ISO terms “Compliance to
regulations, Compare with Conformance”

What is the main purpose of compliance?
The purpose of compliance is to adhere to both internal policies
and procedures, along with governmental laws. By implementing
compliance procedures protects your company's reputational risk
and improves your company's vision and value as well prevent and
detect violations of rules.
It is simply the minimal code of conduct that guides the business
in regards to how its workers and environment should be treated,
in regards to the employee wages, working hours, conditions, and
environmental laws.
Social compliance basically intends to protect both labor and
environment interests.

What is the importance of compliance in textile and Garment
industry?
Providing safe factory working conditions reduces a factory's
staff turnover because the workers enjoy the organization they
work for which inevitably leads to higher productivity,
commitment, and performance.
There are some importance of compliances in
our garments sector. They can be described as below:
Sustainability of existing buyers
Attracting new buyers
Matching the Government requirement
Securing benefits of the workers
Preserving good relationship among workers and management
Environmental safety
Social accountability

History of evolving compliance issue in RMG:
First, in 1995 Pwc India office came to Bangladesh to do a social
audit for Walmart.
Then in 1996, during the European nations cup, several trade unions
and NGOs drew attention to the forced labor of children making
footballs for the world market. Due to this publicity world-famous
retailers focused their eyes on the Bangladesh garments industry
to monitor compliance issues especially on child labor and minimum
wages.
After that in 1996, An agreement was signed among ILO,
BGMEA, and Bangladesh Government to work together to work on the
labor rights issue. From 1998, the Pwc India office continued social
audit for Walmart, Jones Apparel Group, Target, Aramark, Russel
Inc., Lego Company, Timberland, Sara-Lee Corporation,
Abercrombie & Fitch, etc.

Of Compliance
In Bangladesh Garment Sector
Since, 2005 the quota free system started in the RMG industry
and at the same time international buyers are pressurizing on the
issue of compliance. Before placing the orders at the factory
buyers are auditing the factories to assess the labour standards
and meeting whether or not they are employment conditions,
working conditions, occupational safety and health, industrial
relation and management systems exactly to the words
There is no fundamental difference between and among the code
of conducts of various brands. All these codes lend themselves to,
in one way or another, the ILO declaration on fundamental
principles and rights at work and the requirements lead down in
the national law.

To be regarded as a compliant one, a garment industry generally is
demanded the application and fulfillment of he country laws and
regulations, international laws, ILO conventions being ratified by
the government, the buyers requirements and international best
practices. It is said that 85% of the requirements or code of conduct
of all buyers are being fulfilled of the country’s laws and ILO
conventions being ratified by the government are applied or executed
fully. So the emerging and considering points are as follows:

BKMEA-Save the Children CSR initiative:
BKMEA has worked with the ‘Save the Children (Sweden-
Denmark)’ on a joint initiative titled “Corporate Social
Responsibility & Child Labour”. To make acquainted all the
stakeholders with this approach, a conference was held in
Copenhagen, Denmark on 12 December, 2006. The conference was
on “Responsible Approaches to Child Labor in Textile and
Garments Production Walking Together for a Win-Win Situation’.
Mr. Md. Fazlul Hoque, President, BKMEA participated the
conference and presented a paper on “Corporate Social
Responsibility to Workers in the Knitwear Manufacturers &
Exporters Units in Bangladesh”. Renowned buyers like H&M, MFA
Forum, Amnesty International and different international
organizations participated in the conference.

The Copenhagen conference was a follow-up of the
awareness raising seminar on “Corporate Social
Responsibility & Child Labour” organized in Dhaka on
September 16, 2006. It was jointly by Save the
Children (Sweden-Denmark), BKMEA and Danish
Federation of Small and Medium Sized Enterprise. The
awareness raising seminar was participated by H.E. Mr.
Einar Hebogard Jenson, Ambassador, Royal Danish
Embassy and H. E. Ms. Britt Falkman Hagstrom,
Ambassador, Swedish Embassy in Bangladesh, Mr. Olof
Risberg, media, Govt. representative, factory owners
and others.

