DENOTE?
A hashtag is an expression of an idea or a theme; it
promotes something; and, apart from brand
identity, can be searched for and commented on.
For instance, on any social platform, a hashtag that
denotes #iplaw can quickly enable users to find
relevant posts on ip law.
Today, in addition to providing the search-related
functionality for which they were first developed,
hashtags provide businesses new ways to engage
with consumers.

Can we trademark a
hashtag?
A trademark is an identifier of the quality of
the goods or services and the source of
those goods or services identified by the
mark.
Since hashtags are not ideas or inventions
subject to patent protection, and are too
short to qualify for copyright protection , the
best bet for securing rights to a hashtag is
through trademark protection.
Some companies have started to trademark

Trademark law divides trademarks into 45
classes, and the same name or logo can be
trademarked by different persons in
different classes. It is still unclear, however,
how will this use and ability to trademark the
same name or a logo but in different classes
apply to trademarked hashtags. One would
need to register hashtag applications in a
particular class of products or services rather
than in the class for online forums and
communications.

In 2013, the U.S. Patent and Trademark
Office added a new section to the Trademark
Manual of Examination Procedure on
registration of hashtag marks. The USPTO
defines a hashtag as “A form of metadata
comprised of a word or phrase prefixed with
the symbol ‘#’ “ and states that a hashtag
mark may be registerable, but only if it
functions as an identifier of the source of the
applicant’s goods or services.

 The context in which the hashtag is used
For example, one company tried to register the
hashtag #SEWFUN for instruction in the field of
sewing. However, the company only used the mark
in a social media namely, on Twitter to organize
users comments about sewing classes. The USPTO
refused registration of the hash tag, finding that the
hashtag failed to function as a trademark.
 The placement of the hashtag
If used before a number (such as "#9"), the hashtag
will be viewed as meaning “number nine” instead of
“hashtag nine.”

 Usage of the hashtag
Just because a company uses a hashtag in its social
media or advertising material does not mean it
warrants trademark protection.
 Identification of goods or services
The hashtag cannot merely describe or generically
identify the underlying goods or services. For
example, using the hashtags “#coffee” for a coffee
shop does not identify the source of the coffee but
merely identifies the relevant product class. On the
other hand, “#Starbucks” signifies a specific source of
coffee.

It is important for companies to consider the amount of
time the hashtag will be valuable to the company.
Barring any substantive refusals, it usually takes
between six to eight months for a mark to be
registered. It is likely not worth pursuing registration
for hashtags with a short-term use.

TACO JOHN
In 2010, a chain of Mexican restaurants called Taco
John’s relied on its federal registration for “Taco
Tuesday” and sent a cease desist letter to Iguana
Grill for its use of #tacotuesday for their own
promotion efforts. Although Iguana Grill stopped
using the mark, Taco John’s forceful protection of
their mark generated considerable and
detrimental public criticism of their company while
providing free media and marketing buzz for
Iguana Grill.

FRATERNITY COLLECTION
In March of 2015, a court ruled that a hashtag could
contribute to consumer confusion. In this case
(Fraternity Collection, LLC v. Fargnoli), a clothing
maker called Fraternity Collection brought
trademark infringement claims against a former
designer based on use of the (unregistered)
trademark hashtags #fratcollection and
#fraternitycollection.

You can trademark a hashtag so long as you are
providing a product or service to the general public
associated with that hashtag. You can use a hashtag
as a brand name or slogan for your product or
service, in much the same way that any other name
or phrase or combination of words can be used to
brand a product or service. In order to register a
trademark for a hashtag, you must demonstrate to
the United States Patent and Trademark Office that
you are using that hashtag to promote or sell your
products or services.

CONCLUSION
As competition for attention among social media
users increases, trending tags may become an
increasingly prized commodity. On the other hand,
given the ephemeral nature of some hashtags and
the fleeting popularity of social media fads,
companies should consider the long-term viability of
a particular hashtag before expending time and
resources to protect it. In any event, before
adopting hashtags for social media campaigns, it is
imperative to research potential conflicts, which
may include trademark clearance searches to
identify conflicting uses. And if a hashtag has already
become an effective marketing tool, it may be time
to consider registering it as a trademark.

In sum, trademarking a hashtag may be a smart
business move, however, many unique factors must
be considered before making the investment. In
sum, while the USPTO allows for the registration of
hashtags where they function as a source identifier
of a party’s goods or services. Only one thing is
certain, and that is the uncertainty of trademark
protection for hashtags. Until the legal status of
hashtags has been further established, trademark
owners should develop strategies to minimize the
risk to their investment in hashtags and protect their
brands from misuse on social media.
