PREAMBLE
WHERE AS the Students of the IRDP understand and believe that the Institute plays its
role under the Institute of Rural Development Planning Act of 1980 which established
the Institute and that naturally this makes the Institute serve the nation in its own unique
environment and systems; AND
WHERE AS the students understand and believe that through a democratic Students’
Organization run by the democratically elected students will be their true voice and
responsible to promote and maintain student affairs and the interests of students to its best
Level; AND
WHERE AS the students understand and believe that Students Organization that is semi-
autonomous will to the greater extent promote, improve and maintain cordial
relationship between students, the Institute administration and the IRDP community,
other learning Institutions and their Organizations and youths in and outside Tanzania.
NOW, THEREFORE, we members of the Institute Students Representative Council (ISRC),
noting that the ISRC Constitutional Committee was established to represent us in
preparing the draft of the Constitution;
DO HEREBY in and through this Institute Students Representative Council sitting as the
Special Constituent Assembly, solemnly adopt, enact and give to ourselves and our
prosperity, this Constitution of IRDP Student Organization of 2012 on behalf of all the
Organization members, for the purpose of giving effect to the above interest and belief.

CHAPTER ONE
THE ORGANIZATION, INTERPRETATIONS AND MEMBERSHIP
PART I
THE ORGANIZATION AND INTERPRETATIONS
1. (1) The Name of the Organization shall be ‘The Mipango
Students Organization’ here in after referred to
as the
“MISO”
(2) The headquarter of the Organization shall be at Institute of
Rural Development Planning main Campus.
2. In this Constitution unless the context otherwise requires;
“Affiliation” - Means the students organizations
and approved by Council of
Governing Board;
“Baraza” - Means the general meeting of all
students in each of the IRDP
convened with the approval of the
Deputy Rector – Academic.
“By elections” - Means elections, which are conducted
to fill the vacant posts;
“Cabinet” - Means the Cabinet of the Mipango
Student Organization;

“Dean of Students” - Means the Dean of students of IRDP

boards and any other meetings in the
department level;
“Extra Ordinary Meeting”- Means any meeting other than
ordinary meeting;
“Faculty Representative” - Means the students who will
represent other students of every
faculty in the faculty boards and any
other meetings in the faculty level;
“Government” - Means Government of Mipango
Students Organization;
“ISRC” - Means Institute Students
Representatives Council;
“Member” - Means the member of Mipango
Students Organization;
“Minister” - Means a Minister and Deputy

“MISO Judicial Board” - Means the Committee Constituted
under the Article 21 of the
Constitution;
“Ordinary decision” - Means any decision which shall be
supported by a simple
majority in any MISO organs
meetings;
“Ordinary resolution”- Means other resolution which shall
be supported by a simple majority
“Organization” - Means Mipango Students
Organization established under
Section 49 (2) of the Universities
Act, 2005 and G.N No 178/2011;
“President” - Means the President of MISO
Government in every Campus of the
Institute;
“Prime Minister”- Means the Prime Minister of MISO
government in every Campus of the
Institute;
“Rule” - Means rules made by the ISRC under
the provisions of this Constitution;
“Secretariat” - Means the ISRC secretariat

established under Article 17 of this
Constitution;
“Speaker” - Means the person, who shall chair
and preside over the meetings of the
ISRC and shall be elected as
provided for in this Constitution;
“Special decisions” - Means decision reached on and
supported by two thirds of the
member of MISO organs physically
present and voting on impeachment,
boycott, strikes and Constitution
amendments;
Special ISRC - Means the ISRC established under
Article 50 of this constitution which
is vested with powers and duties to
deal with the amendments of this
constitution.
“Special resolution” - Means a resolution of the students
Baraza which is supported by two
third of the members physically
present and voting;
“Status” - Means the status of MISO as
described under this Constitution;
“Student” - Means any person admitted to the
Institute of Rural Development

Planning as candidate for any award
of the Institute and studying under
any of its programmes;
“Students Organization” Means an Organization
approved by the Board of Trustee
being an Organization
representative of the Student of the
Institute.
“The Institute” - Means the Institute of Rural
Development Planning established
by section 3 of the IRDP Act of
1980;
“Vice President” - Means the Vice President of “MISO”
Government in every Campus of the
Institute;
3. The official language of the Organization shall be English and
Kiswahili;
4. The Status of the Organization shall be Student’s Organization of
the Institute, quasi autonomous, non-governmental organization
which shall endeavor to fulfill its objectives to the best interests of
its members and in accordance with the established, recognized
and approved procedures by IRDP Act of 1980.
PART II
OBJECTIVES AND FUNCTIONS OF THE ORGANIZATION
5. The objectives of Students Organization shall be: -

i. To promote and maintain students interests during their tenure at
the Institute without violating any Institute by – laws;
ii. To establish a proper organizational basis for communication
between the Institute authorities and students
iii. To maintain harmonious relations between students and academic
members of staff, the Institute administration, non academic staff,
and the Institute community in general;
iv. To promote and maintain respect for learning and the pursuit of
truth, and to ensure that every student understand his responsibility
to educate himself to the best of his capabilities in so doing cherish
and promote academic freedom as an inalienable right of student at
the institute;
v. To stimulate and promote all desirable aspects of cultural
development which inculcate the spirit and love for music, sports
and art(s) in order to keep talents are developed;
vi. To maintain and promote fraternal relations with other student
institutions and alliances of higher learning in and outside
Tanzania;
vii. To do all such other things as may be conducive to the attainment
of the foregoing objective or any one of them and to question any
other things whatsoever, which appears to compromise the status
of the Organization;
viii. To promote and maintain tranquility, democracy and co-operation
among students of the institute regardless of differences in
nationalities and other diversities;
ix. To facilitate student participation in contemporary issues in which
the nation is interested;
x. To deliberate on matter(s) that appears to affect the status of the
Organization.
ons 6. In pursuit of its objectives stated under Article 5 of this Constitution

Function of
the MISO
the Organization may carry out any or all of the following functions;
(1) To initiate, sponsor, or undertake activities for benefit of the
members of the organization;
(2) To organize debates, seminars, workshops conferences, congress,
study tours and symposia to enhance intellectual and socio-
economic awareness of the members of the organization;
(3) To mobilize funds and sponsor students research in all academic
field in order to promote creativity and originally on matters of
intellectual interest to the scholarly community and the nation;
(4) To publish, broadcast and print through the mass media its own
journals, books news papers, leaflets, magazines, recording, or
publish through any other means of presenting information to the
public;
(5) To invite, with the approval of the Institute management the
distinguished personalities, to interact with the members of the
organization by way of lecturer, panel or group discussion,
workshops, or any other means that would promote a health
discussion of contemporary social, scientific and political issues;
(6) To correspond and communicate or otherwise promote
relationship between the students’ organization and any other
organizations which the organization shares and promote
common objective;
(7) To organize and co-ordinate student activities in pursuance of
their rights and welfare in conformity with the objectives and
status of the organization;
(8) To assist in the counseling of members with regard to their
academic, social and disciplinary matters;
(9) To undertake any other activity or function in conformity with
objectives of the organization.

PART THREE
MEMBERSHIP,
RIGHTS AND OBLIGATION OF THE MEMBERS
7. (1) Every student of the Institute shall be a member of the
Organization upon his registration as a student and his
membership shall cease upon the cessation of his studentship;
(2) Every member shall pay an annual subscription fee as may be
prescribed from time to time by ISRC.
8. Every member of the Organization has: -
(1) Right to vote and hold office when elected or appointed provided
he meets the laid down regulations of election by-laws;
(2) Right to obtain and inspect any public document of the
Organization from request to the Prime Minister;
(3) Right to request any publication of the Organization as shall be
determined by the ISRC;
(4) Freedom of opinion and expression of his ideas before any organ
of the Organization;
(5) Right to be informed at all times of various important events and
issues of the Organization likely to affect his welfare at the
Campus.
Provided that, every member shall enjoy these rights without violating the
Institute by-laws and regulations.
9. Every member of the organization shall be obliged to: -
a. Uphold this Constitution;
b. Educate oneself to the best of ones ability;
c. Pay fees and subscriptions when due;
d. Be an example of self discipline and academic responsibility;

e. Participate in all activities leading to fulfillment of the
objectives of the Organization;
f. Refrain from taking part or conducting or influencing MISO
members or office bearers to take part or conduct themselves in
any manner likely to affect the status of MISO.
10 (i) The decisions concerning the following matters shall not
be made by any organ except through a referendum,
involving all registered members of the Organization: -
(b) any decision likely to affect delivery of students
services;
(c) any decision likely to interrupt academic
programs;
(d) any proposed cause of action likely to cause
breach of peace;
ii. The Dean of students, the President, the Speaker and
the Chairperson of the MISO Board shall be responsible
to ensure that any referendum is conducted in manner
that guarantees the exercise of free will by every
member;
iii. A decision reached by the referendum shall prevail and
be binding upon all members and the Organization shall
be obliged to implement it forthwith.
CHAPTER TWO
PART I
ORGANS OF THE ORGANIZATION
11. There shall be the organs of the organization as follows: -
(1) The Student Baraza at the Campus level;
(2) The Students Representative Council at the Campus

PART II
MISO STUDENTS BARAZA
12. (1) There shall be established a Student Baraza at every
Campus of the Institute composed of a particular
Campus;
(2) The Student Baraza at every Campus shall be the supreme
organ of the Organization at the particular Campus;
(3) (a) The Student Baraza at every Campus shall convene
ordinarily twice per semester on such a date as
provided for in the almanac of the Organization;
(b) Extra – ordinary Student Baraza may convened at
any time provided that the Secretary General shall
issue a two (2) days public notice of such Baraza
when so directed by the ISRC or by the President or
upon the receipt of a petition signed by two third
(2/3) of the members of ISRC.
(4) Without prejudice to the provisions of sub-article (2)
above, the extra – ordinary Baraza for the impeachment of
the President or the Vice President shall be summoned by
the Clerk of the ISRC upon receiving directives of the
ISRC;
(5) The quorum of the Baraza shall be not less than one half
(1/2) of the members;
(6) The Baraza shall be presided over by the President and in
case of his absence or any reason preventing him from

presiding over the same, the Vice President shall preside
over the meetings of the Baraza;
(7) Without prejudice to the provision of sub-article (6)
above, where the Baraza is concerned with the accusation
of, or impeachment of the President or the Vice President
or both, the Baraza shall be presided over by the
Chairperson of the MISO Board;
(8) The decision of the Students Baraza shall be of two types,
thus are: -
(a) Special decision, and
(b) Ordinary decision.
(9) The functions of the Students Baraza at the Campus level
shall be: -
(a) To oversee the activities of all other organs of the
Organization;
(b) To discuss all matters of interests to members
without prejudice to the IRDP laws and any Institute
by-laws;
(c )To make final decisions on the recommendations of
ISRC including votes of no confidence to the President
or Vice President severally or jointly;
(d) The Student Baraza may delegate any of its powers to
the ISRC as it may deem fit.
PART III
INSTITUTE STUDENTS’ REPRESENTATIVES COUNCIL
13. (1) There shall be an Institute Students Representatives
Council (ISRC) at every Campus.