1. Working hours / holiday / rest day: -
 Ensure maximum working hours per day 10 hours with 2 hours
OT.
 Ensure working hours per week maximum 60 hours including OT.
 Average weekly working hours 56 per week in a year
 Make sure one day holiday / rest day in a week.
 No workers working continuously 10 days without one-day break.
 If any worker worked in Friday, given compensatory holiday
within 3 days immediately before or after Friday (weekly
holiday)
 A worker is deprived of any of the weekly holidays given one-day
compensatory holidays within two-month immediately following
of that month.
 If any worker works in a festival holiday, need to given two
additional compensatory holidays with full pay.
2. Attendance Card: -
 Clearly mention in & out time
 Mention Interval time/ Holiday/any kind of leave

 Avoid any hand written in attendance card
 If any mistake, cut by straight one line & put signature.
 Clearly calculation OT hours.
 Don’t keep any blank row in attendance card. Must fill-up –

3. Personal file: -
 Ensure and keep the following documents in personal file.
 Bio-data (must mention present & permanent address, date of
birth).
 Passport sizes and stamp size photographs (2 copy each).
 Age certificate / medial certificate (both external & in house
doctor).
 School certificate / academic certificate
 National Certificate
 Appointment letter.
 Performance appraisal papers (both 3 months & in the case of 6
month).
 Apprentice / probationer period extension (after 3 month)

5. Fire Drill and Fire Training safety Program:
 Fire drill should be conducted at least 4 times in a year
 Key employees should be trained in the proper use of
extinguishers and annual refreshers. Training should be provided
at least 40% of workers
 Factory designated Fire Fighter, Fire rescue Team and First Aider
 Keep up-dated fire drill records.
6. Fire Fighting apparatus and water supply:
a) At least provided and maintained two fire buckets of not less
than two gallons capacity each for every 1000 sft.
b) Fire heat & smoke detector – 1 in each floor.
c) Hose reel with wet riser – 1 in each floor. (Hose – 100 ft.)

d) CO2 extinguisher – 2 for every 1000 sft / ABC dry powder
extinguisher – 2 for every 1000 sft or as determined by the
Director General, Fire.
e) Foam extinguisher
f) Protective clothing (gel type blanket)
g) Fire bell both electrical and manual with battery backup.
h) All fire extinguishers kept within the 25 feet range from both
sides.
i) Fire fighting equipment to be inspected internally on a monthly
basis with written records of inspection kept on or beside the
equipment.
j) Extinguishers should be serviced by an qualified licensed
company an at least an annuals basis
k) Extinguishers should be located in readily visible and designed
areas that are not obstructed.
l) Fire extinguishers location should be clearly marked.
m) Operating instructions for fighting equipment to be mounted on
or beside the equipment in Bengali.

n) The extinguisher seals and temper indictor should not be broken
or missing and extinguishers should be fully charged.
o) Portable fire extinguishers less than 15 kgs to be wall mounted
with top of extinguishers not more than 1.5 meters from floor.
p) Fire fighting equipment locations to be clearly visible in each
section with location sighs unobstructed
q) Fire fighting equipment to have a red keep clear box with
diagonal lines painted on the floor under the equipment.
r) Access to fire fighting equipment to be unobstructed at all times
s) Keep fire training workers name beside extinguisher.
t) Ensure use fire fighting dress, base by the workers.
7. Fire Alarm:
 Automatic devices are sprinkler systems, water flow alarms,
smoke detectors and heat detectors.
 Annual tests should be performed on all smoke and heat
detection devices.
 A fire alarm audible throughout the factory with activation
buttons in each section and a distinctive sound from other

internal systems to be installed. Fire alarm to have battery
backup (both electrical & manual)
 The fire alarm to be inspected internally monthly with written
records of inspection maintained
 Manual alarms consist of pull stations/ boxes that require
manual activation.

10. First Aid Appliances:
a) One first aid box for every 150 workers ordinarily employed in a
factory.
b) Wherein 300 or more workers an employed provided and
maintain one ambulance room or dispensary.
c) The ambulance room or dispensary shall be In-charge of a
qualified medical practitioner assisted by at least one qualified
compounder and nurse.
•One glazed sink with hot and cold water.
•One table with a smooth
•One couch, Two Stretchers, one screen.
•Keep first aid box in the specified area.
•Clearly mark (yellow/ red) place of first aid box.
•Make sure open first aid box in working hours.
•Provide adequate medicine as per law / buyer provided list.
•Keep medicine list beside the box.

11. Latrine/ Toilets Accommodation:
a) At least one latrine for every 25 female workers.
b) At least one latrine for every 25 male workers. Up-to the first
100, thereafter one for every 50 male workers.
•Significantly clean all toilets.
•Ensure water supply in the toilet
•Given sign (male & female) and writing toiler in all main door of
toilet.
•Ensure soap, towel, tissue in toilet

12.Urinal Accommodation:
a) One urinal for every 50 males up-to the first 500 employed,
thereafter one for every 100 male workers.

