What are the stamp duty and registration fees for real estate?
A buyer must pay a set amount of stamp duty and registration charges to the state government
for each property transaction.
The Maharashtra Stamp Act imposes stamp duty and registration fees in Maharashtra 2022. It

What does the Maharashtra Stamp Act entail?
The Maharashtra Stamp Act, commonly known as the Bombay Stamp Act of 1958, governs all
documents listed in Schedule 1 for which the state of Maharashtra collects stamp duty. A

The stamp duty and extra taxes in Maharashtra make up the stamp duty.
Properties in urban areas that are under the jurisdiction of the Municipal Corporation or
Municipal Council must pay a cess/local body tax or/transport surcharge of 1% of the property
value. This is used to support transportation infrastructure projects in Maharashtra, including as

In Mumbai, stamp duty is determined using ready reckoner rates and the property value stated in
the buyer-seller contract. This is also true in other areas of Maharashtra. For example, stamp duty
in Mumbai for a property located within the municipal limits of metropolitan regions is 5% of
the market value, whereas stamp duty in Mumbai for a property located within the borders of any
gramme panchayat is 3% of the market value.
The Maharashtra government raised ready reckoner (RR) rates for the fiscal year 2022-23 on
March 31, 2022. On April 1, 2022, Maharashtra (excluding Mumbai) would see an average rise
of 5%, while municipal corporations (excluding Mumbai) will see an increase of 8.80 percent in
RR rates.
In Maharashtra 2022, the ready reckoner rate is critical for calculating stamp duty and
registration fees. It is dependent on:
Location: The ready reckoner rate is affected by the location of the property. Mumbai is split
into 19 zones, each of which is broken further into 221 subzones.
Property type: Ready reckoner rates differ depending on the kind of property. The ready
reckoner rate for commercial property is high, whereas the ready reckoner rate for residential
property is lower. In a residential property, the value of a ready reckoner rate changes as well—it
differs for an independent home or villa and an apartment in the same neighborhood.
Property market value: The ready reckoner rate is determined by the property's market value.
The ready reckoner rate is influenced much more by the property's features.
Due to the pandemic, the state left the ready reckoner rates constant for the fiscal year 2021-22.
In September 2020, ready reckoner rates in the state increased somewhat by 1.74 percent.
Maharashtra's stamp duty was reduced from September 1, 2020, to December 31, 2020, and from
January 1, 2021, to March 31, 2021, which was a welcome move, especially in Mumbai and
Pune, where property prices are already high.
Despite the economic pressures created by the second wave of the Corona virus epidemic,
Mumbai experienced a large increase following this announcement on stamp duty and
registration fees.
Maharashtra stamp duty and registration fees in 2022: Online payment
The Maharashtra Stamp Act has been changed to allow for the payment of stamp duty on
documents signed in the state over the internet. Follow these procedures to pay your Maharashtra

Step 1: Go to the Maharashtra Stamp Duty Payment Portal to make a payment.

Step 3: If you choose the 'Pay without Registration' option, you will be sent to another page on
the Maharashtra stamp duty portal, where you must pick 'Citizen' and the sort of transaction you
wish to do.
Step 4: Select 'Make Payment to Register Your Document' from the drop-down menu. You can
now pay both the stamp duty and the registration costs together, or just the stamp duty or just the
registration fees separately.
Step 5: On the stamp duty and registration fee website, fill in the needed information, such as
district, sub-office, registrar's payment information, party information, property information, and
property value information.
Step 6: Select a payment method for stamp duty and registration fees, then proceed to produce a
challan from the stamp duty and registration fee website, which must be given at the time of deed
execution.

Charges for stamp duty and registration: Maharashtra stamp duty refund
If you meet the following criteria, you may be eligible for a stamp duty refund in Maharashtra:
 Due to errors in writing, the stamp duty paper is unfit for use.
 The stamp paper is unsigned, and it is filled with entire or partial information, but it is not
intended to be utilized.
 The stamp document is signed, but the party finds the transaction to be unlawful under
Section 31 of the Specific Relief Act.
 According to Section 31 of the Specific Relief Act, the court judges the transaction to be
totally unlawful from the start (Void /ab/ initio).
 The individual who must sign refuses to sign or has passed away before signing.
 Anyone who is a party to the stamp paper document refuses to sign it.
 The terms and conditions are not followed by any party to the stamp paper document.
 The stamp value for the document is insufficient, so the transaction was completed with
the use of another stamp paper with the correct value.
 The stamp duty paper has been tampered with, thus both parties have signed a new stamp
paper document for the same reason.
Maharashtra stamp duty refund: information should be filled out online
It is necessary to provide information into the internet system in order to begin a stamp duty
Maharashtra refund. You must submit the application offline once the information has been
entered online and a token has been assigned.
 To get started, go to the IGR Maharashtra website and select online services. Here, you

Entry." Fill in your phone number, OTP, and captcha.

information, your bank account number, and the cause for the refund. In the particulars of

Stamp duty and registration fees on previous real estate papers While the Maharashtra Stamp Act gives the collector of a district the authority to summon documents within ten years of their registration date to verify whether the appropriate duty has been paid on the deed, the Bombay High Court has ruled that stamp duty cannot be collected for past documents that were insufficiently stamped at the time of their subsequent sale. Furthermore, if historical documents are required to be stamped, the stamp duty must be recovered only at the market rate in effect at the time the transaction occurred, pursuant to Maharashtra's stamps and registration charges.
