Text of Applica on Seeking reply against viola on of Chapter 3A of Patna High Court Rules,
1916 by the Registry of Patna High Court.
That Supreme Court ma er, Writ Pe on (Criminal) 136 of 2016 has
come up for quashing of fake 498(A) before Patna High Court a er the
suspicious death of Pe oner no.02 Widow Srmt. Asha Rani Devi on
11.11.2017 as Cr. WJC Token no. 45078 of 2019 en tled Om Prakash &
Anr Vs. State of Bihar & Ors.
i) Why Criminal stamping filing sec on of Patna High Court did not
allow the pe oner in person to file the pe on on 17.06.2019 and
18.06.2019 which is evident from the Affidavit a ested by Oath of
Commissioner on 17.06.2019
ii) Why the defects have been no fied by Mr. P.K. Verma, A.S.O Patna
High Court, a er 17 days from the date of filing of the case While as
per the Patna High Court Rules, 1916, any defect or deficiency is
pointed out, the ma er shall be so reported as early as possible, but in
not more than 3 working days in the form as prescribed from me to
me. In case the Stamp Reporter is unable to complete the Stamp
Repor ng within specified 03 days for want of relevant record/for any
other reason, he shall complete Stamp Repor ng within 15 days from
the date of filing.
iii) Why Stamp reporter Mr. Dheeraj Kumar has reported the ma er for
Single Bench (SJ) while pe oner has opted for Division Bench or
Special Bench in Presenta on form for Criminal Ma er which is evident
from the stamp repor ng check slip dated 22.06.2019 and filing
proforma at page no.01 in the pe on Moreover, as per the Patna High
Court Rules, Supreme Court ma er is listed before Honble Chief Jus ce
of High Court.
iv) Why the ma er has neither been registered nor been listed nor
been put up For order before Honble Judges by the Registry as on date
even a er removal of defects on 09.07.2019 by the pe oner While as
per the Patna High Court Rules, in case the pe oner in person raises
dispute Where the Registrar General is not in a posi on to adjudicate,
the Registrar General will place the ma er before the Bench under the
heading For orders.
v) When the ma er will be listed before the Division Bench comprising
Honble Chief Jus ce of Patna High Court for hearing in view of the
gravity of the ma er
vi) Why Registry is viola ng the Rule of Law and Human Rights of the
pe oner again in 2019 which may lead to another suspicious death of
Shri Om Prakash herein pe oner no.01 which has resulted in
suspicious death of Widow Srmt. Asha Rani Devi, pe oner no.02 in
2017
vii) Whether the Criminal Writ Jurisdic on Case Token No. 45078 of
2019 will be listed before the Honble the Chief Jus ce of Patna High
Court for hearing or NOT