13.Washing Facilities:
a) Washing basin with taps.
b) For persons whose work involves contact with any injurious or noxious
substances then shall be at least one tap for every 15 persons.
c) For general workers:
Up-to 20 persons - 1 tap
51 – 150 - 4 taps
151 – 200 - 5 taps
Exceeding 200 but not exceeding 500 – 5 plus 1 tap for every 50 persons.
Exceeding 500 – 11 plus 1 tap for every 100 persons

14. Drinking Water: -
Effective arrangement shall be made to provide and maintain at a
suitable point conveniently situated for all workers, employed
therein, a sufficient supply of wholesome drinking water.
Water Jar / point shall not be situated within 20 feet of any
washing place, urinal or latrine.
Ensure available pure drinking water in all floors.
Writing pure drinking water in Bangle and hanging beside the
water tank/jar.
Clearly mention eyewash station.
Every basin clear mention “use water not for drinking”
Ensure one worker use one glass arranged by his or her own.
Ensure water supply in eye wash station.
15. Evacuation Plan: -
•The evacuation plan should includes markings
•Evacuation plan in the local language is posted in each section.
•Evacuation routes in each section are accurately marked on he plan
•Fire extinguisher and fire fighting equipped locations an accurately

•Each plan posted location has “ YOU ARE HERE” point accurately
marked on the plan in the local language.
16. Canteen: -
a) Where in more than 100 workers are ordinarily employed, shall
be provided in the factory an adequate canteen according to the
standard specified.
b) The canteen building shall be situated not less than 50 feet from
latrine, urinal, boiler room and other source of dust / smoke.
17. Dinging Hall:
The dinging hall shall accommodate at least 30 percent of the
workers taking food at a time.
18. Number of Welfare Officer:
Where 500 or more workers are ordinarily employed there shall be
appointed at least one welfare officer and when the number of
workers exceed 2000, one welfare officer shall be appointed every
2000 workers.

19. Rooms for Children / Crèches :-
Wherein more than 40 women workers are ordinarily employed, there
shall be provided and maintained a suitable room or rooms for the use
of children under the age of 6 years of such woman.

20. Lighting: -

22. Passageway/stair: -
• Main Passage way is minimum of 44 inch.
• Sub Passage way are a minimum of 36 inch
• Main passageways are identified with single yellow lines panted on
each side of the passageway and yellow directions arrows painted n
the center of the passageway.
• Sub passageway marked wit yellow direction arrows painted n the
center in the passageway
• Passage to remain unobstructed at al times.
• Stairway are a minimum of 44 inch wide
• The top and bottom of stairs to have a yellow keep clear box with
diagonal lines painted on the floor

23. Chemical Handling & Storage: -
•Make Safety precautions and training for the handling of chemicals,
hazards substances and waster (used solvent, paints, used oil etc)
•Keep instruction (user manual) on safe handling of all chemicals posted
in the factory in local language.
•Chemical & Hazard separated from materials / fabrics & store safely.
•Chemical storage containers to be kept sealed / guarded area.
•Chemicals to be stored in a cool, dry, roofed area well ventilated and
protected from direct sunlight and heat sources.
•Keep materials safety data sheet (MSDS) relating to all chemicals in the
section both Bangle & English.
•All containers containing chemicals to have clear content labels both
Bangla & English.
•Maximum issue of chemicals to production area should be for 1 (one)
day requirements.
•Use different Jar / Mug for different chemicals.

•All chemicals user must follow the using instruction and must use all
chemical protective equipment’s (Gum Boot, Musk, Gloves, Eye
Protection Glass, Apron)
•Check any leakage in container.
•“No Smoking, Eating or drinking” signs to be posted in the chemical
storage area.
•“Use of protective clothing” signs to be posted in the chemical storage
area.
•Keep clean in storage / production area.
•Keep one first aid box in washing section.
•Eye wash station or large bottle of eye washes solution to be provided
in the chemical storage area.
•Sufficient fire extinguishers keep in the storeroom area.

