Bangladesh and India implemented the LBA of 1974 and the enabling Protocol of
September, 2011. In the exchange of enclaves, India will transfer 111 enclaves with a
total area of 17,160.63 acres to Bangladesh, while Bangladesh would transfer 51
enclaves with an area of 7,110.02 acres to India. The issue of adversely possessed lands
along the India-bangladesh border in WEST BENGAL, TRIPURA, MEGHALAYA and ASSAM
has also been resolved.
A treaty entered into by India purportedly ceding Indian territory to a foreign power
is without effect in Indian law unless Parliament chooses to give effect to the same
through an amendment to the Constitution. This position was clarified by the
Supreme Court of India in In re: Berubari Union case (1960) .

Since independence, there have been pockets along the India Bangladesh border that
have traditionally been under the possession of people of one country in the territory
of another country. These are known as adverse possessions. during the visit of the
prime minister to Bangladesh in September 2011, a protocol to the 1974 land
boundary agreement between India and Bangladesh was signed. The protocol
addresses outstanding land boundary issues, including the issue of adverse
possessions, between the two countries.

The Committee for Citizenship Rights of the Chakmas and Hajongs of Arunachal Pradesh
(CCRCHAP) and Arunachal Pradesh Chakma Students' Union (APCSU) on Thursday
disapproved of the resolution moved and adopted by Arunachal Pradesh government in the
House rejecting citizenship for Chakmas and Hajongs in the state on Wednesday. The fact
that the state government has moved and adopted a resolution rejecting grant of citizenship
to the Chakma and Hajong applicants shows that it is not implementing the September 2015
judgement of the Hon'ble Supreme Court and deliberately creating obstacles to scandalize
and lower the dignity of the apex court.
Only the Union government was empowered to grant citizenship certificates
earlier, but Prime Minister Narendra Modi simplified the process in 2015 and
entitled state governments with this right.

Saudi Arabia has become the first country to give a robot citizenship.
Chhattisagrh has become the first state in the country to grant Indian
citizenship to the migrated Hindu families.

• Indian Constitution does NOT restrict eligibility to the top
constitutional offices of President and Vice-President to
natural-born citizens. There is also no question of placing any
such restriction on eligibility to become a Minister or Prime
Minister or Chief Minister.
•Who is a refugee? A refugee is a person who has fled their own country
because they have suffered human rights abuses or because of who they are
or what they believe in. Their own government cannot or will not protect
them and so they are forced to seek international protection.
•Who is an asylum seeker? An asylum-seeker is someone who has left their
country in search of international protection, but is yet to be recognized as a
refugee. 7

India grants asylum and provides direct assistance to some 200,000
refugees from neighbouring countries. As the country lacks a national
legal framework for asylum, UNHCR conducts registration and refugee
status determination (RSD)
The established position of New Delhi on refugees is that once normality
returns in their respective home countries, such persons should go back.
India has not ratified the 1951 U.N. Convention and 1967 U.N. Protocol
on Refugees

Tibetan-Canadian who was born in India and moved to Canada has obtained the
Overseas Citizenship of India (OCI). The OCI certificate became possible for
Tibetans after the Delhi High Court passed an order in September 2016 that
Tibetans born in India between 26 January 1950 and 1 July 1987 are citizens of
India by birth according to the Citizenship Act of India 1955.

Acquisition of Citizenship
1) By birth but not diplomats children
2) By descent – born outside and either of parents Indian
citizen but, registration with consulate/embassy
3) By registration – to person like a person married to a

conditions [the applicant is not a citizen of a country
that denies citizenship for Indians, renounce his/her
citizenship, adequate knowledge of a language
specified in the Eighth Schedule of the Constitution] &
distinguished person of science, philosophy, art,

• she surrendered her Italian passport on 1983 [thereby relinquishing her
Italian citizenship]
• 1983 chose to acquire Indian citizenship – for citizenship by registration -
only people of Indian origin, if they had resided in India for six months
before the date of their application, qualified - So, by naturalisation as
provided for under Section 6 of the Citizenship Act, 1955. Section 6 of the
Citizenship Act, 1955: enables any person not born in India or having
Indian parents to become an Indian citizen if he or she has resided in the
country for at least (14 years) on the date of application
• 1986 when Section 5 (c) was inserted in the Citizenship Act, 1955, through
an amendment - enables a foreign spouse marrying an Indian citizen to
acquire Indian citizenship by registration

Loss of Citizenship
• By Renunciation – renounced one’s child can resume citizenship
• By Termination – Voluntarily accept citizenship of another country
• By Deprivation – Compulsory termination – 7 years continuously out of country

• The PIO-OCI merger comes close on the heels of promulgation of an ordinance on
January 6 amending the Citizenship Act, 1955. The ordinance incorporated the
eligibility and additional benefits of PIO card in OCI card and provided certain other
relaxations to OCI card-holders. The relaxations include allowing breaks not
exceeding 30 days in the one-year continuous stay required before applying for Indian
citizenship and registration as an OCI by a minor born to Indian parents or by the
spouse of an Indian citizen or OCI after two years of marriage.

Overseas Citizenship of India (OCI)
The Constitution of India does not allow holding Indian citizenship and Citizenship of a
foreign country simultaneously.
Based on the recommendation of the High Level committee on Indian Diaspora, the
Government of India decided to register Persons of Indian Origin (PIOs) of certain
category as has been specified in the Section 7A of the Citizenship Act, 1955 as
Overseas Citizenship of India (OCI) Cardholder.
Registered OCI Cardholders shall be entitled to the following benefits:
(i) Multiple entry lifelong visa for visiting India for any purpose
(ii) Registered OverseasCitizen of India Cardholder shall be treated at par with Non-
Resident-Indians in the matter of inter-country adoption of Indian children
(iii) Parity with Non-Resident Indians (NRIs) in respect of all facilities available to them in
economic, financial, and educational fields except in matters relating to the
acquisition of agricultural or plantation properties. etc

In the exchange of enclaves, India will transfer 111 enclaves with a total area of 17,160.63 acres to Bangladesh, while Bangladesh would transfer 51 enclaves with an area of 7,110.02 acres to India. The issue of adversely possessed lands along the India-bangladesh border in WEST BENGAL, TRIPURA, MEGHALAYA and ASSAM has also been resolved. A treaty entered into by India purportedly ceding Indian territory to a foreign power is without effect in Indian law unless Parliament chooses to give effect to the same through an amendment to the Constitution. The fact that the state government has moved and adopted a resolution rejecting grant of citizenship to the Chakma and Hajong applicants shows that it is not implementing the September 2015 judgement of the Hon'ble Supreme Court and deliberately creating obstacles to scandalize and lower the dignity of the apex court. Only the Union government was empowered to grant citizenship certificates earlier, but Prime Minister Narendra Modi simplified the process in 2015 and entitled state governments with this right. Union Minister of State for Home Saudi Arabia has become the first country to give a robot citizenship. Chhattisagrh has become the first state in the country to grant Indian citizenship to the migrated Hindu families.
