Purpose of granting alimony
• to restrict any unfair financial results of a
divorce by providing sustenance to a non-

Types of alimony
• There are two types of alimonies
1. Interim maintenance that is given
during the time of court proceedings.
2. Permanent alimony that is awarded by
the court to be paid after the legal
separation.
• Permanent alimony is required to be paid

Amount of alimony
• 25% of the net salary of a husband was held
to be a "just and proper" amount. ( as
specified in Kalyan Dey Chowdhury vs Rita
Dey Chowdhury Nee Nandy case.
• Alimony does not constitute child support.
Maintenance for children’s needs is to be
provided separately by the father.
(Kulbhushan kumar case where the court
had capped it at 15%)
• Lump-sum settlement granted by the court
usually ranges from 1/5th to 1/3rd of the
husband's net worth and is a one-time
settlement.

Alimony under Hindu laws

• Maintenance can be raised and lowered as
per the changes in the husband's salary.

Conclusion
• Alimony laws under other religions like
Buddhists, Sikhs, and Jains are governed
by the Hindu Marriage Act, 1955.
• maintenance can also be claimed through
civil laws like the Special Marriage Act