The ISRC shall convene two ordinary meetings in a
semester;
(a) The ordinary meetings shall be scheduled by the ISRC
itself, whereby the notice shall be issued by the Clerk;
(b) There shall be an extra–ordinary meeting of the ISRC
which shall be convened upon the deliberations by the
ISRC Secretariat, where upon the ISRC Clerk shall
issue a reasonable notice to that effect;
(2) The quorum for the ISRC meetings shall be not less than
two third (2/3) of the members;
(3) There shall be two types of decisions of the ISRC, which
are: -
(a) Special decision, and
(b) Ordinary decision.
(4) Without prejudice to sub-article (3) above ordinary
decision of the ISRC shall be reached by simple majority,
but for avoidance of doubt special decision shall require
two third (2/3) of the votes of the members attended the
meeting;
(5) The ISRC meetings shall be presided over by the Speaker
or the Deputy Speaker of the ISRC;
(6) In the absence of the Speaker and the Deputy Speaker the
ISRC members shall elect one member, who is not a
cabinet member, to preside over the meeting as the
Chairperson.
14. (1) All meeting of ISRC shall be composed of:-
1. The Speaker;
2. The Deputy Speaker;
3. The Chief Clerk;
4. The Prime Minister;
5. The Ministers of MISO government;

7. Class Representatives; Member of
parliament
8. Hall of residence Chairpersons;
9. One representative elected from
respective affiliations;
10. Two representatives of the disabled
members, one male and one female to be
appointed by the President;
ii. Notwithstanding the provision of Article 14 (1)
(f) of this Article, the departments that shall
have representation are those running academic
programs.
15. The ISRC shall have power to: -
(i) Make, amend or repeal any rules of the
organization;
(ii) Amend the Constitution of the organization;
(iii) Confirm the Prime Minister appointed by
the President;
(iv)Receive, consider and approve or disapprove
policies of the MISO;
(v) Receive and consider the annual general
handing over report of the activities of the
MISO government;
(vi)Approve budget estimates of MISO
government prepared and presented by
Minister responsible at the budget session;
(vii) Make provisions for regular auditing of
books of account(s) of MISO organs to ensure
efficient administration of Organization’s
Funds;

(viii) Discuss the report of the Internal Auditor of
the institute or any other independent External
Auditor;
(ix)Summon any member of government either
individually or collectively for the purposes of
enhancing accountability of MISO
government;
(x) Punish any member of ISRC for malpractices,
corruption and other misconduct tarnishing the
image of the ISRC and or the members
present and voting shall have approved for
such a disciplinary action; The discipline
action may include the severe written warning
or suspension from the ISRC;
(i) Establish committees as may be found
necessary for the execution of its functions;
(ii) To elect two members to be members of the
ISRC secretariat;
(iii) Perform any other lawful duties as the
Student’s Baraza my direct from time to
time.
16. The ISRC shall make the regulations to control the activities
of the ISRC meetings.
17. (1) There shall be a Secretariat of the ISRC which shall
composed of four members: -
i. The Clerk of the ISRC who shall be appointed by the
President and approved by the ISRC before assuming
the office;
ii. One member appointed by the Speaker from outside the
ISRC and approved by the ISRC before assuming the
office;

iii. Two members elected amongst the ISRC members who
shall not be cabinet members of whom one shall be
female and the other a male;
(2) The Secretariat of the ISRC, under the leadership
of the Clerk shall discharge all duties and functions
prescribed for the purpose of ensuring efficient
discharge of the ISRC functions by the ISRC
members;
(3) Without prejudice to the generality of sub-article (2)
(a) and (b), the President and Speaker, as the case
may be, once appointed members to the Secretariat
shall have no power to remove a member from the
Secretariat;
(4) The power to remove members of the Secretariat
shall be vested in the ISRC.
18. The functions of the Secretariat to the ISRC shall be to: -
i. deliberate the agenda of the ISRC meetings;
ii. carry out clerical and financial activities of the ISRC;
iii. keep minutes and other records of the meetings of the
ISRC;
iv. establish the database of the members of the ISRC by
their names;
v. receive bills and motions from the government and
members of ISRC;
vi. deliberate on the question of the extra-ordinary
meetings of the ISRC after receiving an application

either from the government or any of the ISRC
members;
19. (1) Subject to the provisions of this Constitution, the tenure of
office of the members of the Secretariat of the ISRC shall
be one year;
(2) Without prejudice to the generality of sub-article (1)
above the tenure of office of the Secretariat shall run
concurrently with the term of the ISRC;
In case the Clerk of the ISRC is accused of any misconduct or
malpractice or corruption or breach of any of the provisions of
this Constitution, any member of the MISO may file a petition
to the MISO Board.
PART IV
THE CABINET
20 (1) There shall be a cabinet at every Campus of the Institute,
the members of which shall be the President, the Vice
President, the Prime Minister and all the Ministers.
(2) The President shall attend the meetings of the Cabinet and
shall preside over all Cabinet meetings. In the event that
the President is absent, the meeting shall be presided over
by the Vice President, and if both the President and the
Vice President are absent, the Prime Minister shall preside
over the meetings;
(3) Subject to the provisions of this Constitution, the Cabinet
shall be principal organ for advising the President on all
matters regarding the exercise of his powers in accordance

with this Constitution, and shall be accountable to the
President;
(4) The tenure of office of Cabinet members shall commence
on the date they are appointed to hold that office and shall
become vacant upon the occurrence of any of the following
events: -
a. If the incumbent resigns or dies;
b. If the MISO government is removed;
c. Where the incumbent ceases to be a member of MISO;
d. If he violates any of the provisions of this Constitution
as determined by the MISO Board;
e. Where the President revokes the appointment thereby
removing the incumbent from office;
(5) For the avoidance of doubts, Cabinet members other than
the Vice President and the Prime Minister, shall hold office
at the pleasure of the President, and shall not be paid any
salary except allowances and other remuneration in
accordance with rules or regulations made by the ISRC.
(6) The Prime Minister shall be the Secretary of the Cabinet
meetings.
PART V
THE MISO JUDICIAL BOARD
21. (1) There is hereby established a MISO judicial Board
in every Campus of the Institute which shall be
composed of six members appointed by the
President as follows: -
(a) Three members appointed from academic departments;
(b) Two members from religious affiliations recognized by
the Institute;

(c) Two most senior class persons with experience in
dispute resolutions;
(2) In complying with the requirements under sub –
article 1 (b) above, the President shall receive the
recommendations of the names to be appointed as
members of the Board from religious affiliations;
(3) The members of the Judicial Board shall be neither
a member of the ISRC nor Cabinet and where a
member of either ISRC or Cabinet is appointed and
accepts such appointment he will immediately cease
to be a member of ISRC or Cabinet.
(4) Notwithstanding the provision of sub article (1)
above, the President shall not have power to remove
any member from the Board.
22. There shall be a Chairperson and Secretary to the
Judicial Board who shall be elected from amongst the
members of the Judicial Board.
23. The tenure of office of the Board shall be one year, which
shall expire upon the appointment of the new Board although
they may be reappointed.
24. The MISO Judicial Board shall have power to: -
(a) Interpret the Constitution, by laws and rules of the
Organization which shall be final and conclusive;
(b) Act as disciplinary authority to the Organizations
office bearers and its decision shall be final and
conclusive.

25. As for the President, the Vice President, the Speaker, the
Deputy Speaker and the Clerk of the Organization, the Board
shall recommend the necessary sanctions to the ISRC as the
case may be;
26. For the avoidance of doubts the Board shall have other
functions as follows: -
a. To investigate and recommend to the President
appropriate disciplinary and legal measures against any
Cabinet member other than the President and the Vice
President of malpractices, corruption and any other
misconduct; failure of which the Board may on its own
discretion proceed to the ISRC;
b. The Board may act as the arbiter in disputes among the
students with a view to promoting harmony and
tranquility;
c. The Board shall assume powers of the Cabinet where in
any circumstances the Cabinet does not exist;
d. The Board shall have power to receive or review or
revise, or hear and determine any appeal brought to it
by any aggrieved member on the decision made by
Electoral Committee and any other organ of the
Organization;
e. For purpose of expediency and when need arises the
Board may invite the President, the Vice President, the
Speaker or any other office bearer as the circumstances
may require to attend Board meetings and give
clarifications, evidence or opinions on any matter that
need their attendance.

