Five requisite elements of a NVNB claim
1. That a 'measure' has been applied by a party subsequent to the entry
into force of the relevant trade agreement;
2. That a 'benefit' was reasonably expected by the other party as being
negotiated in return for some textual agreement;
3. That as a result of the application of the measure that benefit has

Hence the moratorium has

from one Ministerial
Conference to the next. The
TRIPS Council agreed to
recommend extending the
present period until the next
conference .
In 2015 90 developing and least-developed countries led by Peru
formally presented their proposal at the TRIPS Council, calling
for a permanent moratorium for applying NVCs to disputes under
the agreement.
