Occupancy certificates - Do I need it

2. Absolutely yes! An occupancy certificate or OC for short
is the most important document you need to possess and
there’s a reason. Issued by the local municipal authorities
after a check by the engineer, OC is a certificate that
reassures any buyer the property is constructed
according to the plan approved by the corporation. It’s the
one document that shows to the world that the project or
property has been built according to the laws of the land
and has adhered to the municipal regulations and codes.
The OC is the document you need to submit to the
authorities when requiring any water connection,
telephone connection, electricity board connection etc…
This document is the proof that the property is ready and
fit to be occupied.
3. The OC is the legal document that ascertains the
status of your property. Without an OC any
structure can be deemed as unauthorized and
encroached. They can go to the level of
demolishing it. For applying loans and reselling
your property, you need an OC. You can apply
for OC within 30 days of completing the project.
It’s generally the responsibility of the developer
but you can also get an OC.

the OC:
• Project commencement Certificate
• Project completion certificate
• NOC’s from various departments for fire and
pollution.
• Latest Tax payment receipt
• Copy of the property’s sanctioned plan
You are in your rights to sue the developer if he
does not provide you an OC. Many of the acts like
RERA come in support of the consumer, but it
should be your responsibility to act for these
documents.