27. (1) Upon receiving the allegations and complains of
misconduct and bad behavior of any member, the Board shall
have power: -
a. Summon the member against whom the complains and
allegations is made;
b. Counsel, advice and warn the alleged member with
regards to such misconduct or behavior;
28. The alleged member having been warned more than twice of
misconduct or bad behavior shall be regarded as hardcore and
the MISO Board shall make any necessary recommendations
to the Institute administration on the same complains and
allegations for further disciplinary action to be initiated against
him.
PART VI
HALL STUDENTS BARAZA
29. (1) There shall be a Hall students Baraza at Hall level in every
Campus of the Institute composed of all students residing in
the respective Hall;
i) The Hall students Baraza shall be summoned and presided over
by the Hall Chairperson or the Hall Secretary in case the
Chairperson is absent;
ii) The functions of the Hall student Baraza shall be to discuss all
matters relating to the welfare of members of the respective
Hall;
iii) The Hall Student Baraza can be summoned at any time when
the need so to do arises and the decision of the Baraza shall be
taken to MISO government;

iv) The election of Hall Chairperson and Hall Secretary shall be
conducted at the beginning of every semester, in accordance
with the provisions of this Constitution;
CHAPTER THREE
OFFICE BEARERS
PART I
PRESIDENT
1. There shall be a President of the Organization who shall be the
head of the Organization and MISO government at the main
Campus;
23. Any person who is a member of the Organization shall be
entitled to be elected to hold office of the President
provided that he fulfills the requirements of the election by-
laws;
24. The President shall be elected by members in an election
participated by not less than 60% of all members of the
Organization at the Campus, and in accordance with the
election by – laws of the Organization pursuant to this
Constitution;
25. Any Presidential candidate, in any contested election shall
be declared to have been dully elected as a President only if
he/she has obtained the majority of votes;
26. The Presidential candidate, in the general election shall
submit to the Electoral Committee not less than three

proposes to be his running mate for the office of the Vice
President;
27. Subject to the provision of sub–article (5) above, the
Electoral Committee after receiving the proposed names for
the Presidential candidate, shall conduct a screening and
return to the candidate the names of those who qualify to
the post of the Vice President for him to nominate one
name to be his running mate;
28. The President elect shall assume office of the President as
soon as possible having been declared as a President.
29. Subject to the provisions of sub-article 10 of this article, the
President shall hold office of the President for a period of
one year from a date on which he was elected;
30. A person elected President shall hold office of President
until: -
1. The day his successor takes an oath of
office;
2. The day he dies while in the office;
3. The day he resigns from office;
4. He ceases to hold
the office of the President in
accordance with the provisions of this
Constitution.
31. Every President elect and every person assuming the office
of the President shall, before assuming the functions of the

office of the President, take and subscribe an oath before
the Commissioner for Oaths.
33. 31. The President shall have authority: -
a. to supervise implementation of the decisions made by
the ISRC and the Students’ Baraza at the campus.
b. to appoint the: -
i. Clerk of the ISRC;
ii. Members of the Miso Board;
iii. Disabled members to the ISRC;
iv. Ministers and Deputy Ministers;
v. Prime Minister with the approval of the ISRC;
vi. Representatives to the Departments of the
Institute.
c. Without prejudice to the provisions of sub-article 2 of
this article, the President when making appointment
shall ensure proportional representation of all members
including postgraduate students, members in each
academic year, and gender balance;
d. Without prejudice to provision of sub-article 2 and 3 of
this article, the President shall appoint a Minister(s)
who shall be responsible for post graduate matters and
linkage of the government and Postgraduate students;
e. To preside over the meetings of the Cabinet and
Students Baraza and other meetings at the Campus
where necessary;
f. To link the Miso Organization and the Institute
management;
g. To perform any other duties inconformity with the
Organizations objectives for the benefit of the members
of the Organization at the Campus.

Power of the
President
32. Subject to the other provisions of this Constitution, the office
of President shall fall vacant and the election of the President
shall be held or that vacancy shall be filled otherwise in this
Constitution, as the case may be, upon the occurrence of any of
the following events: -
a. death of the President;
b. resignation of the President;
c. impeachment of the President by the ISRC;
d. discontinuation from studies of the President;
e. if charged and found guilty of disciplinary and criminal
offense(s) and suspended by the Institute;
f. any of the occurrences that make the President
incapable of discharging his office duties for three
months consecutively.
33. (1) The ISRC may pass a resolution to remove the President
from office if a motion to impeach the President is moved
and passed in accordance with the provisions of this
Constitution only if it is alleged that he/she has: -
1. committed acts, which generally violate
this Constitution;
2. conducted himself in a manner which
lowers the esteem of the office of the
President of MISO.
2. The ISRC shall not pass a motion to impeach the President
save only if: -
a. a written notice signed and supported by one half
(1/2) of the ISRC members is served to the Speaker
seven (7) days prior to the sitting at which such
motion is intended to be moved in the ISRC, the
notice shall specify the wrong committed by the
President and propose a Special Committee of

b. after receipt of the notice duly signed by the
required number of members of the ISRC and
satisfies himself that the provisions for moving of

shall announce the names of the member of the
Special Committee of Inquiry who shall be
approved by the ISRC;
c. The Committee shall carry out investigation to
inquire into the charges submitted against the
President, and submit the report to the Speaker
within fourteen days (14) from the date it was
constituted;
d. after receipt of the report of the Special Committee
of Inquiry, the Speaker shall table it before the
ISRC; the ISRC shall discuss the report and give the
President an opportunity to be heard;
e. The ISRC after going through the report shall after
affording the President an opportunity to be heard
and by majority of votes of all the members of the
ISRC pass a resolution that either the charges
against the President have been proved or not;
f. In the event that the ISRC passes a resolution that
the charges against the President have been proved
and that he is unworthy of continuing to hold the
office of the President, the Speaker shall inform the
President about the resolution;
g. The ISRC members having supported the
impeachment of the President by majority of votes
shall summon the Students Baraza;

h. The decision of the Students Baraza for the
impeachment of the President shall be by the special
resolution;
i. The President shall cease to hold office immediately
and shall be obliged to resign where the special
resolution for impeachment is passed.
3. Without prejudice to the generality of sub–article 2 (c)
above the ISRC shall deal with the allegations within
fourteen (14) days of which the President shall be present
in person and be given an opportunity to be heard;
PART TWO
THE VICE PRESIDENT
34. (1) There shall be the Vice President of the Organization at every
Campus of the Institute who shall be the principal assistant to the
President in respect to all matters concerning the members
generally and, in particular shall: -
(a) Assist the President in making follow up on day to day
activities of the Organization’s plans and programs;
(b) Assume office of the President when the President
resigns for any reason, or be removed from his office in
accordance with the provisions of this Constitution or
when the President cease to a member for any reasons;
(c) Perform all duties assigned to him by the President;
(d) Perform all duties and functions of the office of the
President when the President is out of office; and
(e) Perform his duties under the direction of the President
and shall be answerable to the President in respect of

any matters or functions assigned to him by the
President.
ii. The Vice President shall contest as the
running mate of the Presidential candidate.
35 (1) The Vice President shall assume the office on the same
day the President assume office and hold office until: -
a) He/she resigns;
b) He/she dies while in office;
c) His/her tenure of office expires;
d) He/she is discontinued from studies;
e) He/she sworn in as President after the
office of the President has fallen vacant.
36. The reasons, circumstance and procedures for the
impeachment of the Vice President shall apply mutatis
mutandis as those provided for the impeachment of the
President in article 28 of this Constitution.
PART III
THE PRIME MINISTER
37. (1) There shall be a Prime Minister of the Organization
who shall be appointed by the President in
accordance with the provisions of this Constitution
and who before assuming his office shall take and
subscribe before the President such an oath of
allegiance of the office of Prime Minister;

(2) Soon as possible and in any event within seven (7)
days after assuming his office the President shall
appoint the Prime Minister from among the ISRC
members and he shall not assume office until his
appointment is first confirmed by the ISRC;
(3) Subject to the provisions of sub-article 4 of this
Constitution, a Prime Minister shall hold the office
of Prime Minister for a period of one year from the
day he is appointed to be the Prime Minister;
(4) The Prime Minister shall hold the office until: -
(a) The day he/she resigns, or
(b) The day he/she dies while in office, or
(c) The day his/her tenure of office expires, or
(d) The day the President elect is sworn in, or
(e) The day the President appoints another
member of the ISRC to hold the office of
Prime Minister, or
(f) He is removed from office following his/her
impeachment by the ISRC in accordance
with the provisions of this Constitution.
38 (1) The Prime Minister shall have the functions and authority
as follows: -
a. To assist the President to control, supervise and make
follow–up of the day to day implementation of
Organization’s plans and programs;
b. To perform all duties and functions of the office of the
President and Vice President when they are both out of
office; and

c. To co-ordinate the activities of ministries and other organs
of the Organizations.
(2) The Prime Minister shall perform his/her duties
under the direction and supervision of the President
and shall provide leadership and be answerable to
the President in respect of any matter of functions
assigned to him/her by the President;
39 1) Notwithstanding the provisions of article 31 of this
Constitution, the ISRC may pass a vote of no confidence in the
Prime Minister only if it is alleged that: -
i. He/she has committed acts which generally
violate this Constitution;
ii. He has conducted himself in such a way or
manner that lowers the esteem of the office of
the Prime Minister;
iii. Where a special resolution has been passed that
the ISRC has no confidence in the Prime
Minister through voting the Prime Minister shall
cease to hold the office;
iv. In the event that the office of the Prime Minister
is vacant pursuant to the provisions of article 36
(5) (b), (c) and (f) then as soon as possible after
the Prime Minister has ceased to hold office, the
President shall appoint a new Prime Minister
and such appointment shall be approved by the
ISRC.

