defended its tag line “ALLROUND PROTECTION” for Oral-B

defendant, upholding the ruling of Delhi HC. Held- “Tag lines
were valid and the duty of determining whether the present tag

• Goswami will have to prove that the phrase is identifiable
with him and is an integral part of his personality to be
successful in preventing its further use by Times Now.
• Goswami could argue that the use or delivery of the phrase
by TV anchor Anand Narasimhan after his departure from the
channel amounts to a violation of his personality rights-
which the Madras High Court placed on par with the Right to
privacy under Article 21 of the Constitution
• He made the phrase popular in the show therefore can claim
proprietorship over the mark

nation wants to know” has acquired the requisite
distinctiveness as the consumer has adopted the
slogan to identify it with their show, the Newshour,
which is still on air following Goswami’s departure
from the channel in November
• It was only after the phrase was made popular on
Times Now that other journalists started using the
phrase
• Argued that the expression “the nation wants to
know” has been used below the Times Now logo since
9 January 2013.
• But, applied for Trademark as a “Proposed to be
Mark” in November 2016

• Times Now claims that its contracts with employees
incorporate a clause that “all intellectual property created
during the course of employment would vest with Times
Now”.
• Such terms in contracts are common now-a-days and exist
undoubtedly to protect the employers' interests.
• Therefore, it seems that even if nation wants to know was
indeed brought into vogue by Goswami, it is Times
Now which would have ownership rights over usage of the
phrase.

injunction in Delhi High Court against the use of the
expression “the nation wants to know” on Republic TV
• Senior Advocate Rajiv Nayyar said that Arnab's new
show titled "Nation Wants to Know" was a case of
passing off.
• Justice Manmohan observed that “whether passing
off had occurred or is occurring at all, is questionable”
as both are still fighting for the mark
• The court ordered Republic TV to file a written
statement on the matter within four weeks of time

• If Goswami's application was retaliation against the
trademark application filed by Times, a better approach
would have been to instead oppose their application
• As an opponent, Goswami could also rely on Section 11
(10) of the Trademarks Act, which states that the Registrar
shall take into consideration "bad faith" of the applicant
when registering a mark;
• Goswami could argue that the fact that Times' trademark
application coincided with Goswami's resignation
from Times Now is indicative of bad faith on the part
of Times Now.
• Goswami’s interests are best served if the phrase is not
trademarked and the public at large is allowed to use it as
the slogan is so uniquely associated with him
