  3. General description The auditee was located at No.10, Weier West Road, Tongqin Town, Wuyi County, Jinhua, Zhejiang, China / 中国浙江省⾦华 市武义县桐琴镇五⾦机械⼯业园区纬⼆西路10号. Total 3 buildings approx. 15700㎡ were within boundary owned by auditee. One 7-storey building was used as office and dormitory. One 1-storey building was used as canteen. One 5-storey building was used as production and warehouse. The auditee was specialised in water bottle, plastic mug manufacturing and the main production processing including: metal processing, welding, polishing, paint spraying, silk-screen printing, plastic spraying, assembling and packing. No finished products subcontractor was used and all employees were hired directly by auditee. The peak or low season for production was not obvious. Good cooperation was conducted between auditor and auditee such as auditor could take photos onsite and independent office was provided for workers interview. The onsite CAP was signed by the auditee representative and auditor without opposed comment. Remark: 1. The name of auditee in English showed in the foreign trade operator registration form was 'No.10, Weier West Road, Tongqin Town, Wuyi County, Jinhua, Zhejiang'. The name of auditee in English in the business license should be 'No.10, Weier West Road, Hardware&machinery Industrial Park, Tongqin Town, Wuyi County, Jinhua, Zhejiang'. They indicated same location and as confirmed by auditee management that they preferred to using 'No.10, Weier West Road, Tongqin Town, Wuyi County, Jinhua, Zhejiang' in the audit report. 2. No government waivers or collective bargaining agreements was maintained by this factory. No labor agency or contractor was used by the factory, thus, no labor agency contract or contractor license was applicable. So these documents were not uploaded to the platform. 3.   6. Findings PA1: Social Management System It was noted that the factory had written management procedures to implement amfori BSCI Code of Conduct, such as protect environment, HS management, etc.. However, not all of the policies were implemented effectively. Such as how to supervise and control workers' monthly overtime(exceeded 36 hours in 3 sampled months for sampled workers: July 2021, Dec. 2021 and Apr. 2022) and insurance was not covered all applicable workers. Interviewees claimed that social insurance and overtime was voluntary to choose. 评估中发现⼯⼚建⽴了确保amfori BSCI⾏为守则有效实施的管理程序,⽐如保护环境、健康安全等。然⽽,不是所有的政策 都被有效的实施。 ⽐如:如何监控员⼯的⽉加班(抽样员⼯抽样3个⽉加班时间超过了36个⼩时:2021年07⽉,2021年12⽉和 2022年04⽉)和社会保险没有覆盖所有适⽤⼈员。被访谈员⼯表⽰社保加班是⾃愿选择的。 It was noted that the factory had established cost accounting and capacity planning procedure. However, it was not implemented effectively which led to the monthly overtime hours exceeded legal requirement(exceeded 36 hours in 3 sampled months for sampled workers: July 2021, Dec. 2021 and Apr. 2022). 评估中发现⼯⼚有建⽴成本核算和产量计划程序。但是没有有效实施以致于⽉加班时间超过法规 要求(抽样员⼯抽样3个⽉加 班时间超过了36个⼩时:2021年07⽉,2021年12⽉和2022年04⽉)。 PA 2: Workers Involvement and Protection It was noted that the factory did not conduct the regular survey on the written procedure for the grievance mechanism. Remark: The suggestion box and worker representative was available in the factory. Based on records review, no grievance was reported since May 2021. 评估中发现⼯⼚没有针对书⾯申诉机制程序进⾏定期评审。备注:⼯⼚有意⻅箱以及员⼯代表。通过记录查阅,从2021年05 ⽉份以来⽆申诉发⽣。 PA 5: Fair Remuneration It was noted that total 162 employees included 24 workers(not required for social insurance as per law requirement) retired back to work, 138 employees should buy social insurance. The social insurance receipt from May 2021 to Apr. 2022 were provided for review, the social insurance receipt of Apr. 2022 showed that the factory did not provide social insurance(endowment insurance, medical insurance, unemployment insurance, maternity insurance) for 127 out of 138 employees who should buy social insurance, did not provide work-related injury insurance 81 out of 138 workers. The factory management claimed that most workers had bought local agricultural insurance. Most interviewed workers claimed that they had bought local agricultural insurance. (Law and Regulation: Social Insurance Law of the People's Republic of China, Article 10, 23, 33, 44 and 53. Maximum monthly overtime were 94 hours in July 2021. (Laws and Regulations: China Labor Law, Article 41) (1) Through reviewing the attendance records in July 2021, 16 selected employees' monthly overtime hours were within 40 to 94 hours; (2) Through reviewing the attendance records in Dec. 2021, 16 selected employees' monthly overtime hours were within 78 to 86 hours; (3) Through reviewing the attendance records in Apr. 2022, 16 selected employees' monthly overtime hours were within 80 to 81.5 hours; Remark: Maximum monthly overtime arranged for sampled workers from Jun. 01, 2022 to Jun. 10, 2022 were 12 hours. The factory had established written procedure regarding working time management. However, it was not implemented effectively. As claimed by factory management that the attendance system had no alert when overtime hours exceeded the limitation. 评估中发现⼯⼚2021年05⽉⾄2022年06⽉10⽇的考勤记录提供查阅,16名抽样员⼯⽉加班时间在抽样3个⽉超过了36个⼩ 时,最多⽉加班在2021年07⽉份达到了94个⼩时。(参考法律法规:《中华⼈⺠共和国劳动法》第41条)。 (1)通过查阅 2021年07⽉16名抽样员⼯考勤显⽰⽉加班在40⾄94⼩时之间; (2)通过查阅2021年12⽉16名抽样员⼯考勤显⽰⽉加班在78⾄ 86⼩时之间; (3)通过查阅2022年04⽉16名抽样员⼯考勤显⽰⽉加班在80⾄81.5⼩时之间; 备注:抽样⼯⼈中从2022年6⽉1 ⽇⾄2022年6⽉10⽇最多的⽉加班为12⼩时。已经建⽴了书⾯的⼯作时间管理程序, 然⽽没有有效的实施,管理层表⽰当加班 时间超出限制时考勤系统没有警⽰功能。 - 6 /

PA 7: Occupational Health and Safety (1) It was noted that the factory did not conduct the occupational hazards factors testing, such as chemical in paint spraying, dust in welding area and noise in metal processing area. The factory management claimed that they did not conduct it as consideration of cost control. Reference law: Provisions on the Administration of Workplace Occupational Health Article 20. (2) It was noted that the factory did not provide the pre-job and post-service occupational diseases examination for workers exposed to occupational hazards position. (e.g. welding workers exposed to dust, paint spraying worker exposed to chemical and metal processing worker exposed to noise etc.) . The on-job occupational diseases examination was provided. Reference law: Law of the People‘s Republic of China on Prevention and Control of Occupational Diseases, Article 35. Work-related injury management procedure was established and no related case happened before according written records. Approx. 120 workers had meal in the canteen. Reference law: Measures for the Administration of Environmental Surveillance , Article 21 (2) It was noted that the factory didn't monitor its boundary noise level to comply with the requirement of law.