PART IV
MINISTERS
40 There shall be Ministers and Deputy Ministers in every
Campus of the Institute who shall be appointed by the
President after consultation with the Prime Minister;
(1) The Ministers and Deputy Ministers shall be responsible
for their offices as the President may from time to time by
writing under his hand and the seal of the Organization
establish;
(2) All the Ministers and Deputy Ministers shall be appointed
from among the members of the SRC, and upon their
appointment they shall be the members of the Cabinet;
(3) The Ministers or Deputy Ministers shall not assume office
until they have taken and subscribed before the President,
an oath of allegiance before and any other oath relating to
the execution of the functions of their offices;
(4) Without prejudice to the provision of sub-article (1) above
the President shall appoint Ministers who shall not exceed
30% of the SRC members;
(5) The tenure of the Ministers or Deputy Ministers shall
commence on the date they are appointed to hold their
office and shall become vacant upon the occurrence of the
followings: -
i. The day he/she resigns, or
ii. The day he/she dies while in office, or
iii. The day his/she tenure of office expires, or
iv. The day the President elect is sworn in, or
v. The day the President revokes the appointment,
or
vi. Immediately before the President elect assumes
office.

PART V
THE SPEAKER
41. (1) There shall be a Speaker of the ISRC who shall be elected by the
members of ISRC of every Campus of the Institute from amongst
the ISRC members;
(2) Once a person is elected to be the Speaker of the
ISRC he/she shall cease to be the representative of the
members of whom he/she was the representing before
being so elected;
(3) The Speaker shall be elected by the ISRC within
fourteen days after the General election;
(4) The Speaker of ISRC shall be;
(a) The leader of the ISRC and shall preside
over all the meetings of the ISRC;
(b) Shall represent the ISRC in all other
institutions, organization and meetings
outside the ISRC;
(5) Subject to sub-article (2) above, the members of
whom their representative have been elected to be Speaker
of the ISRC, shall as soon as possible elect another
representative to fill the vacant post;
42. (1) The Speaker shall have the following qualifications: -
a) He/she must be fluent in English;
b) He/she must be the member of ISRC;

c) He/she must be a person of good credibility and
conduct
d) The speaker should not be a member who is the
final year of studies;
43 (1) The Speaker shall cease to hold office: -
a. If he/she violates any article of this Constitution;
b. If he/she is removed from the office by the Special Resolution
of the ISRC.
vii. Notwithstanding the provision of sub – article
(1) above, the procedures for the removal of the
Speaker shall apply mutatis mutandis as
provided under article 3 of this Constitution
save that the impeachment of the Speaker shall
be made by the ISRC upon receiving the
recommendations from the Judicial Board, and
its decision shall be final and conclusive.
PART VI
DEPUTY SPEAKER
44. There shall be a Deputy Speaker of the ISRC in every Campus
of the Institute who shall be elected by member of the ISRC from
amongst the members of the ISRC;
viii. The Deputy Speaker shall be elected within
fourteen (14) days after General Election;
ix. The Deputy Speaker shall be the principal assistant
of the Speaker of the ISRC;

x. In the performance of his/her duties the Deputy
Speaker shall: -
a. Preside over the meetings of the ISRC
in the absence of the Speaker;
b. Perform any other lawful duties as
directed by the Speaker.
xi. The reasons, circumstances and procedures for the
removal of the Deputy Speaker shall be the same as
those provided for the removal of the Speaker as
provided under article 43 (2) of this Constitution.
CHAPTER FOUR
FINANCIAL MATTERS
45. (1) The Minister responsible for finance shall be responsible for the
collection of all organization’s funds;
(2) The Minister responsible for finance shall deposit all funds
collected to the Organization’s bank account;
(3) For avoidance of doubts, financial matters shall be governed by the
organizations financial regulations as issued from time to time by
ISRC;
(4) The Internal Auditor of the Institute; or any other person
authorized by him/her shall:
a. Audit the accounts of the Organization;
b. Make available the audit report for discussion and
action by the ISRC;
(5) The management of all property of the Organization shall be the
responsibility of the government on behalf of the members;
(6) The Organization may employ the staff if;

a. The government proposes such employment and
rate of remuneration to be paid;
b. The ISRC approve such employment and
remuneration by simple majority;
(7) The ISRC shall establish a financial committee to monitor and
control the Organizations finance activities to safeguard the
Organization’s funds;
(8) The ISRC shall convene a budget session two months after the
General Election;
(9) The outgoing government shall ensure that one third (1/3) of the
budget is maintained and retained for the incoming government to
run its activities;
46. (1) The President of the Institute and the Vice President
of every Campus of the Institute shall be paid a monthly
salary and allowance as may be prescribed by the ISRC
from time to time;
(2) The office bearers and other members of the ISRC shall
be entitled to allowance, remuneration and
reimbursement of any expenses incurred by them in the
performance of their respective duties as provided by
financial by-laws.
CHAPTER FIVE
ELECTION
47. (1) There shall be General Election and by-election of the
Organization in every Campus of the Institute;
(2) The General Election and by-election shall be supervised by
the Electoral Committee elected by the ISRC from amongst the
MISO members;

(3) The Electoral Committee shall consist of not less than ten (10)
but not more than fourteen (14) members;
(4) The General Election shall be conducted three months after the
opening of the second semester of every academic year within
(21) Twenty one days.
(5) The by-election to fill the casual vacancy in any office shall be
conducted within thirty days (30) from the date of the said
office fallen vacant occurred;
(6) Where a casual vacancy occurs within three months
immediately preceding the ordinary date of the expiry of the
term of the member in respect of whom the vacancy occurs,
by-election shall not be held to fill the vacancy, but the
vacancy shall be filled at the next ordinary election.
(7) A poll shall not be conducted in any election or by-election in
which there is no contested election;
(8) Any candidate contesting for any post shall not be a member
of the final year of studies, save for Departmental
Representative, Class Representatives, Hall Chairperson and
Hall Secretaries;
(9) For the avoidance of doubt, the posts which shall be contested
for during the General Election are;
a. Presidential post;
b. Departmental Representative post;
c. Class Representative post;
d. Hall Chairpersons;
e. Hall Secretary.

48. Any student of the IRDP is eligible to contest for any post in MISO
unless he:-
(a) i. Has charged with Criminal or disciplinary offence;
ii. Has been suspended from studies;

iii. Has underperformed academically or
iv. Has been previously convicted of a criminal or disciplinary
offence.
(b) High Academic Performance with GPA at least second class
lower Division or its equivalent of not less than 3.5 points in
previous year or years of study and proven ability to sustain
leadership responsibilities without impairing academic
performance;
(c) Clean studentship record without any implications in
disorderliness or infractions of Institute rules and regulations;
(d) Being held in high esteem by members of the Organization.
(e) Of no political party affiliation or allegiance
CHAPTER SIX
MISCELLANEOUS PROVISIONS
PART I
POWERS TO MAKE RULES AND AMENDMENTS OF
THE CONSTITUTION
49. (1) The ISRC may make, amend and repeal any of rules of the
Organizational in line with the Institute law and by-laws;
(2) Any member of MISO or member of ISRC or the MISO
government on its own motion can move a motion to make or
amend or repeal a rule of the Organization through the relevant
organs;
(3) The said amendments shall not come into effect unless sanctioned
by the Student Baraza.

50 .(1) Any article(s) of this Constitution may be amended by the special;
ISRC;
(2) The special ISRC shall be composed of all members of the ISRC at
the main Campus and not less than five members from each
Campus of IRDP and shall sit at the main Campus;
(3) The motion of amendment of any articles of this Constitution shall
be presented by the government or any ISRC member;
(4) Subject to sub-article (3) above if the motion is presented by ISRC
member, a written notice specifying the articles(s) proposed to be
amended should be supported and signed by two third (2/3) of
ISRC members and lodged to the ISRC Secretariat fourteen days
(14) prior to the ISRC meeting;
(5) Where two third 2/3 of ISRC members support the motion through
vote, the ISRC shall form a Constitution Committee of seven
members amongst the ISRC members, which will be vested with
the duty to draft such amendment of the articles of the
Constitution;
(6) The Chairperson and the Secretaries of Constitution Committee
from each Campus shall form a joint committee which shall
prepare a joint - report emanating from each committee report and
present the same to the Special ISRC for deliberations and
adoption the decision of which shall be met by the support of two
third (2/3) of members from each campus sitting in the Special
ISRC.
Provided that the member who initiates such a motion shall not
form part of the Constitution Committee.
PART II
MANAGEMENT OF PROPERTIES AND CONTRACTS
38
Special ISRC on
amendment
51.(1) The management of the properties of the MISO shall be the
responsibility of the student’s government which shall be
answerable to the ISRC and the Baraza;
(2) Matters relating to contract shall after negotiation by the relevant
person or ministry be presented to the ISRC for discussion before
signed by the relevant person;
(3) Unless otherwise agreed any contract shall not exceed one
academic year.
52.(1) The record of the Organization shall be kept in Organization
Official documents
(2) No member or group of students shall use the title of the
Organization without the written consent of the Prime Minister;
53. (1) If any subject or matter is not covered by the provisions of this
Constitution then such matter(s) shall be placed before the
ISRC for discussion and deliberations;
(2) The regulations and by-laws amendment under the previous
Constitution of 2009 shall be in use while pending the
enactment of new by-laws and regulations;
(3) Where the regulations and by-laws conflict with any other
MISO laws, purposive approach shall be adopted in
interpreting the regulations and by-laws. However in all cases
the MISO Constitution of 2012 shall be the guidelines to all
regulations and by-laws;
54. This Constitution shall be referred to as the Constitution of IRDP
Students organization of 2012;
55. This Constitution shall come into operation upon the approval of the
Institute Board of Trustee.

