Introduction
An Act to provide for the constitution of commercial
courts, commercial division and commercial appellate
division in the High Courts for adjudicating commercial
disputes of specified value and matters connected
therewith or incidental thereto.
The Act has recently been enacted in an attempt to
reduce judicial delays, at least as far as commercial
disputes are concerned.

ACT
The Act essentially introduces setting up of a
Commercial Court at District level and a
Commercial Division in the High Court, having
ordinary original civil jurisdiction to deal with
Commercial Dispute of a Specified Value, not
being less than Rs.1 Crore or such higher
value as may be notified by the Central
Government. All appeals from the orders of
the Commercial Court/Commercial Division
would lie before the Commercial Appellate
Divisions to be set-up in all High Courts.

COMMERCIAL DISPUTES
The Act applies exclusively to commercial disputes
and defines these widely as including disputes arising
out of the ordinary transactions of merchants,
bankers, financiers and traders, agreements for the
sale of goods or provision of services, partnership
and joint venture agreements, shareholders
agreements, franchising and licensing agreements,
construction and infrastructure contracts,
commercial property agreements, insurance,
subscription and investment agreements, intellectual
property rights etc. This includes commercial
disputes with the government and government
agencies.

SPECIFIED VALUE
The value of the subject matter in respect of the suit
which shall not be less than ten (10) million rupees
[about USD 150,000] or such higher value, as may be
notified by the Central Government. The purpose of
such segregation of Commercial Disputes of the
given Specified Value from other disputes is to
ensure that the selected disputes are speedily and
efficiently resolved by the Special Courts.

TIMELINES
1. Plaintiff may seek leave to file additional documents within
30 days of filing the Suit.
2. To be filed within 30 days and not later than 120 days from
the date of service of summons.
3. Parties to complete inspection of documents within 30
days from the date of filing the Written Statement or
Written Statement to the Counter Claim whichever is later.
The Court may extend the time limit upon application at its
discretion, but not beyond 30 days in any event.
(Therefore a maximum of 60 days).
4. To be completed within 15 days of completion of
inspection or any later date fixed by the Court.

5. Court shall hold first case management hearing
not later than 4 weeks from the date of filing of
Affidavit of admission or denial of documents by
all the parties to the suit.
6. Court shall ensure that arguments are closed not
later than 6 months from the date of the first
case management meeting.
7. Party to submit written arguments 4 weeks prior
to commencing oral arguments.
8. Commercial Court, Commercial Division or
Commercial Appellate Division shall within 90
days of conclusion of arguments pronounce
judgment.

APPEAL
The appeals against decisions of the
Commercial Courts/Commercial Division can
only be brought before the Commercial
Appellate Division of the concerned High
Court within sixty (60) days from the date of

JURISDICTION OVER
ARBITRATION MATTERS
As far as Arbitration is concerned, the Act provides that all the
matters dealing with international commercial arbitration must
be brought within the ambit of High Court irrespective of the
fact whether the High Court exercises such jurisdiction or not.
However, there is a proviso added to this clause which provides
that the matters pertaining to the appointment of arbitrators in
international commercial contracts must be excluded from the
purview of High Court’s jurisdiction. Commercial Court will also
have the power to hear appeals filed against domestic
arbitrations involving Indian parties, which initially lie before
any civil court other than High Court exercising territorial
jurisdiction over such arbitration.
