State regulation in field of
procurement
 The Ministry of Economic Development
and Trade of Ukraine shall be the
Authorized Agency;
 The Antimonopoly Committee of Ukraine
shall be the complaint review authority.

 Chamber of Accounts;
 Antimonopoly Committee of Ukraine;
 State Financial Inspection of Ukraine;
 State Statistics Service of Ukraine.

Principal functions of the
Authorized Agency
 to develop and approve regulatory and legal acts
necessary for implementation of this Law;
 to develop and approve the Public Procurement
System Development Strategy;
 to monitor public procurements;
 to summarize procurement practice, including
international practice;
 to study, summarize and disseminate the best
international procurement practice;
 to ensure that Authorized Agency’s web portal
focused on procurement issues

 to provide methodological aid to procuring entities at
no cost, including answers to inquiries of
stakeholders in respect of public procurement
 international cooperation in the field of procurement
 to organize and approve the training and advanced
training procedure for procurement specialists;
 to provide clarifications for the application of
procurement legislation
 to take actions to ensure efficient and rational use of
public funds and their maximal economy during
performance of public procurements
 to inform the general public on public procurement
policy and rules

Complaint Review Authority
 Acting for the purposes of unbiased and efficient
protection of rights and legitimate interests of
persons involved in public procurement
procedures
 Decisions of the complaint review authority shall
come into effect on the decision-making day
 Decisions of the complaint review authority may
be appealed against by the complainant or the
procuring entity at the court

The Chamber of Accounts, the
Antimonopoly Committee of Ukraine, the
State Financial Inspectorate of Ukraine
and the State Statistics Service of Ukraine
shall exercise control in the field of public
procurement within the scope of their
powers as defined by the Constitution and
laws of Ukraine.

Special Functions of the State
Treasury of Ukraine
 check validity of the documents before
payments under procurement contracts
are made;
 take measures to prevent payments from
a procuring entity's account under the
financial obligations assumed under a
procurement contract in the cases
specified by Law of Ukraine On Public
Procurement.