  • 1. PREAMBLE WHERE AS the Students of the IRDP understand and believe that the Institute plays its role under the Institute of Rural Development Planning Act of 1980 which established the Institute and that naturally this makes the Institute serve the nation in its own unique environment and systems; AND WHERE AS the students understand and believe that through a democratic Students’ Organization run by the democratically elected students will be their true voice and responsible to promote and maintain student affairs and the interests of students to its best Level; AND WHERE AS the students understand and believe that Students Organization that is semi- autonomous will to the greater extent promote, improve and maintain cordial relationship between students, the Institute administration and the IRDP community, other learning Institutions and their Organizations and youths in and outside Tanzania. NOW, THEREFORE, we members of the Institute Students Representative Council (ISRC), noting that the ISRC Constitutional Committee was established to represent us in preparing the draft of the Constitution; DO HEREBY in and through this Institute Students Representative Council sitting as the Special Constituent Assembly, solemnly adopt, enact and give to ourselves and our prosperity, this Constitution of IRDP Student Organization of 2012 on behalf of all the Organization members, for the purpose of giving effect to the above interest and belief. 1
  • 2. CHAPTER ONE THE ORGANIZATION, INTERPRETATIONS AND MEMBERSHIP PART I THE ORGANIZATION AND INTERPRETATIONS 1. (1) The Name of the Organization shall be ‘The Mipango Students Organization’ here in after referred to as the “MISO” (2) The headquarter of the Organization shall be at Institute of Rural Development Planning main Campus. 2. In this Constitution unless the context otherwise requires; “Affiliation” - Means the students organizations and approved by Council of Governing Board; “Baraza” - Means the general meeting of all students in each of the IRDP convened with the approval of the Deputy Rector – Academic. “By elections” - Means elections, which are conducted to fill the vacant posts; “Cabinet” - Means the Cabinet of the Mipango Student Organization; 2 Interpretation Name of the Organization
  • 3. “Campus” - Means the Campuses of IRDP “Class Representative” - Means the Chairperson and Assistant Chairperson elected by the students of each class as a representative; “Dean of Students” - Means the Dean of students of IRDP “Departmental Representative” - Means the students who will represent other students of every department in the departmental boards and any other meetings in the department level; “Extra Ordinary Meeting”- Means any meeting other than ordinary meeting; “Faculty Representative” - Means the students who will represent other students of every faculty in the faculty boards and any other meetings in the faculty level; “Government” - Means Government of Mipango Students Organization; “ISRC” - Means Institute Students Representatives Council; “Member” - Means the member of Mipango Students Organization; “Minister” - Means a Minister and Deputy 3

Minister of the Organization; “MISO Judicial Board” - Means the Committee Constituted under the Article 21 of the Constitution; “Ordinary decision” - Means any decision which shall be supported by a simple majority in any MISO organs meetings; “Ordinary resolution”- Means other resolution which shall be supported by a simple majority “Organization” - Means Mipango Students Organization established under Section 49 (2) of the Universities Act, 2005 and G.N No 178/2011; “President” - Means the President of MISO Government in every Campus of the Institute; “Prime Minister”- Means the Prime Minister of MISO government in every Campus of the Institute; “Rule” - Means rules made by the ISRC under the provisions of this Constitution; “Secretariat” - Means the ISRC secretariat 4
  • 5. established under Article 17 of this Constitution; “Speaker” - Means the person, who shall chair and preside over the meetings of the ISRC and shall be elected as provided for in this Constitution; “Special decisions” - Means decision reached on and supported by two thirds of the member of MISO organs physically present and voting on impeachment, boycott, strikes and Constitution amendments; Special ISRC - Means the ISRC established under Article 50 of this constitution which is vested with powers and duties to deal with the amendments of this constitution. “Special resolution” - Means a resolution of the students Baraza which is supported by two third of the members physically present and voting; “Status” - Means the status of MISO as described under this Constitution; “Student” - Means any person admitted to the Institute of Rural Development 5

Planning as candidate for any award of the Institute and studying under any of its programmes; “Students Organization” Means an Organization approved by the Board of Trustee being an Organization representative of the Student of the Institute. “The Institute” - Means the Institute of Rural Development Planning established by section 3 of the IRDP Act of 1980; “Vice President” - Means the Vice President of “MISO” Government in every Campus of the Institute; 3. The official language of the Organization shall be English and Kiswahili; 4. The Status of the Organization shall be Student’s Organization of the Institute, quasi autonomous, non-governmental organization which shall endeavor to fulfill its objectives to the best interests of its members and in accordance with the established, recognized and approved procedures by IRDP Act of 1980. PART II OBJECTIVES AND FUNCTIONS OF THE ORGANIZATION 5. The objectives of Students Organization shall be: - 6 Objectives of MISO The Language of the Organization The Status of the Organization
  • 7. i. To promote and maintain students interests during their tenure at the Institute without violating any Institute by – laws; ii. To establish a proper organizational basis for communication between the Institute authorities and students iii. To maintain harmonious relations between students and academic members of staff, the Institute administration, non academic staff, and the Institute community in general; iv. To promote and maintain respect for learning and the pursuit of truth, and to ensure that every student understand his responsibility to educate himself to the best of his capabilities in so doing cherish and promote academic freedom as an inalienable right of student at the institute; v. To stimulate and promote all desirable aspects of cultural development which inculcate the spirit and love for music, sports and art(s) in order to keep talents are developed; vi. To maintain and promote fraternal relations with other student institutions and alliances of higher learning in and outside Tanzania; vii. To do all such other things as may be conducive to the attainment of the foregoing objective or any one of them and to question any other things whatsoever, which appears to compromise the status of the Organization; viii. To promote and maintain tranquility, democracy and co-operation among students of the institute regardless of differences in nationalities and other diversities; ix. To facilitate student participation in contemporary issues in which the nation is interested; x. To deliberate on matter(s) that appears to affect the status of the Organization. ons 6. In pursuit of its objectives stated under Article 5 of this Constitution 7 Function of the MISO
  • 8. the Organization may carry out any or all of the following functions; (1) To initiate, sponsor, or undertake activities for benefit of the members of the organization; (2) To organize debates, seminars, workshops conferences, congress, study tours and symposia to enhance intellectual and socio- economic awareness of the members of the organization; (3) To mobilize funds and sponsor students research in all academic field in order to promote creativity and originally on matters of intellectual interest to the scholarly community and the nation; (4) To publish, broadcast and print through the mass media its own journals, books news papers, leaflets, magazines, recording, or publish through any other means of presenting information to the public; (5) To invite, with the approval of the Institute management the distinguished personalities, to interact with the members of the organization by way of lecturer, panel or group discussion, workshops, or any other means that would promote a health discussion of contemporary social, scientific and political issues; (6) To correspond and communicate or otherwise promote relationship between the students’ organization and any other organizations which the organization shares and promote common objective; (7) To organize and co-ordinate student activities in pursuance of their rights and welfare in conformity with the objectives and status of the organization; (8) To assist in the counseling of members with regard to their academic, social and disciplinary matters; (9) To undertake any other activity or function in conformity with objectives of the organization. 8
  • 9. PART THREE MEMBERSHIP, RIGHTS AND OBLIGATION OF THE MEMBERS 7. (1) Every student of the Institute shall be a member of the Organization upon his registration as a student and his membership shall cease upon the cessation of his studentship; (2) Every member shall pay an annual subscription fee as may be prescribed from time to time by ISRC. 8. Every member of the Organization has: - (1) Right to vote and hold office when elected or appointed provided he meets the laid down regulations of election by-laws; (2) Right to obtain and inspect any public document of the Organization from request to the Prime Minister; (3) Right to request any publication of the Organization as shall be determined by the ISRC; (4) Freedom of opinion and expression of his ideas before any organ of the Organization; (5) Right to be informed at all times of various important events and issues of the Organization likely to affect his welfare at the Campus. Provided that, every member shall enjoy these rights without violating the Institute by-laws and regulations. 9. Every member of the organization shall be obliged to: - a. Uphold this Constitution; b. Educate oneself to the best of ones ability; c. Pay fees and subscriptions when due; d. Be an example of self discipline and academic responsibility; 9 MISO Membership Obligation to members Rights of MISO Members
  • 10. e. Participate in all activities leading to fulfillment of the objectives of the Organization; f. Refrain from taking part or conducting or influencing MISO members or office bearers to take part or conduct themselves in any manner likely to affect the status of MISO. 10 (i) The decisions concerning the following matters shall not be made by any organ except through a referendum, involving all registered members of the Organization: - (b) any decision likely to affect delivery of students services; (c) any decision likely to interrupt academic programs; (d) any proposed cause of action likely to cause breach of peace; ii. The Dean of students, the President, the Speaker and the Chairperson of the MISO Board shall be responsible to ensure that any referendum is conducted in manner that guarantees the exercise of free will by every member; iii. A decision reached by the referendum shall prevail and be binding upon all members and the Organization shall be obliged to implement it forthwith. CHAPTER TWO PART I ORGANS OF THE ORGANIZATION 11. There shall be the organs of the organization as follows: - (1) The Student Baraza at the Campus level; (2) The Students Representative Council at the Campus 10 Decision to be made by a referendum The organs of the Organization
  • 11. Levels; (3) The Government at the Campus level; (4) The MISO Judicial BOARD at the Campus level; (5) The Hall Baraza at Hall level. PART II MISO STUDENTS BARAZA 12. (1) There shall be established a Student Baraza at every Campus of the Institute composed of a particular Campus; (2) The Student Baraza at every Campus shall be the supreme organ of the Organization at the particular Campus; (3) (a) The Student Baraza at every Campus shall convene ordinarily twice per semester on such a date as provided for in the almanac of the Organization; (b) Extra – ordinary Student Baraza may convened at any time provided that the Secretary General shall issue a two (2) days public notice of such Baraza when so directed by the ISRC or by the President or upon the receipt of a petition signed by two third (2/3) of the members of ISRC. (4) Without prejudice to the provisions of sub-article (2) above, the extra – ordinary Baraza for the impeachment of the President or the Vice President shall be summoned by the Clerk of the ISRC upon receiving directives of the ISRC; (5) The quorum of the Baraza shall be not less than one half (1/2) of the members; (6) The Baraza shall be presided over by the President and in case of his absence or any reason preventing him from 11 Establishment of Student s BARAZA
  • 12. presiding over the same, the Vice President shall preside over the meetings of the Baraza; (7) Without prejudice to the provision of sub-article (6) above, where the Baraza is concerned with the accusation of, or impeachment of the President or the Vice President or both, the Baraza shall be presided over by the Chairperson of the MISO Board; (8) The decision of the Students Baraza shall be of two types, thus are: - (a) Special decision, and (b) Ordinary decision. (9) The functions of the Students Baraza at the Campus level shall be: - (a) To oversee the activities of all other organs of the Organization; (b) To discuss all matters of interests to members without prejudice to the IRDP laws and any Institute by-laws; (c )To make final decisions on the recommendations of ISRC including votes of no confidence to the President or Vice President severally or jointly; (d) The Student Baraza may delegate any of its powers to the ISRC as it may deem fit. PART III INSTITUTE STUDENTS’ REPRESENTATIVES COUNCIL 13. (1) There shall be an Institute Students Representatives Council (ISRC) at every Campus. 12 Establishment of ISRC

