Honorable Sir,
Sub: Thousands of crores of rupees revenue is being lost due to Commercial Tax
Department's violation of Sections 21 &43 of Telangana VAT Act 2005 and Rule 59 of
Telangana VAT Rules 2005-Request for suitable action against the higher officials of the
Department for their failure-Regarding.
I, Mote Raghupathi, covener, Movement for Stronger Democracy-MOSDEM, H. No.11-
9-75/1/102, Rd.No.2 Laxminagar Colony, Kothapet, Saroornagar, Rangaredy district, sincerely
submit that,
The higher officials of the Department of Commercial Taxes have been violating section
21 and section 43 of Telangana VAT Act 2005 and also Rule 59 of Telangana VAT Rules
2005.
Due to these violations 91 circles have become non-functional in VAT revenue
collections.
CTOs of the circles are precluded from inspections of business premises in their circles
by the Deputy Commissioners (Violation of Section 43) and are being insisted to obtain form
ADM IB to conduct inspections IN OTHER CIRCLES and obtain ADM IC for completing the
assessments (violation of Sec.21).
Due to this practice of deterring the CTOs of the circles by the Deputy
Commissioners(CT) Inspections (sec.43) and Assessments (sec.21) are not being held
properly causing every year thousands of crores of rupees of revenue loss to the Government.
For instance, in this financial year, 2016-17, out of 1,80,000 (approximately) dealers in
the state only 5000 (approximately) dealers have been assessed. Only Rs.100 to 150

crores of rupees (approximately) have been collected by assessments. But, when it is
compared with the Tamil Nadu's revenue for the F.Y.2015-16 from inspection 5500 crore
rupees (approximately) and assessments 2000 crore rupees (approximately) totally put
together 7500 crores of rupees (approximately) is negligible.
Thus it can be inferred that all the 91 circles have been made idle from revenue point
view.
The revenue which our State earned from sales tax by Commercial Taxes Department
of Rs. 35,224 crores in this F.Y. 2016-17 could have earned even without the 91 circles. There
is no need of these circles for the Revenue which our State has got all these three (3) years.
Our plea is to make the circles active in implementing Sec. 21
and Sec. 43 but not to remove them.
The Department has notified that out of the above mentioned Rs. 35,224 crores of
rupees in this F.Y. 2016-17:
· Rs. 17,611 are from non-VAT goods (Public Sector Units, Petrolium Products,
Liquor and Cigarettes) and
· remaining Rs. 17,600 crores of rupees are from sales Tax.
· But out of this 17,600 rupees nearly 6000 crores are from CST and minor acts.
· Around 12000 crores are from VAT Tax collections.
· The entire 12000 crore rupees are from Section 20 of the VAT Act-Dealers pay tax
while submitting monthly returns online. In this collections the department's role is
negligible.
· There are also other two sections, sec.21 & sec.43, where the department has to
play a crucial role. At least another 5000 to 6000 crores of rupees revenue could be
generated from these sections.
Thus the 91 circles could have raised a revenue of ANOTHER 5000 TO 6000
CRORES by way of INSPECTIONS (Sec.43) AND ASSESSMENTS (Sec.21) if the Act and
Rules have been not violated by the higher officials of the Department.
If the inspections and assessments are done on a regular basis the dealers would be
afraid of tax evasion and pay the VAT tax without fail.
It means our Government has lost a revenue of 15000 crores to 20,000 crores of rupees
in these three(3) years.
Thus the higher officials of the Department have been working against the Telangna
Government by violating sections 21 and 43 of Telangana VAT act 2005 and rule 59 of
Telangana VAT Rules 2005. This is an act of contempt of the Telangana Legislture which
should be viewed seriously.
I request your kindness to take appropriate action against the higher officials for
violating the Act and Rules thus causing thousands of crores rupees of revenue loss to the
Government.

I further request your kindness to make the concerned officers personally liable for the
revenue loss and also the loss can be recovered from them.
Regarding these violations I made a complaint to the Commissioner of Commercial
Taxes on 20-02-2016 and to the Principal Secretary-Revenue (excise&commercial taxes) to
the Government of Telangana on 03-01-2017 by email and on 07-01-2017 in the office. The
copies of these applications are forwarded as attachments.