24. Protective Equipment (Machine & Person): -
a) Machinery equipped with safety division
1. Needle guard: - presents workers from placing fingers under
the needle.
2. Finger guards: - present, stitched finger, accidents also acts as a
guide in threading.
3. Plexiglas Shield: - Design to protect the worker from broken
needle, button etc.
4. Pressing machine and irons shield has a guard at the handle that
protects the employee’s hand from potential burn ______
contact or from steam.
5. All flywheel, v-belt guar, pulleys guards and wiring should be
properly attached to the machine and covers.
b) General Safety: -
1. Handling & transportation of raw materials / finished goods.
 Lifting devices should be provided to pick up large rolls of fabric,
transport stacks of cut materials and move boxed ad goods pallets

When motorized forklifts are used the areas of use should be
clearly marked off and caution sign should also be displayed in an
around the area.
2. Warehouse / storage area: - Warehouse / storage area should
properly organized.
Storage racks should be structurally adequate to handle the
total weights anticipated
Combustible raw materials and finished products should be
stored in separate designed areas.
 Storage arrangements should be orderly with even rows and
adequate aisles
Storage areas should be separate from manufacturing or
production areas.

c) PERSONAL PROTECTIVE EQUIPMENT’S & SAFETY EDUCATION:
The safety equipment wears by employees to protect against physical
hazards. Factory should provide written policies, procedure and
practice for wearing, using and maintaining personal protective
equipment.
Eye Wear: - Safety glasses should guard against flying objects,
gloves, liquids, dust etc.
Respirator: - To present the inhalation of hazards airborne
contaminants.
Glove: To protect hands and present cuts, scratches, bruises,
burns and absorption of chemicals.
Foot Protection: - Boots to protect feet against alkaline and
water. The foots should be natural / synthetic rubber or plastic,
resistant to water or specific substances.
Hard Hats: - This shields head against impact from failing,
moving, flying and knocks objects, as well as protection from rain
and other elements.

Wetter Gloves:
Earplugs: - Protects ears against the harmful efforts of noise that exceed
permissible sound level.
Face Mask: This should be used when transporting chemicals.
Stainless Steel (Mesh) Glove: - Protects hand against most knives and
presents cuts and stashes.
Safety Education Materials: - Poster displayed in production floor to
promote safety practices.
d) Protective Equipment’s /Clothing/ Practices: -
 Factory Policy on the use of all-protective equipment and clothing by
managers, supervisors and employee is posted in a visible location in
the local language.
Mesh gloves to be provided for and used by cutters.
Die cutting machines to be set up for 2 handed operation.
Cutting knives and ban knives to be fitted with finger guards.
Dust masks to be provided where necessary.
Protective glasses / goggles to be provided beside each grinding machine.

Grinding / buffing machines to be fitted with correct guards and
operation support.
Protective glasses / goggles to be provided in the mechanics
workshop.
Earplugs to be provided where necessary.
All sewing machinery to be fitted with top and bottom pulley
guards.

protection guards.
Over lock, buttonhole, and button sew, tacking machines to be
fitted with the correct eye protection visors.
Pressing machines to be fitted with emergency release devices.
Tagging guns to be issued to individual users with user name and
employee number permanently attached to each gun.

Spot cleaners using chemicals to be provided with correct masks /
respirators. Toxic chemicals require a Toxic vapor and Acid gases

Back support belts to be provided for employees required lifting
heavy or difficult items.
e) Electrical Equipment’s: -
Electric panels, circuit breakers and switch boxes to be marked
with electricity danger sign.
Switch functionality to be identified in each electric panel, circuit
breaker and switch box.
Electric panels, circuit breakers and switch boxes to have a keep
clear box with diagonal lines painted on the floor under the box.
Access clearance to be 3 feet (92 cms) in front.

be unobstructed at all times.
All openings inside electric panels, circuit breakers and switch boxes
to be covered with faceplates.

functioning doors.

Flexible electric cords and cables to be connected to plugs, switches
and machinery through a strain relief to prevent direct pulling on
the connector.

  • 3. Social Compliance •What is Compliance? Consent –Compliance In simple language, a set of process, standards, or law that is established to specify the protocol is called compliance The definition of compliance is “the action of complying with a command,” or “the state of meeting rules or standards.” In the corporate world, it's defined as the process of making sure your company and employees follow all laws, regulations, standards, and ethical practices that apply to your organization It is a Package of Events related to Conformity and assurance of Human Right, Legal Rights, Health & Hygiene, Safety, Welfare & Freedom of Association of an employee within the organization or the business. 3