The ISRC shall convene two ordinary meetings in a semester; (a) The ordinary meetings shall be scheduled by the ISRC itself, whereby the notice shall be issued by the Clerk; (b) There shall be an extra–ordinary meeting of the ISRC which shall be convened upon the deliberations by the ISRC Secretariat, where upon the ISRC Clerk shall issue a reasonable notice to that effect; (2) The quorum for the ISRC meetings shall be not less than two third (2/3) of the members; (3) There shall be two types of decisions of the ISRC, which are: - (a) Special decision, and (b) Ordinary decision. (4) Without prejudice to sub-article (3) above ordinary decision of the ISRC shall be reached by simple majority, but for avoidance of doubt special decision shall require two third (2/3) of the votes of the members attended the meeting; (5) The ISRC meetings shall be presided over by the Speaker or the Deputy Speaker of the ISRC; (6) In the absence of the Speaker and the Deputy Speaker the ISRC members shall elect one member, who is not a cabinet member, to preside over the meeting as the Chairperson. 14. (1) All meeting of ISRC shall be composed of:- 1. The Speaker; 2. The Deputy Speaker; 3. The Chief Clerk; 4. The Prime Minister; 5. The Ministers of MISO government; 13 Coram of ISRC
  • 14. 6. Departmental Representatives; 7. Class Representatives; Member of parliament 8. Hall of residence Chairpersons; 9. One representative elected from respective affiliations; 10. Two representatives of the disabled members, one male and one female to be appointed by the President; ii. Notwithstanding the provision of Article 14 (1) (f) of this Article, the departments that shall have representation are those running academic programs. 15. The ISRC shall have power to: - (i) Make, amend or repeal any rules of the organization; (ii) Amend the Constitution of the organization; (iii) Confirm the Prime Minister appointed by the President; (iv)Receive, consider and approve or disapprove policies of the MISO; (v) Receive and consider the annual general handing over report of the activities of the MISO government; (vi)Approve budget estimates of MISO government prepared and presented by Minister responsible at the budget session; (vii) Make provisions for regular auditing of books of account(s) of MISO organs to ensure efficient administration of Organization’s Funds; 14

(viii) Discuss the report of the Internal Auditor of the institute or any other independent External Auditor; (ix)Summon any member of government either individually or collectively for the purposes of enhancing accountability of MISO government; (x) Punish any member of ISRC for malpractices, corruption and other misconduct tarnishing the image of the ISRC and or the members present and voting shall have approved for such a disciplinary action; The discipline action may include the severe written warning or suspension from the ISRC; (i) Establish committees as may be found necessary for the execution of its functions; (ii) To elect two members to be members of the ISRC secretariat; (iii) Perform any other lawful duties as the Student’s Baraza my direct from time to time. 16. The ISRC shall make the regulations to control the activities of the ISRC meetings. 17. (1) There shall be a Secretariat of the ISRC which shall composed of four members: - i. The Clerk of the ISRC who shall be appointed by the President and approved by the ISRC before assuming the office; ii. One member appointed by the Speaker from outside the ISRC and approved by the ISRC before assuming the office; 15 Regulation to be made by ISRC Quorum of Secretariat of the ISRC
  • 16. iii. Two members elected amongst the ISRC members who shall not be cabinet members of whom one shall be female and the other a male; (2) The Secretariat of the ISRC, under the leadership of the Clerk shall discharge all duties and functions prescribed for the purpose of ensuring efficient discharge of the ISRC functions by the ISRC members; (3) Without prejudice to the generality of sub-article (2) (a) and (b), the President and Speaker, as the case may be, once appointed members to the Secretariat shall have no power to remove a member from the Secretariat; (4) The power to remove members of the Secretariat shall be vested in the ISRC. 18. The functions of the Secretariat to the ISRC shall be to: - i. deliberate the agenda of the ISRC meetings; ii. carry out clerical and financial activities of the ISRC; iii. keep minutes and other records of the meetings of the ISRC; iv. establish the database of the members of the ISRC by their names; v. receive bills and motions from the government and members of ISRC; vi. deliberate on the question of the extra-ordinary meetings of the ISRC after receiving an application 16 Function of the Secretariat
  • 17. either from the government or any of the ISRC members; 19. (1) Subject to the provisions of this Constitution, the tenure of office of the members of the Secretariat of the ISRC shall be one year; (2) Without prejudice to the generality of sub-article (1) above the tenure of office of the Secretariat shall run concurrently with the term of the ISRC; In case the Clerk of the ISRC is accused of any misconduct or malpractice or corruption or breach of any of the provisions of this Constitution, any member of the MISO may file a petition to the MISO Board. PART IV THE CABINET 20 (1) There shall be a cabinet at every Campus of the Institute, the members of which shall be the President, the Vice President, the Prime Minister and all the Ministers. (2) The President shall attend the meetings of the Cabinet and shall preside over all Cabinet meetings. In the event that the President is absent, the meeting shall be presided over by the Vice President, and if both the President and the Vice President are absent, the Prime Minister shall preside over the meetings; (3) Subject to the provisions of this Constitution, the Cabinet shall be principal organ for advising the President on all matters regarding the exercise of his powers in accordance 17 Tenure of the Secretariat Establishment of Cabinet
  • 18. with this Constitution, and shall be accountable to the President; (4) The tenure of office of Cabinet members shall commence on the date they are appointed to hold that office and shall become vacant upon the occurrence of any of the following events: - a. If the incumbent resigns or dies; b. If the MISO government is removed; c. Where the incumbent ceases to be a member of MISO; d. If he violates any of the provisions of this Constitution as determined by the MISO Board; e. Where the President revokes the appointment thereby removing the incumbent from office; (5) For the avoidance of doubts, Cabinet members other than the Vice President and the Prime Minister, shall hold office at the pleasure of the President, and shall not be paid any salary except allowances and other remuneration in accordance with rules or regulations made by the ISRC. (6) The Prime Minister shall be the Secretary of the Cabinet meetings. PART V THE MISO JUDICIAL BOARD 21. (1) There is hereby established a MISO judicial Board in every Campus of the Institute which shall be composed of six members appointed by the President as follows: - (a) Three members appointed from academic departments; (b) Two members from religious affiliations recognized by the Institute; 18 Establishment of MISO Judicial Board

(c) Two most senior class persons with experience in dispute resolutions; (2) In complying with the requirements under sub – article 1 (b) above, the President shall receive the recommendations of the names to be appointed as members of the Board from religious affiliations; (3) The members of the Judicial Board shall be neither a member of the ISRC nor Cabinet and where a member of either ISRC or Cabinet is appointed and accepts such appointment he will immediately cease to be a member of ISRC or Cabinet. (4) Notwithstanding the provision of sub article (1) above, the President shall not have power to remove any member from the Board. 22. There shall be a Chairperson and Secretary to the Judicial Board who shall be elected from amongst the members of the Judicial Board. 23. The tenure of office of the Board shall be one year, which shall expire upon the appointment of the new Board although they may be reappointed. 24. The MISO Judicial Board shall have power to: - (a) Interpret the Constitution, by laws and rules of the Organization which shall be final and conclusive; (b) Act as disciplinary authority to the Organizations office bearers and its decision shall be final and conclusive. 19 Election of Chairman and Secretary of MISO Judicial Board Tenure of MISO Judicial Board Powers of MISO Judicial Board

