WORKERS’
COMPENSATION
Employers in Maryland are generally required
to carry workers’ compensation insurance. If
you are employed by a company that carries
workers’ compensation, you are mostly likely
eligible for benefits. Workers covered by
workers’ comp are eligible from the first day
on the job. Workers’ comp is also a “no-fault”
program, so you should be given benefits
regardless of who was responsible for a
workplace accident.

third party - someone other than your
employer - you can file a third-party claim
to receive compensation. Examples of
third parties that might be responsible for
a workplace injury include…

If you are a contractor and aren’t
eligible for workers’ compensation
benefits, you might be able to get
compensation through personal injury
claims. While workers’ compensation
insurance usually protects employers
from litigation by employees, a
contractor is not an employee and,
thus, can sometimes take direct legal
action against the company that hired
HOW WORKERS ARE
DENIED
COMPENSATION
A denial of workers’ compensation benefits.
An employer or insurer might dispute the
extent of a worker’s injury or claim that the
worker’s negligence negates their eligibility
for benefits.
Worker misclassification. In some cases,
businesses classify workers as contractors,
even though they would be more accurately
described as employees. In these situations,
a worker can seek workers’ comp benefits
by claiming they have been misclassified or
by filing a personal injury claim against
their employer.