They are having many demands in their rights & privileges in their working place within the particular time period, occasion & in the various intervals of their work. Compliance confirms all these issues to get good production for the enterprise, maintains good & healthy inter personal relations within management & employs and excellent working environment. On the other hand, in ISO terms “Compliance to regulations, Compare with Conformance” 4
  • 5. Social Compliance 5 What is the main purpose of compliance? The purpose of compliance is to adhere to both internal policies and procedures, along with governmental laws. By implementing compliance procedures protects your company's reputational risk and improves your company's vision and value as well prevent and detect violations of rules. It is simply the minimal code of conduct that guides the business in regards to how its workers and environment should be treated, in regards to the employee wages, working hours, conditions, and environmental laws. Social compliance basically intends to protect both labor and environment interests.
  • 6. Social Compliance 6 What is the importance of compliance in textile and Garment industry? Providing safe factory working conditions reduces a factory's staff turnover because the workers enjoy the organization they work for which inevitably leads to higher productivity, commitment, and performance. There are some importance of compliances in our garments sector. They can be described as below: Sustainability of existing buyers Attracting new buyers Matching the Government requirement Securing benefits of the workers Preserving good relationship among workers and management Environmental safety Social accountability
  • 7. Social Compliance 7 History of evolving compliance issue in RMG: First, in 1995 Pwc India office came to Bangladesh to do a social audit for Walmart. Then in 1996, during the European nations cup, several trade unions and NGOs drew attention to the forced labor of children making footballs for the world market. Due to this publicity world-famous retailers focused their eyes on the Bangladesh garments industry to monitor compliance issues especially on child labor and minimum wages. After that in 1996, An agreement was signed among ILO, BGMEA, and Bangladesh Government to work together to work on the labor rights issue. From 1998, the Pwc India office continued social audit for Walmart, Jones Apparel Group, Target, Aramark, Russel Inc., Lego Company, Timberland, Sara-Lee Corporation, Abercrombie & Fitch, etc.

Social Compliance Background and Emergence Of Compliance In Bangladesh Garment Sector Since, 2005 the quota free system started in the RMG industry and at the same time international buyers are pressurizing on the issue of compliance. Before placing the orders at the factory buyers are auditing the factories to assess the labour standards and meeting whether or not they are employment conditions, working conditions, occupational safety and health, industrial relation and management systems exactly to the words There is no fundamental difference between and among the code of conducts of various brands. All these codes lend themselves to, in one way or another, the ILO declaration on fundamental principles and rights at work and the requirements lead down in the national law. 8

Social Compliance To be regarded as a compliant one, a garment industry generally is demanded the application and fulfillment of he country laws and regulations, international laws, ILO conventions being ratified by the government, the buyers requirements and international best practices. It is said that 85% of the requirements or code of conduct of all buyers are being fulfilled of the country’s laws and ILO conventions being ratified by the government are applied or executed fully. So the emerging and considering points are as follows: > Country laws and regulations > International laws or ILO conventions being ratified by the government > Buyers code or requirements > International best practice 9

Social Compliance 10 Ratifications for Bangladesh 36 Conventions and 1 Protocol Fundamental Conventions: 8 of 10 Governance Conventions (Priority): 2 of 4 Technical Conventions: 26 of 176 Out of 36 Conventions and 1 Protocol ratified by Bangladesh, of which 31 are in force, 1 Convention has been denounced; 4 instruments abrogated; 1 has been ratified in the past 12 months.

Social Compliance BKMEA-Save the Children CSR initiative: BKMEA has worked with the ‘Save the Children (Sweden- Denmark)’ on a joint initiative titled “Corporate Social Responsibility & Child Labour”. To make acquainted all the stakeholders with this approach, a conference was held in Copenhagen, Denmark on 12 December, 2006. The conference was on “Responsible Approaches to Child Labor in Textile and Garments Production Walking Together for a Win-Win Situation’. Mr. Md. Fazlul Hoque, President, BKMEA participated the conference and presented a paper on “Corporate Social Responsibility to Workers in the Knitwear Manufacturers & Exporters Units in Bangladesh”. Renowned buyers like H&M, MFA Forum, Amnesty International and different international organizations participated in the conference. 11
  • 12. Social Compliance The Copenhagen conference was a follow-up of the awareness raising seminar on “Corporate Social Responsibility & Child Labour” organized in Dhaka on September 16, 2006. It was jointly by Save the Children (Sweden-Denmark), BKMEA and Danish Federation of Small and Medium Sized Enterprise. The awareness raising seminar was participated by H.E. Mr. Einar Hebogard Jenson, Ambassador, Royal Danish Embassy and H. E. Ms. Britt Falkman Hagstrom, Ambassador, Swedish Embassy in Bangladesh, Mr. Olof Risberg, media, Govt. representative, factory owners and others. 12

The foots should be natural / synthetic rubber or plastic, resistant to water or specific substances. Hard Hats: - This shields head against impact from failing, moving, flying and knocks objects, as well as protection from rain and other elements. 36