As for the President, the Vice President, the Speaker, the Deputy Speaker and the Clerk of the Organization, the Board shall recommend the necessary sanctions to the ISRC as the case may be; 26. For the avoidance of doubts the Board shall have other functions as follows: - a. To investigate and recommend to the President appropriate disciplinary and legal measures against any Cabinet member other than the President and the Vice President of malpractices, corruption and any other misconduct; failure of which the Board may on its own discretion proceed to the ISRC; b. The Board may act as the arbiter in disputes among the students with a view to promoting harmony and tranquility; c. The Board shall assume powers of the Cabinet where in any circumstances the Cabinet does not exist; d. The Board shall have power to receive or review or revise, or hear and determine any appeal brought to it by any aggrieved member on the decision made by Electoral Committee and any other organ of the Organization; e. For purpose of expediency and when need arises the Board may invite the President, the Vice President, the Speaker or any other office bearer as the circumstances may require to attend Board meetings and give clarifications, evidence or opinions on any matter that need their attendance. 20 Recommendation from the Board of the ISRC Function of the MISO Judicial Board
  • 21. 27. (1) Upon receiving the allegations and complains of misconduct and bad behavior of any member, the Board shall have power: - a. Summon the member against whom the complains and allegations is made; b. Counsel, advice and warn the alleged member with regards to such misconduct or behavior; 28. The alleged member having been warned more than twice of misconduct or bad behavior shall be regarded as hardcore and the MISO Board shall make any necessary recommendations to the Institute administration on the same complains and allegations for further disciplinary action to be initiated against him. PART VI HALL STUDENTS BARAZA 29. (1) There shall be a Hall students Baraza at Hall level in every Campus of the Institute composed of all students residing in the respective Hall; i) The Hall students Baraza shall be summoned and presided over by the Hall Chairperson or the Hall Secretary in case the Chairperson is absent; ii) The functions of the Hall student Baraza shall be to discuss all matters relating to the welfare of members of the respective Hall; iii) The Hall Student Baraza can be summoned at any time when the need so to do arises and the decision of the Baraza shall be taken to MISO government; 21 Procedure after receiving allegation MISO judicial Board to make recommendation to the Institute Administration for disciplinary action Establishment of Hall students Baraza
  • 22. iv) The election of Hall Chairperson and Hall Secretary shall be conducted at the beginning of every semester, in accordance with the provisions of this Constitution; CHAPTER THREE OFFICE BEARERS PART I PRESIDENT 1. There shall be a President of the Organization who shall be the head of the Organization and MISO government at the main Campus; 23. Any person who is a member of the Organization shall be entitled to be elected to hold office of the President provided that he fulfills the requirements of the election by- laws; 24. The President shall be elected by members in an election participated by not less than 60% of all members of the Organization at the Campus, and in accordance with the election by – laws of the Organization pursuant to this Constitution; 25. Any Presidential candidate, in any contested election shall be declared to have been dully elected as a President only if he/she has obtained the majority of votes; 26. The Presidential candidate, in the general election shall submit to the Electoral Committee not less than three 22 The President
  • 23. names of members of whom one among them he/she proposes to be his running mate for the office of the Vice President; 27. Subject to the provision of sub–article (5) above, the Electoral Committee after receiving the proposed names for the Presidential candidate, shall conduct a screening and return to the candidate the names of those who qualify to the post of the Vice President for him to nominate one name to be his running mate; 28. The President elect shall assume office of the President as soon as possible having been declared as a President. 29. Subject to the provisions of sub-article 10 of this article, the President shall hold office of the President for a period of one year from a date on which he was elected; 30. A person elected President shall hold office of President until: - 1. The day his successor takes an oath of office; 2. The day he dies while in the office; 3. The day he resigns from office; 4. He ceases to hold the office of the President in accordance with the provisions of this Constitution. 31. Every President elect and every person assuming the office of the President shall, before assuming the functions of the 23
  • 24. office of the President, take and subscribe an oath before the Commissioner for Oaths. 33. 31. The President shall have authority: - a. to supervise implementation of the decisions made by the ISRC and the Students’ Baraza at the campus. b. to appoint the: - i. Clerk of the ISRC; ii. Members of the Miso Board; iii. Disabled members to the ISRC; iv. Ministers and Deputy Ministers; v. Prime Minister with the approval of the ISRC; vi. Representatives to the Departments of the Institute. c. Without prejudice to the provisions of sub-article 2 of this article, the President when making appointment shall ensure proportional representation of all members including postgraduate students, members in each academic year, and gender balance; d. Without prejudice to provision of sub-article 2 and 3 of this article, the President shall appoint a Minister(s) who shall be responsible for post graduate matters and linkage of the government and Postgraduate students; e. To preside over the meetings of the Cabinet and Students Baraza and other meetings at the Campus where necessary; f. To link the Miso Organization and the Institute management; g. To perform any other duties inconformity with the Organizations objectives for the benefit of the members of the Organization at the Campus. 24 Power of the President
  • 25. 32. Subject to the other provisions of this Constitution, the office of President shall fall vacant and the election of the President shall be held or that vacancy shall be filled otherwise in this Constitution, as the case may be, upon the occurrence of any of the following events: - a. death of the President; b. resignation of the President; c. impeachment of the President by the ISRC; d. discontinuation from studies of the President; e. if charged and found guilty of disciplinary and criminal offense(s) and suspended by the Institute; f. any of the occurrences that make the President incapable of discharging his office duties for three months consecutively. 33. (1) The ISRC may pass a resolution to remove the President from office if a motion to impeach the President is moved and passed in accordance with the provisions of this Constitution only if it is alleged that he/she has: - 1. committed acts, which generally violate this Constitution; 2. conducted himself in a manner which lowers the esteem of the office of the President of MISO. 2. The ISRC shall not pass a motion to impeach the President save only if: - a. a written notice signed and supported by one half (1/2) of the ISRC members is served to the Speaker seven (7) days prior to the sitting at which such motion is intended to be moved in the ISRC, the notice shall specify the wrong committed by the President and propose a Special Committee of 25 President’s Election to beheld to Vacant post ISRC Resolution and motion to impeach the President

Inquiry to be constituted to inquire into the charges brought against the President; b. after receipt of the notice duly signed by the required number of members of the ISRC and satisfies himself that the provisions for moving of the motion have been complied with, the Speaker shall announce the names of the member of the Special Committee of Inquiry who shall be approved by the ISRC; c. The Committee shall carry out investigation to inquire into the charges submitted against the President, and submit the report to the Speaker within fourteen days (14) from the date it was constituted; d. after receipt of the report of the Special Committee of Inquiry, the Speaker shall table it before the ISRC; the ISRC shall discuss the report and give the President an opportunity to be heard; e. The ISRC after going through the report shall after affording the President an opportunity to be heard and by majority of votes of all the members of the ISRC pass a resolution that either the charges against the President have been proved or not; f. In the event that the ISRC passes a resolution that the charges against the President have been proved and that he is unworthy of continuing to hold the office of the President, the Speaker shall inform the President about the resolution; g. The ISRC members having supported the impeachment of the President by majority of votes shall summon the Students Baraza; 26
  • 27. h. The decision of the Students Baraza for the impeachment of the President shall be by the special resolution; i. The President shall cease to hold office immediately and shall be obliged to resign where the special resolution for impeachment is passed. 3. Without prejudice to the generality of sub–article 2 (c) above the ISRC shall deal with the allegations within fourteen (14) days of which the President shall be present in person and be given an opportunity to be heard; PART TWO THE VICE PRESIDENT 34. (1) There shall be the Vice President of the Organization at every Campus of the Institute who shall be the principal assistant to the President in respect to all matters concerning the members generally and, in particular shall: - (a) Assist the President in making follow up on day to day activities of the Organization’s plans and programs; (b) Assume office of the President when the President resigns for any reason, or be removed from his office in accordance with the provisions of this Constitution or when the President cease to a member for any reasons; (c) Perform all duties assigned to him by the President; (d) Perform all duties and functions of the office of the President when the President is out of office; and (e) Perform his duties under the direction of the President and shall be answerable to the President in respect of 27 Vice President
  • 28. any matters or functions assigned to him by the President. ii. The Vice President shall contest as the running mate of the Presidential candidate. 35 (1) The Vice President shall assume the office on the same day the President assume office and hold office until: - a) He/she resigns; b) He/she dies while in office; c) His/her tenure of office expires; d) He/she is discontinued from studies; e) He/she sworn in as President after the office of the President has fallen vacant. 36. The reasons, circumstance and procedures for the impeachment of the Vice President shall apply mutatis mutandis as those provided for the impeachment of the President in article 28 of this Constitution. PART III THE PRIME MINISTER 37. (1) There shall be a Prime Minister of the Organization who shall be appointed by the President in accordance with the provisions of this Constitution and who before assuming his office shall take and subscribe before the President such an oath of allegiance of the office of Prime Minister; 28 The Office of Vice President Prime Ministers Procedures of impeachment of the Vice President

(2) Soon as possible and in any event within seven (7) days after assuming his office the President shall appoint the Prime Minister from among the ISRC members and he shall not assume office until his appointment is first confirmed by the ISRC; (3) Subject to the provisions of sub-article 4 of this Constitution, a Prime Minister shall hold the office of Prime Minister for a period of one year from the day he is appointed to be the Prime Minister; (4) The Prime Minister shall hold the office until: - (a) The day he/she resigns, or (b) The day he/she dies while in office, or (c) The day his/her tenure of office expires, or (d) The day the President elect is sworn in, or (e) The day the President appoints another member of the ISRC to hold the office of Prime Minister, or (f) He is removed from office following his/her impeachment by the ISRC in accordance with the provisions of this Constitution. 38 (1) The Prime Minister shall have the functions and authority as follows: - a. To assist the President to control, supervise and make follow–up of the day to day implementation of Organization’s plans and programs; b. To perform all duties and functions of the office of the President and Vice President when they are both out of office; and 29 Power and function of the office of Prime Minister
  • 30. c. To co-ordinate the activities of ministries and other organs of the Organizations. (2) The Prime Minister shall perform his/her duties under the direction and supervision of the President and shall provide leadership and be answerable to the President in respect of any matter of functions assigned to him/her by the President; 39 1) Notwithstanding the provisions of article 31 of this Constitution, the ISRC may pass a vote of no confidence in the Prime Minister only if it is alleged that: - i. He/she has committed acts which generally violate this Constitution; ii. He has conducted himself in such a way or manner that lowers the esteem of the office of the Prime Minister; iii. Where a special resolution has been passed that the ISRC has no confidence in the Prime Minister through voting the Prime Minister shall cease to hold the office; iv. In the event that the office of the Prime Minister is vacant pursuant to the provisions of article 36 (5) (b), (c) and (f) then as soon as possible after the Prime Minister has ceased to hold office, the President shall appoint a new Prime Minister and such appointment shall be approved by the ISRC. 30 Vote of no confidence against Prime Minister

