Free Immigration Consultations

 Make sure all information and emergency contacts are up
to date at your children’s school(s) and doctor’s office,
including who can and cannot pick up your children
o Make sure your children know who can and
cannot pick them up from school, and who will
care for them
o If you have a restraining order against anyone,
make sure to give a copy of it to the school
o Write down instructions if your child has any
medical conditions and/or takes any medications
and give a copy to your child’s school and the
adult you designate
 Meet with your lawyer to designate and document
someone you trust with Power of Attorney to make
financial, legal or childcare decisions in your absence
 Make sure your children all have passports
o You can obtain these from a consulate’s office
 Talk to a friend or family member who has legal status in
the United States about how to access money to pay for
an immigration bond
o Bond means that a judge will set an amount of
money to pay in order to be released until you
need to report to court
o Save money in case you are granted bond. Bond
usually ranges from $7,000 - $15,000
 You might only be able to make one phone call while
detained – but memorize all important phone numbers.
o When you make your phone call, make sure to
tell the person:
 Which jail you are being held in
 Your ID#
 Your A#
 Your Birthdate
o And ask them to call your attorney.
o Family members can use the ICE detainee
locator: https://locator.ice.gov/odls/homePage.do

 If you need legal advice on immigration
matters, make sure the person helping
you is authorized to give legal advice
 Only an attorney or an accredited
representative working for a Board of
Immigration Appeals-recognized
organization can give you legal advice
 Being a “notario público” does not
authorize someone to provide you
with legal advice
 If you have a criminal history, make
sure your attorney has specialized
knowledge and experience in the
immigration consequences of crimes
 There is a lot of misinformation in the
community; do not rely on rumors or
false promises.

You have the right to:
 Not open the door
 Remain silent and not answer any questions
 Slide your “Know Your Rights” card under the door
 Ask to see a court warrant by sliding it under the door
or showing it through a window
 Make sure the warrant is signed by a JUDGE
 You can refuse to let ICE into your home without a
signed warrant from a judge.
 Call a U.S. citizen friend of family member to let them
know what is happening
 Call an experienced immigration attorney.
Your Rights- In Your Home
In a car, on the street, in a public space, at work, you have the
right to:
 Remain silent. This means you have the right not to answer
any questions
o Do not lie. It is better to say nothing than to lie
 Ask if you are under arrest or free to leave. If you are free
to leave, ask to leave
 An attorney. Ask to call your lawyer
 You can refuse to give your fingerprints
Stay calm. Do not run or resist arrest. Keep your hands where the
officer can see them.
Remaining silent does not mean that you will not be arrested, but it
is your right not to give ICE any information that can be used
against you.
- ICE needs information about where you are from to place
you into immigration court.
- Your passport is enough evidence for ICE to prove who you
are and where you are from. If you do not have
immigration status, consider where to keep any foreign
identification documents including passport, driver’s
license, national identification card, etc.
How to be Prepared if Arrested by ICE
 You have the right not to give any
information to ICE agents especially what
country you are from
 If you have any undocumented family
members, advise them not to visit you
 Call an immigration lawyer and if you have
any criminal background make sure you talk
to a lawyer with expertise in criminal matters
If You Have a Court Date in
Immigration Court: GO TO COURT
 If you don’t go to a scheduled hearing, you
will be ordered removed and a warrant will be
issued for your arrest. You will not be eligible
for bond.
 Being ordered deported is something that will
always be connected to you, even if your
court date was more than 10 years ago.
 If you don’t have a lawyer at your first court
hearing you can ask for more time to find one
 In immigration court, you have the right to
have an attorney represent you but you
must find your own attorney and the attorney
is usually not free. Ask for the legal services
list of attorneys for free or low cost legal
assistance.

  • 1. Free Immigration Consultations with Attorneys  Make sure all information and emergency contacts are up to date at your children’s school(s) and doctor’s office, including who can and cannot pick up your children o Make sure your children know who can and cannot pick them up from school, and who will care for them o If you have a restraining order against anyone, make sure to give a copy of it to the school o Write down instructions if your child has any medical conditions and/or takes any medications and give a copy to your child’s school and the adult you designate  Meet with your lawyer to designate and document someone you trust with Power of Attorney to make financial, legal or childcare decisions in your absence  Make sure your children all have passports o You can obtain these from a consulate’s office  Talk to a friend or family member who has legal status in the United States about how to access money to pay for an immigration bond o Bond means that a judge will set an amount of money to pay in order to be released until you need to report to court o Save money in case you are granted bond. Bond usually ranges from $7,000 - $15,000  You might only be able to make one phone call while detained – but memorize all important phone numbers. o When you make your phone call, make sure to tell the person:  Which jail you are being held in  Your ID#  Your A#  Your Birthdate o And ask them to call your attorney. o Family members can use the ICE detainee locator: https://locator.ice.gov/odls/homePage.do How Can My Family and I be Prepared in Case of Arrest by ICE? AVOID SCAMS!  If you need legal advice on immigration matters, make sure the person helping you is authorized to give legal advice  Only an attorney or an accredited representative working for a Board of Immigration Appeals-recognized organization can give you legal advice  Being a “notario público” does not authorize someone to provide you with legal advice  If you have a criminal history, make sure your attorney has specialized knowledge and experience in the immigration consequences of crimes  There is a lot of misinformation in the community; do not rely on rumors or false promises. Know Your Rights 98 North Washington Street, Suite 106 Boston MA 02114 (p)(617)742-9296 (f) (617)742-9385 You have the right to:  Not open the door  Remain silent and not answer any questions  Slide your “Know Your Rights” card under the door  Ask to see a court warrant by sliding it under the door or showing it through a window  Make sure the warrant is signed by a JUDGE  You can refuse to let ICE into your home without a signed warrant from a judge.  Call a U.S. citizen friend of family member to let them know what is happening  Call an experienced immigration attorney. Your Rights- In Your Home In a car, on the street, in a public space, at work, you have the right to:  Remain silent. This means you have the right not to answer any questions o Do not lie. It is better to say nothing than to lie  Ask if you are under arrest or free to leave. If you are free to leave, ask to leave  An attorney. Ask to call your lawyer  You can refuse to give your fingerprints Stay calm. Do not run or resist arrest. Keep your hands where the officer can see them. Remaining silent does not mean that you will not be arrested, but it is your right not to give ICE any information that can be used against you. - ICE needs information about where you are from to place you into immigration court. - Your passport is enough evidence for ICE to prove who you are and where you are from. If you do not have immigration status, consider where to keep any foreign identification documents including passport, driver’s license, national identification card, etc. How to be Prepared if Arrested by ICE  You have the right not to give any information to ICE agents especially what country you are from  If you have any undocumented family members, advise them not to visit you  Call an immigration lawyer and if you have any criminal background make sure you talk to a lawyer with expertise in criminal matters If You Have a Court Date in Immigration Court: GO TO COURT  If you don’t go to a scheduled hearing, you will be ordered removed and a warrant will be issued for your arrest. You will not be eligible for bond.  Being ordered deported is something that will always be connected to you, even if your court date was more than 10 years ago.  If you don’t have a lawyer at your first court hearing you can ask for more time to find one  In immigration court, you have the right to have an attorney represent you but you must find your own attorney and the attorney is usually not free. Ask for the legal services list of attorneys for free or low cost legal assistance. Your Rights- Outside Your Home