PART IV MINISTERS 40 There shall be Ministers and Deputy Ministers in every Campus of the Institute who shall be appointed by the President after consultation with the Prime Minister; (1) The Ministers and Deputy Ministers shall be responsible for their offices as the President may from time to time by writing under his hand and the seal of the Organization establish; (2) All the Ministers and Deputy Ministers shall be appointed from among the members of the SRC, and upon their appointment they shall be the members of the Cabinet; (3) The Ministers or Deputy Ministers shall not assume office until they have taken and subscribed before the President, an oath of allegiance before and any other oath relating to the execution of the functions of their offices; (4) Without prejudice to the provision of sub-article (1) above the President shall appoint Ministers who shall not exceed 30% of the SRC members; (5) The tenure of the Ministers or Deputy Ministers shall commence on the date they are appointed to hold their office and shall become vacant upon the occurrence of the followings: - i. The day he/she resigns, or ii. The day he/she dies while in office, or iii. The day his/she tenure of office expires, or iv. The day the President elect is sworn in, or v. The day the President revokes the appointment, or vi. Immediately before the President elect assumes office. 31 Ministers and Deputies
  • 32. PART V THE SPEAKER 41. (1) There shall be a Speaker of the ISRC who shall be elected by the members of ISRC of every Campus of the Institute from amongst the ISRC members; (2) Once a person is elected to be the Speaker of the ISRC he/she shall cease to be the representative of the members of whom he/she was the representing before being so elected; (3) The Speaker shall be elected by the ISRC within fourteen days after the General election; (4) The Speaker of ISRC shall be; (a) The leader of the ISRC and shall preside over all the meetings of the ISRC; (b) Shall represent the ISRC in all other institutions, organization and meetings outside the ISRC; (5) Subject to sub-article (2) above, the members of whom their representative have been elected to be Speaker of the ISRC, shall as soon as possible elect another representative to fill the vacant post; 42. (1) The Speaker shall have the following qualifications: - a) He/she must be fluent in English; b) He/she must be the member of ISRC; 32 Qualification of the speaker Qualification of the speaker
  • 33. c) He/she must be a person of good credibility and conduct d) The speaker should not be a member who is the final year of studies; 43 (1) The Speaker shall cease to hold office: - a. If he/she violates any article of this Constitution; b. If he/she is removed from the office by the Special Resolution of the ISRC. vii. Notwithstanding the provision of sub – article (1) above, the procedures for the removal of the Speaker shall apply mutatis mutandis as provided under article 3 of this Constitution save that the impeachment of the Speaker shall be made by the ISRC upon receiving the recommendations from the Judicial Board, and its decision shall be final and conclusive. PART VI DEPUTY SPEAKER 44. There shall be a Deputy Speaker of the ISRC in every Campus of the Institute who shall be elected by member of the ISRC from amongst the members of the ISRC; viii. The Deputy Speaker shall be elected within fourteen (14) days after General Election; ix. The Deputy Speaker shall be the principal assistant of the Speaker of the ISRC; 33 The procedure of removing of the speaker and cease to hold the office Deputy speaker
  • 34. x. In the performance of his/her duties the Deputy Speaker shall: - a. Preside over the meetings of the ISRC in the absence of the Speaker; b. Perform any other lawful duties as directed by the Speaker. xi. The reasons, circumstances and procedures for the removal of the Deputy Speaker shall be the same as those provided for the removal of the Speaker as provided under article 43 (2) of this Constitution. CHAPTER FOUR FINANCIAL MATTERS 45. (1) The Minister responsible for finance shall be responsible for the collection of all organization’s funds; (2) The Minister responsible for finance shall deposit all funds collected to the Organization’s bank account; (3) For avoidance of doubts, financial matters shall be governed by the organizations financial regulations as issued from time to time by ISRC; (4) The Internal Auditor of the Institute; or any other person authorized by him/her shall: a. Audit the accounts of the Organization; b. Make available the audit report for discussion and action by the ISRC; (5) The management of all property of the Organization shall be the responsibility of the government on behalf of the members; (6) The Organization may employ the staff if; 34 Responsibilities of the Minister of Finance
  • 35. a. The government proposes such employment and rate of remuneration to be paid; b. The ISRC approve such employment and remuneration by simple majority; (7) The ISRC shall establish a financial committee to monitor and control the Organizations finance activities to safeguard the Organization’s funds; (8) The ISRC shall convene a budget session two months after the General Election; (9) The outgoing government shall ensure that one third (1/3) of the budget is maintained and retained for the incoming government to run its activities; 46. (1) The President of the Institute and the Vice President of every Campus of the Institute shall be paid a monthly salary and allowance as may be prescribed by the ISRC from time to time; (2) The office bearers and other members of the ISRC shall be entitled to allowance, remuneration and reimbursement of any expenses incurred by them in the performance of their respective duties as provided by financial by-laws. CHAPTER FIVE ELECTION 47. (1) There shall be General Election and by-election of the Organization in every Campus of the Institute; (2) The General Election and by-election shall be supervised by the Electoral Committee elected by the ISRC from amongst the MISO members; 35 Salary and allowance to the President and Vice President General Election

(3) The Electoral Committee shall consist of not less than ten (10) but not more than fourteen (14) members; (4) The General Election shall be conducted three months after the opening of the second semester of every academic year within (21) Twenty one days. (5) The by-election to fill the casual vacancy in any office shall be conducted within thirty days (30) from the date of the said office fallen vacant occurred; (6) Where a casual vacancy occurs within three months immediately preceding the ordinary date of the expiry of the term of the member in respect of whom the vacancy occurs, by-election shall not be held to fill the vacancy, but the vacancy shall be filled at the next ordinary election. (7) A poll shall not be conducted in any election or by-election in which there is no contested election; (8) Any candidate contesting for any post shall not be a member of the final year of studies, save for Departmental Representative, Class Representatives, Hall Chairperson and Hall Secretaries; (9) For the avoidance of doubt, the posts which shall be contested for during the General Election are; a. Presidential post; b. Departmental Representative post; c. Class Representative post; d. Hall Chairpersons; e. Hall Secretary. qwe2 48. Any student of the IRDP is eligible to contest for any post in MISO unless he:- (a) i. Has charged with Criminal or disciplinary offence; ii. Has been suspended from studies; 36 Qualification on holding MISO office
  • 37. iii. Has underperformed academically or iv. Has been previously convicted of a criminal or disciplinary offence. (b) High Academic Performance with GPA at least second class lower Division or its equivalent of not less than 3.5 points in previous year or years of study and proven ability to sustain leadership responsibilities without impairing academic performance; (c) Clean studentship record without any implications in disorderliness or infractions of Institute rules and regulations; (d) Being held in high esteem by members of the Organization. (e) Of no political party affiliation or allegiance CHAPTER SIX MISCELLANEOUS PROVISIONS PART I POWERS TO MAKE RULES AND AMENDMENTS OF THE CONSTITUTION 49. (1) The ISRC may make, amend and repeal any of rules of the Organizational in line with the Institute law and by-laws; (2) Any member of MISO or member of ISRC or the MISO government on its own motion can move a motion to make or amend or repeal a rule of the Organization through the relevant organs; (3) The said amendments shall not come into effect unless sanctioned by the Student Baraza. 37 Make and amendment of the constitution
  • 38. 50 .(1) Any article(s) of this Constitution may be amended by the special; ISRC; (2) The special ISRC shall be composed of all members of the ISRC at the main Campus and not less than five members from each Campus of IRDP and shall sit at the main Campus; (3) The motion of amendment of any articles of this Constitution shall be presented by the government or any ISRC member; (4) Subject to sub-article (3) above if the motion is presented by ISRC member, a written notice specifying the articles(s) proposed to be amended should be supported and signed by two third (2/3) of ISRC members and lodged to the ISRC Secretariat fourteen days (14) prior to the ISRC meeting; (5) Where two third 2/3 of ISRC members support the motion through vote, the ISRC shall form a Constitution Committee of seven members amongst the ISRC members, which will be vested with the duty to draft such amendment of the articles of the Constitution; (6) The Chairperson and the Secretaries of Constitution Committee from each Campus shall form a joint committee which shall prepare a joint - report emanating from each committee report and present the same to the Special ISRC for deliberations and adoption the decision of which shall be met by the support of two third (2/3) of members from each campus sitting in the Special ISRC. Provided that the member who initiates such a motion shall not form part of the Constitution Committee. PART II MANAGEMENT OF PROPERTIES AND CONTRACTS 38 Special ISRC on amendment
  • 39. 51.(1) The management of the properties of the MISO shall be the responsibility of the student’s government which shall be answerable to the ISRC and the Baraza; (2) Matters relating to contract shall after negotiation by the relevant person or ministry be presented to the ISRC for discussion before signed by the relevant person; (3) Unless otherwise agreed any contract shall not exceed one academic year. 52.(1) The record of the Organization shall be kept in Organization Official documents (2) No member or group of students shall use the title of the Organization without the written consent of the Prime Minister; 53. (1) If any subject or matter is not covered by the provisions of this Constitution then such matter(s) shall be placed before the ISRC for discussion and deliberations; (2) The regulations and by-laws amendment under the previous Constitution of 2009 shall be in use while pending the enactment of new by-laws and regulations; (3) Where the regulations and by-laws conflict with any other MISO laws, purposive approach shall be adopted in interpreting the regulations and by-laws. However in all cases the MISO Constitution of 2012 shall be the guidelines to all regulations and by-laws; 54. This Constitution shall be referred to as the Constitution of IRDP Students organization of 2012; 55. This Constitution shall come into operation upon the approval of the Institute Board of Trustee. 39 Management of MISO Properties Documentation and Recording Lacuna Declaration Approval by the Governing Board The operation of the Constitution
